HomeMy WebLinkAboutORD 99-21 - Canceling Election District 6ORDINANCE AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, CANCELING THE ELECTION OF THE UNOPPOSED CANDIDATE FOR THE POSITION OF COUNCILMEMBER FOR DISTRICT 6 AND ELECTING HIM TO OFFICE; PROVIDING A SEVERABILITY CLAUSE; DECLARING THE NEED FOR EMERGENCY PASSAGE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Georgetown is a home rule municipality located in Williamson County, created in accordance with the provisions of the Local Government Code and operating pursuant to the enabling legislation of the State of Texas; and WHEREAS, in accordance with law, a general election has been ordered for May 1, 1999, for the purpose of electing a mayor and council members for Districts 2, and 6on the Georgetown City Council; and WHEREAS, no proposition or at -large issue is to appear on the ballot in that election; and WHEREAS, the City Secretary has certified in writing that only one candidate has filed an application for a position on the ballot; and WHEREAS, the filing deadlines for placement on the ballot and declaration of write-in candidacy have passed; and WHEREAS, in these circumstances, Subchapter C of Chapter 2 of the Election Code authorizes a governing body to declare the unopposed candidate elected to office and cancel the election for that posifon; and WHEREAS, in order to efficiently proceed with the business of the City, and due to the fact that the period for early voting begins on April 14, the day after this Council action vwill have been taken, it has been determined that this ordinance must be passed on emergency reading. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1 The facts and recitations contained in the preamble ofthis ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policies ofthe Century Plan - Policy Plan Element: SECTION 2 The following candidate, who is unopposed in the May 1, 1999 General Election, is hereby declared elected to office, and shall be issued a certificate of election at the Special Council Meeting to be held on Tuesday, May 4, 1999: Charles Burson, City Council Member District 6 SECTION 3 41 Cancellation of Election Ordinance No. Page I of 2 Pages It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4 If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5 The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
