AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS AMENDING SECTION 12.38.040 OF THE CODE OF ORDINANCES RELATING TO MEMBERSHIP OF THE HISTORICAL PRESERVATION COMMISSION; PROVIDING A REPEALING CLAUSE AND SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE. WHEREAS, Section 12.38.040 of the Code of Ordinances of the City of Georgetown created an Historic Preservation Commission and establishes its membership; WHEREAS, the City Council has determined that the public's best interest shall be served by repealing the requirement that one of the Commission's members be the Williamson County Precinct 3 Commissioner or the Williamson County Judge and replacing it with the requirement that one of the Commission's members be an employee of Williamson County who offices in the historic Williamson County Courthouse; and WHEREAS, the current provision in Code of Ordinances concerning the length of the Commission members' terms of office is inconsistent with State law and the City Council finds it to be in the public's best interest to revise the provision to be consistent with State law; and WHEREAS, the caption of this ordinance was printed in the Williamson County Sun on November 8, 2000, in compliance with the City Charter of the City of Georgetown; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following elements of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter the Policy Plan: Governmental Affairs 6.0 — A high level of cooperation and involvement exists among Georgetown's citizens and governmental organizations. SECTION 2. Section 12.38.040(B) and (C) of the Code of Ordinances of the City of Georgetown is hereby amended to read as follows: Historical Preservation Commission Ordinance No. Page 1 of 3 "B. The Historical Preservation Commission shall be composed of two property owners andlor business operators within historical districts as defined in this chapter, and also to include the Belford and Elm Street National Register Historic Districts; five citizens -at -large defined as anyone residing within the Georgetown city limits, one member of the Planning and Zoning Commission, and an employee of Williamson County who offices in the historic Williamson County Courthouse. Each member appointed shall be considered based upon their interest in the City, knowledge of the history of the community, education and interest in the historical and cultural preservation and development of the City as exemplified by their background in the areas of history, art, architecture, and real estate. C. Each member appointed to the Historical Preservation Commission shall serve for a term of two years." SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5, The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
