HomeMy WebLinkAboutORD 2002-74 - Food SanitationORDINANCE NO. +► % . � 7L AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING SECTION 8.12.040(A) OF CHAPTER 8.12 OF THE GEORGETOWN MUNICIPAL CODE, RELATING TO PERMIT FEES AND OTHER FEES FOR FOOD ESTABLISHMENTS, REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Williamson County Health District (the "Health District") is the agency designated to issue permits and inspect all food establishments within the City of Georgetown, Texas (the "City"); and WHEREAS, the Health District has not had adequate revenue from permit fees to cover costs of inspections; and WHEREAS, the Health District has requested that the City amend its ordinance pertaining to permit fees and other fees related to food establishments; and WHEREAS, the City Council of the City of Georgetown, Texas, finds that it is in the public interest to make the changes in the food establishment fees as requested by the Health District. THEREFORE,ORDAINED • OF OF GEORGETOWN, TEXAS SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Health and Human Services Policy 1 of the Century Plan — Policy Plan Element which states, "The City will cooperate with public and private health and human services related organizations to assure that there are comprehensive services available" and is not found to be inconsistent or in conflict with any other Century Plan Polices, as required by Section 2.03 of the Administrative Chapter of the Policy Plan; SECTION 2. Section 8.12.040 (A) of the Georgetown Municipal Code is hereby amended to read as follows: 8.12.40 Application and fees. A. Under the terms of this chapter, every person who may desire to operate a food establishment in the City shall make application to the Health District upon forms prescribed and furnished by the Health District for a permit. Upon filing of such application, the Health Official shall make or cause to be made an inspection of the premises, and upon finding that the conduct of such business comes within the requirements of this chapter, the Health Official Ordinance No. o2UC7cdC Revision to Food Sanitation I Georgetown Municipal Code Page 1 of 3 (Ch. 8.12) for New Fees shall approve such application; whereupon the applicant shall pay an applicable fee according to the following schedule: FOOD ESTABLISHMENTS PERMIT FEES: NO, OF EMPLOYEES FEES 1-15 $150 16-30 $250 31 + $300 Y2 of application fee due after June 30 FOLLOW-UP INSPECTION FEES: $75 — each additional follow-up increases by $25 DAYCARES: LICENSED NO, OF CHILDREN FEES 13-40 $150 41-100 $250 101 + $300 MOBILE FOOD UNITS: 1ST UNIT $100 ADDITIONAL $ 75 SANITATION INSPECTION: Includes daycares with fewer than 13 children, daycares with more than 12 children but no food preparation, foster I adoptive homes -- $60 FOOD HANDLER CLASSES, REMOTE CLASS, TRAIN THE TRAINER CLASS, TRAIN THE TRAINER VIDEO: no change SEASONAL PERMITS - valid for 6 months - $60 ME F11 hi cc]• k •i • - ESTABLISHMENT PLAN REVIEW. $125 - includes actual plan review and 2 pre -opening inspections $60 — each additional pre -opening inspections PERMIT REINSTATEMENT FEE: $100 SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
