HomeMy WebLinkAboutORD 2000-11 - Single-Member District PlanORDINANCE i AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING THE CITY'S SINGLE -MEMBER DISTRICT PLAN TO INCLUDE ANNEXATIONS, AND A DISANNEXATION, WHICH HAVE BECOME EFFECTIVE SINCE THE MAY 1, 1999 GENERAL ELECTION; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, in Ordinance 91-30, the City Council adopted the City's current single - member district plan and amended that ordinance with Ordinance Nos. 95-11, 96-09, 97- 19, 98-13 and 99-12; WHEREAS, such plan was later approved by the United States Department of Justice to be used for selection of elected officials for the Mayoral and City Councilmember elections within the City of Georgetown; WHEREAS, the City has annexed additional property and disannexed a property adjacent to the City limits since the May 1, 1999 general election; WHEREAS, these annexations and disannexation require that the City amend its single -member district plan to incorporate the newly annexed properties into the City's single -member districts and to remove the disannexed property for election purposes; WHEREAS, each of the annexed tracts, as well as the disannexed tract, is immediately adjacent to an existing single -member district boundary line, necessitating that the boundary lines be redrawn; WHEREAS, these annexations contained no population and according to the most recent decennial census in 1990, the disannexed tract contained a population of fourteen (14); WHEREAS, the approval of the U.S. Department of Justice is required to amend the City's single -member district plan, and such approval must be submitted well in advance of the City's election; WHEREAS, the City Council hereby determines that the addition of these annexed tracts to and the removal of the disannexed tract from the adjacent single -member districts and respective redrawing of district boundaries is in the best interest of the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference 2000 Revision to Single -Member District Plan, Ordinance No. ® ®'t� Page 1 of 3 herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Governmental Affairs Policy 2 of the Century Plan - Policy Plan Element, which states: "The City will encourage all citizens to actively participate in governmental functions", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The following boundary revisions to the City's single -member district plan are hereby adopted: District 1 Kelley Trust Subdivision Phases Two & Three (27.24 acres). A portion of Census Tract 214.03, Block 303C, having no 1990 population, shall be added to District 1. District 4 Shell Ranch Section Four, The Village Park (4.98 acres). A portion of Census Tract 201.01, Block 201, having no 1990 population, shall be added to District 4. Sun City Georgetown Phase 4-B, Neighborhood 17-A (19.310 acres). A portion of Census Tract 201.01, Block 104, having no 1990 population is being added to District 4. District 6 FM 971 Disannexation (29.88 acres adjacent to FM 971). A portion of Census Tract 201.02, Block 5108, having a 1990 population of fourteen (14), shall be removed from District 6. Racial breakdown is as follows: NHW NHB H NHOther 14 0 0 0 SECTION 3. The map attached as Exhibit A is hereby adopted as the official single -member district boundary map, reflecting the changes in Census blocks specified in Section 2. The chart attached as Exhibit B identifies the population distributions for each district. SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect 2000 Revision to Single -Member District Plan, Ordinance No. 000 Page 2 of 3 in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown, or on the effective date of the annexation ordinance, whichever date is later.
