HomeMy WebLinkAboutORD 99-05 - Adding MLK HolidayAN ORDINANCE PERSONNEL, OF THE CITY OF GEORGETOWN CODE OF ORDINANCES, TO REVISE DESIGIIATED MARTIN LUTHER KING JR., DAY AS AN OFFICIAL CITY HOLIDAY APPLICABLE OF O• PROVIDING • AND SETTING ANT EFFECTIVE DATE. WHEREAS, Dr. Martin Luther King Jr., 1929 - 1968, was a civil rights leader and is one of the world's best known advocates of non-violent social change; and WHEREAS, Martin Luther King Jr. Day is a national holiday; and, WHEREAS, under the provisions of the Charter of the City of Georgetown, Texas, Article II, Section 2.16 mandates the Council to establish a Personnel Policy by Ordinance; and, WHEREAS, the City staff has prepared the review and recommended modifications and revisions to the Personnel Policy; and, WHEREAS, the Council has determined that the adoption of this Ordinance is imperative for the orderly and timely implementation of the Personnel Policy; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policy of the Century Plan - Policy Plan Element: 1. Facilities and Services Policy End 4.0, which states: "The City provides for the safety of its citizens and supports the responsive delivery of coordinated services by the City and other public agencies", 2. Facilities and Services Focus End 4.2 which states: "The City has a high level of employee satisfaction and retention", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. The City Council hereby adopts the amendment to Chapter 3.01 of Title 3, Personnel, of the City of Georgetown Code of Ordinances, revising designated holidays to adopt Martin Luther King Jr., Day as an official City holiday applicable to employees of the City of Georgetown, as stated in Exhibit A which is attached hereto and incorporated herein by reference as if copied verbatim. SECTION 3. The City Manager is hereby authorized to determine the appropriate procedures to implement the holiday and make whatever changes as may be necessary. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end of the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect on December 8, 1998. POLICY The following days are recognized as City -paid holidays during the fiscal year: HoIida Thanksgiving Day Christmas New Year's Day Martin Luther King Jr. DaX Memorial Day Independence Day Labor Day Two Personal Holidays Date Observed Fourth Thursday in November and the following Friday December 24 and 25 January 1 Third Monday in January Last Monday in May July 4 First Monday in September To be selected by the full e employee Such other holiday as the City Council may declare. Part-time employees earn holiday leave on a pro -rated basis.
