The City Council of the City of Georgetown convened in a SPECIAL MEETING ON THE 11th DAY OF NOVEMBER, 2002, at the City Hall, and roll was called of the duly constituted City Council Members of the City of Georgetown, to wit: Gary Nelon, Mayor Llorente Navarrette, Councilmember District 1 Gabe Sansing, Councilmember District 2 Doug Smith, Councilmember District 3 Jack Noble, Councilmember District 4 Sam Pfiester, Councilmember District 5 Farley Snell, Councilmember District 6 Ken Evans, Councilmember District 7 And all of the foregoing persons were present, save and except the following absentees: Q&V.&rr&* Snell thus constituting a quorum. 2. Among other business, an Ordinance No. 2002-67 being an "Ordinance Canvassing the Returns and Declaring the Results of the City of Georgetown Bond Election Held on November 5, 2002," was introduced for consideration by the City Council. 3. After an opportunity for discussion, it was duly moved and seconded that the foregoing Ordinance be approved and adopted, said motion prevailed and carried by the following vote: AYES: NOES: 4. A true, correct, and full copy of the Ordinance passed at the meeting described above is attached to and follows this Certificate, The Ordinance has been duly recorded in the minutes of the City Council, and the above paragraphs are true, full, and correct representations of the actions taken at the meeting. Carls City Attorney ORDINANCE NO. 2002-67 AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE CITY OF GEORGETOWN SPECIAL ELECTION HELD ON NOVEMBER 5,2002; AND PROVIDING FOR EMERGENCY PASSAGE. WHEREAS, the City Council of the City of Georgetown, Texas ordered an election to be held on Tuesday, November 5, 2002, for the purpose of seeking voter response to the question of increasing the sales tax in the city of Georgetown by one-quarter (1/4) of one percent and for the purpose of seeking voter response regarding the adoption of the Firefighters Civil Service Law. WHEREAS, the City Council has investigated all matters pertaining to said election, including the ordering, giving notice, holding and making returns of said election; and WHEREAS, the election officers who held said election have prepared the returns of the results thereof, and the returns have been delivered to City Council; and WHEREAS, according to Section 67.003 of the Election Code, the local canvassing authority shall convene to conduct the local canvass not earlier than the third day or later than the sixth day after election day for an election other than the general election for state and county officers. Therefore, the last day to conduct official canvass of returns of the City of Georgetown ballot is November 11, 2002, so this ordinance will need to be approved on emergency reading; WHEREAS, according to said returns, duly and legally made, Proposition No. 1 received the following votes: PROPOSITION NO, 1 The adoption of a local sales and use tax in the City of Georgetown, Texas, at the rate of one-fourth of one percent to provide revenue for maintenance and repair of municipal streets. Early Votes Election Day Total FOR: 4117 1941 6058 AGAINST: 2982 1590 4572 WHEREAS, according to said returns, duly and legally made, Proposition No. 2 received the following votes: PROPOSITION NO. 2 Adoption of the Firefighters' Civil Service Law Early Votes Election Day Total FOR: 4401 2382 6783 AGAINST: 2415 976 3391 2002 Special Election Ordinance No. 2002-67 Page 1 of 2 Pages NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS, that: SECTION I. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Governmental Affairs Focus End 15.01 of the Century Plan - Policy Plan Element, which states: "All citizens actively participate in governmental functions;" and has found that this action is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION II. The City Council officially finds and determines that the election was duly ordered and called; that proper notice of the election was given in accordance with law; that proper election officers were duly appointed prior to the election; that the election was held in accordance with the applicable laws; that the City complied with the Federal Voting Rights Act and the Texas Election Code; and that returns of the results of the election have been made and delivered; and that the City Council has canvassed the returns, all in accordance with the law and the Ordinance calling the election. SECTION III. The City Council officially finds and determines, as is evidenced on the official tabulation of votes which is included herein as Exhibit A, that Proposition 1 for the adoption of a local sales and use tax in the City of Georgetown, Texas, at the rate of one-fourth of one percent to provide revenue for maintenance and repair of municipal streets was approved, and The City Council officially finds and determines, as is evidenced on the official tabulation of votes which is included herein as Exhibit A, that Proposition 2 for the Adoption of the Firefighters' Civil Service Law was approved. SECTION IV. It is further found and determined that in accordance with the order of this governing body, the City Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located outside of City Hall/Council Chambers, a place convenient and readily accessible to the general public, and said notice was posted and remained posted continuously for at least 72 hours preceding the scheduled time of the meeting. A copy of the posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. PASSED AND APPROVED on emergency reading this Monday, thel 1th day of November, 2002.
