WHEREAS, an application has been made to the City Council for the purpose of changing the zoning district classification of the following described real property ("the property"): SUN CITY GEORGETOWN, NEIGHBORHOOD THIRTEEN -B BEING A REPLAT OF NL BEING NED UNIT DEVELOPMENT OF SUN CITY TEXAS, PHASE 2, NEIGHBORHOOD THIRTE� , BLOCK 1, LOTS 4 TO 24; BLOCK 2, LOTS 25 TO 27 AND LOTS 233 TO 249; BLOCK 3, LOTS 78 TO 96 AND LOTS 228 TO 229; BLOCK 4, LOTS 100 TO 1410, LOTS 117 TO 127, LOT 168 AND LOTS 230 TO 232; BLOCK 7 LOTS i 32 T 0 i 57 AND LOTS 224 TO 227; AND BLOCK 8, LOTS 161 TO 167, BEING 40.521 ACRES IN THE BURRELL EAVES SURVEY, LOCATED ALONG SUN CITY BOULEVARD AS RECORDED IN DOCUMENT NUMBERS 9558175-9558177 OF THE OFFICIAL DEED RECORDS OF WILLIAMSON COUNTY. TEXAS, hereinafter referred to as "the property"; WHEREAS, the City Council has submitted the proposed change in the Base Ordinance to the consideration in a public hearing and for its recommendation or Planning and Zoning Commission for its report; and WHEREAS, notice of such hearing was published in a newspaper of general circulation in the City; which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and WHEREAS, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the lots within two hundred feet of the property, as required by law; and WHEREAS, the applicant for such zoning change placed on the property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing: and WHEREAS, the City Planning and Zoning Commission in a meeting held on October 5, 2002 recommended approval of said zoning district classification for the above described property being 40.521 acres from RP, Residential Planned district classification to RP, Residential Planned district classification revised or any more restrictive use, in accordance with attached Exhibit A. The City Council hereby finds that this ordinance imp Policies of the Century Plan -- Land Use Pian: Goal 1: Encourage the most desirable and efficient use of land while enhancing the physical environment through functional and compatible land use configuration; Objective 's .; : E ;su'? thGt a.v d=evelopments will be compatible with existing land uses in terms Of usedensity, building heights scale, and offsite effects; , Objective 1.5: Require zoning change requests to be consistent with the Future Land Use Plan; and, further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century PICA Policies, as required by Section 203 of the Administrative Chapter of the Policy Pian. SECTION 2. The Base Ordinance and the Zoning Map of he City, as well as the Zoning District for the Property shall be and the same is hereby 40.521 acres from RP, Residential Planned district classification to RP, Residential Planned district classification revised, in accordance with attached Exhibit A which is attached hereto and incorporated by reference herein is hereby adopted by the City Council of the City of Georgetown, Texas. If any provision of this Ordinance or application thereof to any person or circuthereomstance this shall be held invalid, such invalidity shall not affect the other provisions, or application Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are eretl<< oec,ared to be severable. SEC_ T_. The Mayor is hereby authorized to sign his Ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of :he Charter of the City of Georgetown.
