AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS AMENDING TITLE 2 OF THE CODE OF ORDINANCES ENTITLED "ADMINISTRATION" TO AMEND CHAPTER 2.48, CITY PLANNING AND ZONING COMMISSION, CHAPTER 2.64, BUILDING STANDARDS COMMISSION, CHAPTER 2.689 GEORGETOWN CONVENTION AND VISITOR'S BOARD, AND CHAPTER 2.72, CITY LIBRARY BOARD; PROVIDING A REPEALING CLAUSE AND SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Charter grants the City Council the authority to establish boards and commissions to assist it in carrying out its duties; and WHEREAS, the City Council desires to amend the ordinances relating to the Planning and Zoning Commission, the Building Standards Commission, the Convention and Visitor's Board and the Library Board, to provide for uniform terms of office, to revise qualifications for membership and to comport with State law; and WHEREAS, the City Council finds it to be in the best interest of the public to amend these ordinances; and WHEREAS, the caption of this ordinance was printed in the Willianison County Sun on February 7, 2001, in compliance with the City Charter of the City of Georgetown; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following elements of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan: Parks Plan Element 11.0: All citizens actively participate in community -wide social, cultural, and recreational activities. Ordinance No. Pey' Page 1 of 5 Amending Terms of Boards & Commissions Governmental Affairs Element 6.0: A high level of cooperation and involvement exists among Georgetown's citizens and governmental organizations. SECTION 2. Chapter 2.48, City Planning and Zoning Commission, of the Code of Ordinances of the City of Georgetown is hereby amended to provide as follows: Section 2.48.030 is amended to read as follows: "Section 2.48.030 --Terms. The term of office for members shall be two years. All vacancies shall be filled for the unexpired terms in the same manner as provided for in the original appointments. Members of the Commission may be removed by the Mayor, with the consent of the City Council, for cause stated in writing and after public hearing." Section 2.48.050 is amended to read as follows: "Section 2.48.050 --Organization. The City Council shall select a Chair of the Commission. The Commission shall select a vice -chair and such other officials as it deems necessary. The Commission has the power to make rules, regulations and bylaws for its own government to the extent provided for in Chapter 211 of the Local Government Code. These rules and regulations shall conform as nearly as possible with those governing the City Council and shall be subject to approval by the City Council. Such bylaws include, among other items, provisions, for: A. Regular and special meetings, open to the public; B. Records of its proceedings, to be open for inspection by the public; C. Reporting to the governing body and the public from time to time and annually; and D. The holding of public hearings on its recommendations." Section 2.48.060(I), is amended to read as follows: "1. To function as the City Zoning Commission and exercise all of those powers and duties permitted by Chapter 211 of the Local Government Code, the City Charter and City ordinances, as each may be amended from time to time." SECTION 3. Chapter 2.64, Building Standards Commission, Sections 2.64.010 and 2.64.015 of the Code of Ordinances of the City of Georgetown are hereby amended to provide as follows: Ordinance No. Page 2 of 5 Amending Terms of Boards & Commissions "2.64.010 Created—Membership. A. There is created and established in and for the City a Building Standards Commission to hear and determine cases concerning alleged violations of ordinances, as authorized by Chapter 54, Subchapter C, Texas Local Government Code and the City Code of Ordinances. B. The Commission shall consist of five members to be appointed for terms of two years. Commission members must live in the Georgetown city limits or in the City's extraterritorial jurisdiction. Four of the five members should be experienced in at least one of the following areas: real estate profession, architecture, engineering, building construction, fire protection, mechanical contracting (heating, ventilation and air conditioning (HVAC)), and/ or plumbing contracting. One Commission member will serve at -large. In the absence of qualified candidates from any of these categories, the City Council may waive these requirements to fill a vacant post. C. A Commission member may be removed by the City Council for cause on a written charge. Before the decision regarding removal is made, the City Council must hold a public hearing on the matter if so requested by the member that is subject to the removal action. 2.64.015 Alternate board members. A. The City Council shall be authorized to appoint up to four or more alternate members of the Commission who shall serve in the absence of one or more regular members when requested to do so by the Mayor or City Manager. B. Alternate members serve for the same period and are subject to removal in the same manner as the regular members. A vacancy is filled in the same manner as a vacancy among the regular members." SECTION 4. Title 2 of the Code of Ordinances Chapter 2.68, Convention and Visitor's Board, of the City of Georgetown is hereby amended as follows: Section 2.68.020(6) is amended to read: "6. Recommend to the Council for action contracts with certain tourism providers when such contracts conform to the City Charter, and all applicable State and local laws." Section 2.68.040 (A) is amended to read: "A. The Board consists of up to ten members. The terms of each of the members is two years." Title 2 Chapter 2.72 of the Code of Ordinances of the City of Georgetown is hereby amended as follows: "LIBRARY ADVISORY BOARD Section I. Created—Membership. A. There is created the Library Advisory Board of the City of Georgetown. The Board is to be composed of nine (9) mernbers. All members shall reside in the corporate City limits or extraterritorial jurisdiction of the City of Georgetown. B. The terms of office for Board members shall be two (2) years. Terns will be staggered so that four Board members' terns expire in evenly numbered years and the other five terns expire in odd -numbered years. Section II. Purpose and duties. A. The purpose of the Board shall be to participate in the Library Needs Assessment study, update the Long -Range Plan for the library and serve to promote library programs and services in the community. B. The Board is responsible to and shall act as an advisory body to the Council and shall perform such duties and exercise such additional powers as may be described by ordinances of the Council not inconsistent with the provisions of the Charter." SECTION 6. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 7. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 8. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
