AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING SECTION 10.16.080 OF THE CODE OF ORDINANCES TO PROHIBIT THE PARKING OF COMMERCIAL VEHICLES IN DESIGNATED PUBLIC PARKING AREAS; DIRECTING THE CITY MANAGER TO ERECT APPROPRIATE SIGNS INDICATING SUCH ZONES; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Georgetown, Texas, deems it necessary and proper to amend Section 10, 16.080 of the Code of Ordinances of the City of Georgetown entitled "Parking in certain areas restricted", to prohibit the parking or storing of commercial vehicles in areas designated for public parking; and WHEREAS, the Council finds that it is necessary, proper and in the best interest of the citizens of Georgetown to adopt the changes hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, that: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following Century Plan - Policy Plan Elements: • Transportation Policy End 10.00 -- "Citizens and commercial goods move safely and efficiently throughout all parts of the City"; and • Urban Design Focus End 11.07 -- "The impact of commercial and industrial land uses on single-family neighborhoods are minimized; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2. The City Council of the City of Georgetown hereby amends Section 10.16.080, A., of the Code of Ordinances entitled "Definitions of words and terms" to read as follows: "A. Definitions of words and terms. Words and terms used in this section shall have the meanings given them Chapter 541 of the Texas Transportation Code, unless otherwise specifically defined in this section. In this chapter: `Commercial vehicle'shall mean: Ordinance No. 000 ® 015 Prohibiting Parking of Commercial Vehicles in Public Parking Lots Page 1 of 2 1. a vehicle, including, but not limited to, a truck , truck tractor, road tractor, bus, motor home or other recreational vehicle, with a manufacturer's rated carrying capacity greater than one ton; and 2. special mobile equipment, including, but not limited to, a trailer, semi -trailer, pole trailer, house trailer, travel trailer, camper trailer, or boat trailer. `Store' shall mean the parking of a commercial vehicle on a regular basis. " The City Council of the City of Georgetown hereby amends Section 10.16.080, A., 4.7 of the Code of Ordinances entitled "Overnight parking of commercial vehicles on public street or way prohibited" to read as follows: "4. Overnight parking/storage of commercial vehicles on public street, public right-of-way or public parking area prohibited. No person shall park or store a commercial vehicle overnight on a public street, within public right-of-way or within a public parking area. This section shall not apply to the parking of vehicles owned or operated by federal, state or local government authorities. " SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5, The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
