HomeMy WebLinkAboutORD 99-09 - Historic Preservation CommissionORDINANCE i / AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING THE GEORGETOWN MUNICIPAL CODE BY AMENDING SECTION 12.38.040 "HISTORICAL PRESERVATION COMMISSION" ORIGINALLY PASSED AND ADOPTED ON THE 11TH DAY OF AUGUST, 1975 AND BY REPEALING ANY CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Historical Preservation Commission Board wishes to broaden the eligibility requirements for serving on the commission, and WHEREAS, by decreasing the number of "historic property owner" and "business operator within a historic district" positions from five to two, and by changing the category to be "property owners or business operators within a historic district", and WHEREAS, by expanding the number of historic districts to include not only the Downtown Historic District but also the Belford and Elm Street National Register Historical Districts, for purposes of membership only but not jurisdiction; and WHEREAS, the number of "citizen -at -large" positions will increase from two to five and "citizen -at -large" shall be defined as any person residing within the city limits.; and WHEREAS, the one county commissioner position shall be further clarified to be the Precinct 3 Commissioner only or the County Judge and shall be without a term limit; and WHEREAS, the cumulative effect of these changes will, while maintaining the same number of members, allow the City Council to appoint Historic Preservation Commission members from a broader pool of qualified candidates; and WHEREAS, the Chapter 12.38.040-C of the Georgetown Municipal Code needs to reflect the current practice and advisory board governance policy of two-year term limits; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT. SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policies of the Century Plan: HPC Membership Amendment Ordinance 1 of 2 A. Historic Preservation Policy 9.0 which states, "Prehistoric, historic, and cultural resources are preserved, protected and promoted." and B. Urban Design Policy 13.0 which states, "Georgetown has a positive, identifiable image and an attractive appearance"; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. Chapter 12.38.040 of the Georgetown Municipal Code of the City of Georgetown, Texas, is hereby amended as shown in Exhibit A. SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown. The Historical Preservation Commission shall be composed of 2 property owners and/or business operators within historical districts as defined in this chapter, and also to include the Belford and Elm Street National Register Historic Districts; five citizens -at -large defined as anyone residing within the Geogetown city limits, one member of the Planning and Zoning Commission, and the Williamson County Precinct 3 Commissioner or the Williamson County Judge. Each member appointed shall be considered based upon their interest in the City, knowledge of the history of the community, education and interest in the historical and cultural preservation and development of the City as exemplified by their background in the areas of history, art, architecture, and real estate. C. Each member, except the Precinct 3 County Commissioner or the County Judge, appointed to the Historical Preservation Commission shall serve for a term of two years except that the initial members appointed shall serve on staggered term........
