HomeMy WebLinkAboutORD 99-12 - Single Member District PlanORDINANCE • , WHEREAS, in Ordinance 91-30, the City Council adopted the City's current single - member district plan and amended that ordinance with Ordinance 95-11, Ordinance 96-09, Ordinance No. 97-19 and Ordinance No. 98A3; WHEREAS, such plan was later approved by the United States Department of Justice to be used for selection of elected officials for the Mayoral and City Councilmember elections within the City of Georgetown; WHEREAS, the City has annexed additional property and is currently in the process of annexing certain property adjacent to the City limits, WHEREAS, these annexations and proposed annexation of property adjacent to the City limits of the City of Georgetown require that the City amend its single -member district plan to incorporate these newly annexed properties within the City's single -member district plan for election purposes; WHEREAS, the City election will occur immediately after the completion of all of the annexations; WHEREAS, since the approval of the U.S. Department of Justice is required to amend the City's single -member district plan, and such approval must be submitted well in advance of the City's election; WHEREAS, according to the most recent decennial census in 1990, these recent annexations contained significant population in 1990, necessitating that some of the existing single -member district boundaries be redrawn, WHEREAS, each of the annexed tracts is immediately adjacent to an existing single -member district boundary line; WHEREAS, the City Council hereby determines that the addition of these annexed tracts to the adjacent single -member districts and respective redrawing of district boundaries is in the best interest of the City; 1999 Revision to Single -Member District Plan, Ordinance No. _ `" / Page 1 of 4 NOW, - i• ORDAINED BY THE CITY COUNCILOF OF • ' i SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Governmental Affairs Policy 2 of the Century Plan - Policy Plan Element, which states: "The City will encourage all citizens to actively participate in governmental functions", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The following boundary revisions to the City's single -member district plan are hereby adopted: District 1 Park Central Section One (17.01 acres), Park Central Section Two (19.61 acres) and Benderson Trust (95.42 acres). A portion of Census Tract 214.03, Block 303C, having no 1990 population, shall be added to District 1. These properties were included with last year's ordinance as they were forecasted to be annexed prior to the May, 1998 election, however, these annexations were not completed until September, 1998. First reading of this ordinance included the 15 -plus -acre Felter Tract. As a result of first reading, the Felter Tract was included on last year's revised Voter District Map. However, prior to second reading, the Felter tract was omitted from the Park Central annexations. The Voter District Map shall be revised to reflect this omission. Kelley Trust Subdivision (18.31 acres). A portion of Census Tract 214.03, Block 303C, having no 1990 population, shall be added to District 1. Fullerton Tract (0.80 acres). A portion of Census Tract 215.01, Block 103B, having no population, shall be added to District 1. District 2 River Chase Subdivision (74.935 acres). A portion of Census Tract 201.03, Blocks 303A, 303E and 303C, having no 1990 population, shall be added to District 2. District 4 Sun City Georgetown Phase 4A (123.564 acres). A portion of Census Tract 201.01, Block 104, having no 1990 population is being added to District 4. Sun City Golf Course No. 2, Phase 1 Phase 2 (86.648 acres). A portion population is being added to District 4. (257.289 acres) and Sun City Golf Course No. of Census Tract 201.01, Block 104, having 1999 Revision to Single -Member District Plan, Ordinance No. q ° � 1 Page 2 of 4 2, rare] Dicotec Subdivision Lots 3 and 4 (1.96 acres). A portion of Census Tract 201 .01, Block 408, having no population, is being added to District 4. Shell Ranch Section 3 (17.7368 acres). A portion of Census Tract 201.01, Block 201, with no 1990 population is being added to District 4. District 6 FM 971 (571 acres adjacent to FM 971). All of Block 101 B out of Census Tract 214.02; a portion of Blocks 111, 1121 113A, 114A, 114B, 115D and all of Blocks 1136, 115A and 115C out of Census Tract 208.98; and a portion of Blocks 510B and 511 out of Census Tract 201.02, having a 1990 population of 27, shall be added to District 6. Racial breakdown is as follows: NHW NHB H NHOther 27 0 0 0 Chisholm Park (36.575 acres). A portion of Census Tract 208.98, Block 101 B, having a 1990 population of 3, shall be added to District 6. A portion of Census Tract 208.98, Blocks 115A and 115D and Tract 214.01, Block 101B, having no 1990 population, shall be added to District 7. Katy School Subdivision (51.525 acres). A portion of Census Tract 208.98, Block 1148, having no population, shall be added to District 7. SECTION 3. The map attached as Exhibit A is hereby adopted as the official single -member district boundary maps, reflecting the changes in census blocks specified in Section 2. The chart attached as Exhibit B identifies the population distributions for each district. SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or -application,_ and to this end the provisions of this ordinance are hereby declared to be severable. 1999 Revision to Single -Member District Plan, Ordinance No. `l Page 3 of 4 SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown, or on the effective date of the annexation ordinance, whichever date is later.
