AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, AMENDING SECTION 10.12.090 OF THE CODE
OF ORDINANCES OF THE CITY OF GEORGETOWN, TEXAS, TO
ESTABLISH SPEED LIMITS FOR INNERLOOP ROAD AND THE BERRY
CREEK LOW WATER CROSSING ON OAK TREE DRIVE; REPEALING
CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A
SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City has accepted dedication of right-of-way described in deeds
recorded at Volume 2682, Page 0193 and at Document Nos. 9832842, 9832843 and
9837230, Official Records of Williamson County, Texas, known as Innerloop Road; and
WHEREAS, the City desires to set a speed limit for the portion of Innerloop Road
contained within the city limits of the City of Georgetown;
WHEREAS, on December 10, 1996, the City of Georgetown annexed Berry Creek
Subdivision;
WHEREAS, the City desires to set a speed limit for the portion of Oak Tree Drive
which crosses Berry Creek known as the "Berry Creek Low Water Crossing";
WHEREAS, it is determined upon the basis of an engineering and traffic
investigation that the prima facie maximum speed limit for the portions of Innerloop Road
which lie within the City limits shall be set at 45 miles per hour and for the Berry Creek Low
Water Crossing on Oak Tree Drive at 20 miles per; and
WHEREAS, signs will be erected giving notice of the prima facie maximum speed
limits as so declared.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this ordinance
are hereby found and declared to be true and correct, and are incorporated by reference
herein and expressly made a part hereof, as if copied verbatim. The City Council hereby
finds that this ordinance implements Transportation Element of the Century Plan - Policy
Plan Element, which states: "Georgetown's transportation system provides for the safe
and efficient movement of traffic, promotes the economic interests of the community, and
adequately serves the needs of individuals.' and further finds that the enactment of this
ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required
by Section 2.03 of the Administrative Chapter of the Policy Plan.
SECTION 2. Section 10.12.090 of the Code of Ordinances of the City of
Georgetown, Texas, establishing speed limits on city streets is hereby amended to add
subsection E., 2. (orthe next consecutive numbered subsection) regarding Innerloop Road:

"E. 45 Mile Per Hour Zones:
2. lnnerloop Road: Beginning at the intersection of old U.S. Highway 89ISouth
Austin Avenue and continuing east along lnnerloop Road to the intersection of County
Road 115; and beginning at the intersection of U.S. Highway 29 East and continuing south
along lnnerloop Road approximately 3,007 feet to its intersection with Belmont Drive,
SECTION 3. Section 10.12.090 of the Code of Ordinances of the City of
Georgetown, Texas, establishing speed limits on city streets is hereby amended to add
subsection B., 32. (or the next consecutive numbered subsection) regarding the Berry
Creek Low Water Crossing on Oak Tree Drive:
"B. 20 Mile Per Hour Zones:
32, Berry Creek Low Water Crossing—Oak Tree Drive: Beginning at a point on
Oak Tree Drive sixty (60) feet west of the west curbline of Berry Creek Drive continuing
west across the Berry Creek low water bridge five hundred fifty (550) feet to a point sixty-
four (64) feet from the east curbline of Torrey Pines.
SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions,
in conflict with this Ordinance are hereby repealed, and are no longer of any force and
effect.
SECTION 5. If any provision of this ordinance or application of it to any person or
circumstance, is held to be invalid, the remainder of the ordinance which can be given
effect without the invalid provision or application shall applied as valid and is hereby
declared to be severable from the invalid portion.
SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This ordinance shall become effective and be in full force and effect
in (10) ten days on and after publication in accordance with the provisions of the Charter
of the City of Georgetown.
