A •'i a i i • a r r. s 1 � e r r y i *. � a • i � ♦ i 1 .�. a . i * . r 1 WHEREAS, the City has rules and regulations governing the development of manufactured home parks within the City limits and the extraterritorial jurisdiction of the City; and WHEREAS, the City Council appointed a citizen committee known as the Housing Working Group (the "Committee") to prepare the Housing Element of the Georgetown Century Plan, which will contain policies on housing types, and affordable housing, including manufactured housing; and WHEREAS, the Committee has completed its review of the rules and regulations for manufactured homes within the City limits and extraterritorial jurisdiction and has submitted its findings to City staff for preparation of an ordinance for consideration by the Planning and Zoning Commission ("Commission") and subsequently by the City Council; and WHEREAS, a draft ordinance was presented to the Commission on March 5, 2001; WHEREAS, the Commission determined that due the number of new Commission members, it had not had ample time for review of the ordinance and does not anticipate being able to do so by the expiration of the fourth extension, April 13, 2001, at midnight; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, that: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policies of the Century Plan - Policy Plan Element: 1. Housing Policy 10.0 which states "The City cooperates with builders, developers, and property owners to provide safe and adequate housing opportunities for all citizens"; and Ordinance No. /' Fifth Extension of Manufactured Housing Moratorium Page 1 of 3 2. Growth and Physical Development Policy 7.1 which states "The City's regulations implement the Policy ends and provide the opportunity to seek change with reasonable effort and expense"; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2. The City of Georgetown hereby extends the suspension of the receipt, review, processing and approval of all new valid applications for projects intending to locate manufactured home units for residential occupancy within the City limits and its extraterritorial jurisdiction for two months from the expiration of the previous extension deadline of midnight on April 13, 2001 (per Ordinance No. 2001-09, adopted February 13, 2001). This fifth extension shall expire at midnight on June 12, 2001, SECTION 3. Any projects which are active as of the effective date of this ordinance are exempt from this suspension and may proceed so long as they continue through the development review process. In the event a substantive change is made to an active project which necessitates the submission of a new application, such new application shall be subject to the suspension. SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. Any person(s) or firm or corporation who shall violate any provision of this ordinance, or shall fail to comply therewith, shall be deemed guilty of a Class C misdemeanor, and upon conviction thereof, shall be punishable. Each day a violation shall continue shall be deemed to be a separate offense to the maximum fine allowed by State law for Class C misdemeanors. SECTION 7. Due to the approaching deadline of the fourth extension, the City Council finds it to be in the best interest of the citizens of Georgetown to adopt this ordinance on an emergency basis. SECTION 8. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effectively immediately upon adoption in accordance with the provisions of the Charter of the City of Georgetown.
