AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN,
TEXAS, AMENDING SECTION 13.04.140 ENTITLED "RATES AND CHARGES-
-SEWERS --SCHEDULE" OF THE CODE OF ORDINANCES OF THE CITY OF
GEORGETOWN TEXAS TO SET SEWER RATES FOR THE CUSTOMERS OF
THE CIMARRON HILLS SUBDIVISION; REPEALING CONFLICTING
ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, on August 8, 2000, the City of Georgetown and Paloma Cimarron Hills,
L.P. entered into an agreement entitled "First Amendment to Development Agreement
Concerning Proposed Subdivision and Construction of Cimarron Hills Subdivision,"
("Development Agreement') which, among other things, states that the City will provide
wastewater service to the Cimarron Hills Subdivision at a minimum monthly service fee initially
established at $21.50/month (see Development Agreement, Para. 6); and
WHEREAS, The City of Georgetown has constructed a wastewater treatment plant,
solely to serve the Cimarron Hills subdivision; and
WHEREAS, The City of Georgetown wishes to implement rates that are consistent with
the Development Agreement, and that fully recover the cost of service for the Cimarron Hills
Wastewater Treatment Plant from Cimarron Hills residents to make the plant self-supporting;
and
WHEREAS, The City Council of the City of Georgetown wishes to amend the current,
standard wastewater rates and adopt proposed rates for customers using the Cimarron Hills
Wastewater Treatment Plant, effective on all utility billings after January 1, 2003.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, THAT.
SECTION 1. The facts and recitations contained in the preamble of this ordinance are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this
ordinance implements Finance Policy End 4.0 of the Century Plan - Policy Plan Element, which
states: "The City will conduct all municipal operations in an efficient business -like manner and
sufficient financial resources for both short-term and long-term needs are provided," and further
finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century
Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan,

SECTION 2. Section 13.04.140 "Rates and Charges--Sewer--Schedule" of the Code of
Ordinances of the City of Georgetown, Texas is hereby amended to read as follows:
"Rates and charges for sewer charges are as follows:
A. Residential Rates
1. Customer charge, per month: $11.75
2. Cost per 1,000 gallons: $2.95
3. The residential charges in this section are computed using the average number of
gallons of water used monthly for a three-month winter period (December, January,
February.) The winter average will be calculated annually.
B. Non-residential Rates
1. Customer charge, per month: $11.75
2. Cost per 1,000 gallons: $2.95
3. The non-residential charges in this section are computed using the actual water
usage billed per month.
C Residential customers served by the Cimarron Hills Wastewater Treatment Plant
1. Customer Charge, per month: $21.50
2. Cost per 1,000 gallons: $2.95
3. The residential charges in this section are computed using the average number of
gallons of water used monthly for a three-month winter period (December, January,
February.) The winter average will be calculated annually.
D. Non-residential customers served by the Cimarron Hills Wastewater Treatment Plant
1. Customer charge, per month: $21.50
2. Cost per 1,000 gallons: $2.95
3. The non-residential charges in this section are computed using the actual water
usage billed per month.
SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.
SECTION 4. If any provision of this ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.
SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary
to attest. This ordinance shall become effective and be in full force and effect in (10) ten days
on and after publication in accordance with the provisions of the Charter of the City of
Georgetown.
