HomeMy WebLinkAboutORD 2000-55 - Extension of Dev Application1RDINANCE NO. 4 0400 •�� • • • • •'� i .III • • � +' ':Y i • .• i JJr.� ..• r • A A Ia i' WHEREAS, on April 25, 2000, the City Council adopted Ordinance No. 2000-22, which included the implementation of the Urban Design Element of the Century Plan in Parts Five and Six of the Zoning Ordinance ("Urban Design Standards"); and WHEREAS, the Zoning Ordinance exempted previously approved Detailed Development Plans from compliance with the Urban Design Standards for a period of 180 days, if a building permit was secured within that time; and WHEREAS, said 180 -day period will expire on November 9, 2000; and WHEREAS, the City Council finds that it is in the best interest of the public to extend the time period for development of previously approved Detailed Development Plans under certain conditions. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, that: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policies of the Century Plan ' Policy Plan Element: ® Growth and Physical Development Policy 7.1 which states "The City's regulations implement the Policy ends and provide the opportunity to seek change with reasonable effort and expense"; and ® Urban Design Policy 11.0 which states "Georgetown's citizens and businesses enjoy an attractive community with a unique sense of place and a positive, identifiable image, at a cost which is consistent with other City social and economic priorities"; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, Ordinance No. 4000 Extension of Exemption of Previously Approved Detailed Development Plans from Urban Design Standards Page 1 of 3 SECTION 2, Section 6. of Ordinance No. 2000-22 is hereby amended to extend the 180 -day time period during which previously approved applications under the Subdivision Regulations have an opportunity to be exempted from this ordinance ("Exemption Period") for a 12 -month period extending from November 9, 2000 and expiring on November 8, 2001 ("Extended Exemption Period") under the conditions stated in this paragraph. Specifically, any previously approved applications under the Subdivision Regulations which were approved prior to the effective date of the Urban Design Standards, which have not made application for a building permit prior to 5:00 p.m. on November 9, 2000, may submit an application for a revised Detailed Development Plan ("Revised Detailed Development Plan"). The Revised Detailed Development Plan shall upgrade the previously approved Detailed Development Plan such that one of the Urban Design Standards which is at least 50% deficient shall be brought into full compliance with the Urban Design Standards. If more than one of the Urban Design Standards is deficient, the property owner shall select, at their sole discretion, which Urban Design Standard shall be brought into compliance SECTION 3. The Exemption Period in Section 6. of Ordinance No. 2000-22 is clarified to exempt only those properties for which an application for a building permit is made for at least one (1) structure on the site of a previously approved application under the Subdivision Regulations prior to 5:00 p.m. on November 9, 2000, and a certificate of occupancy is received for the structure by November 8, 2001. SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. Unless subsequent action extends the application and enforcement of the amendments contained in this ordinance, the amendments shall expire at 5:00 p.m. on November 8, 2001, SECTION 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
