AN ORDINANCE APPROVING THE GENERAL SERVICE RATES, INCLUDING RATE ADJUSTMENT PROVISIONS AND MISCELLANEOUS SERVICE CHARGES TO BE CHARGED FOR SALES AND TRANSPORTATION OF NATURAL GAS TO RESIDENTIAL, COMMERCIAL AND INDUSTRIAL CONSUMERS IN THE CITY OF GEORGETOWN, WILLIAMSON COUNTY, TEXAS; AND PROVIDING FOR THE MANNER IN WHICH SUCH RATES MAY BE CHANGED, ADJUSTED AND AMENDED; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR A SAVINGS CLAUSE AND REPEALING CONFLICTING ORDINANCES OR RESOLUTIONS. WHEREAS, on May 31, 2001, TXU Gas Distribution, a division of TXU Gas Company ("TXU") filed with the Governing Body of this municipality a Statement of Intent to Change Residential, Commercial and Industrial Rates charged to consumers within this municipality. Also filed was the Tariff for Gas Service in the South Region Distribution System, ("Tariff for Gas Service") and the supporting Cost of Service Schedules ("Schedules"). The Tariff for Gas Service includes Rate Schedules 4300 — South Region Distribution System Cities, 4301 — Residential Service, 4302 — Commercial Service, 4311-4313 — Industrial sales, 4314 — Industrial Transportation, 4321 — Industrial Sales and Transportation, 4308-1 through 4308-4 — Rate Adjustment Provisions, and 9001 through 9007 — Miscellaneous Service Charges; and WHEREAS, the City Council has determined it to be in the best interest of the citizens of Georgetown to adopt TXU Is proposed rate changes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Utilities and Energy Policy 14.6 of the Century Plan - Policy Plan Element, which states: "Franchised utilities provide adequate services for all citizens"; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2. The maximum general service rates for sales and transportation of natural gas rendered to residential, commercial and industrial consumers within the city limits of Georgetown, Texas by TXU Gas Distribution, a division of TXU Gas Company, a Texas Corporation, its successors and assigns, are hereby fixed and approved as set forth in Rate Schedules 4301 — Residential Service, 4302 — Commercial Service, 4311- 4313 — Industrial Sales, and 4314 — Industrial Transportation, and 4321 - Industrial Ordinance No.}, TXU Rate Change ag of Sales and Transportation included in the Tariff for Gas Service in the South Region Distribution System. SECTION 3. The Rate Adjustment Provisions set forth in the Tariff for Gas Service as Rate Schedules 4308-1 Gas Cost Adjustment, 4308-2 Tax Adjustment, 4308-3 Weather Normalization Adjustment, and 4308-4 Surcharges are approved. SECTION 4. TXU shall have the right to collect such reasonable charges as are necessary to conduct its business and to carry out its reasonable rules and regulations. Such miscellaneous service charges are identified in Rate Schedules 9001 through 9007 of the Tariff for Gas Service and are approved. Services for which no charge is set out may be performed and charges for by TXU at a level established by the normal forces of competition. SECTION 5. The aforesaid rate schedules herein approved shall be effective for bills rendered on and after the effective dates set forth in the Statement of Intent, if this ordinance is passed and approved on or before that effective date. SECTION 6. The rates set forth in this ordinance may be changed and amended by either the City or TXU in the manner provided by law. Service hereunder is subject to the orders of regulatory bodies having jurisdiction, and to TXU's Rules and Regulations currently on file with the City. SECTION 7. Unless otherwise noted herein, other than TXU Gas Distribution (a named party), no person or entity has been admitted as a party to this rate proceeding. SECTION 8. It is hereby found and determined that said meeting at which this ordinance was passed was open to the public, as required by Texas law, and that advance public notice of the time, place and purpose of said meeting was given. SECTION 9. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this ordinance are hereby repealed, and are no longer of any force and effect. SECTION 10. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 11. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect immediately upon its passage in accordance with the provisions of the Charter of the City of Georgetown.
