AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING SECTION 12.10.160.A.12 OF THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN RELATING TO THE PROHIBITION OF SIGNS ALONG STREETS AND RAILROADS; PROVIDING A CONFLICT CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Georgetown, Texas, deems it necessary and proper and in the best interest of the citizens of Georgetown to amend Section 12,10.160.A.12 of the Code of Ordinances of the City of Georgetown entitled "Signs in the Public Right-of-way", to amend and clarify the regulations pertaining to the permitting, location, erection, and removal of signs along streets and railroads as hereinafter set forth; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, that: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following Century Plan - Policy Plan Elements: • Economic Development and Focus End 1.07—"The tourism industry in Georgetown is developed and promoted in a manner that complements the City's unique character." And further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The City Council of the City of Georgetown hereby amends Section 12.10.160.A.12 of the Code of Ordinances of the City of Georgetown to read as follows: 12.10.160.A.12. Signs Along Streets, Public Ways, or Railroads: No sign or flag may be placed on or over the area located within ten (10) feet of the back of the street curb, or if no curb, the impervious surface of the street, or if unpaved, the area located within ten (10) feet of the portion of the street ordinarily used for vehicular travel, the median of a street, across the public right-of-way line extended across a railroad right- of-way, or in the restricted areas at street intersections designated by Section 12.44.010 of the City of Georgetown Municipal Code, with the following exceptions: A. Bus stop signs erected by a public transit company. No advertising is permitted at bus stops except for a single sign no larger than two (2) square feet that advertises the bus stop; C. Informational signs of a public utility regarding its poles, lines, pipes, or facilities; D. Canopy, projecting, and suspended signs projecting over a public right-of- way in conformity with the conditions of Section II of this ordinance. E. Emergency warning signs erected by a governmental agency, a public utility company, or a contractor doing authorized or permitted work within the public right-of-way. F. Temporary signs permitted and approved as part of a Special Event under Section 12.24.65 of the City of Georgetown Municipal Code. SECTION 3. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. d the SECTION 5, The Mayor is hereby becohorized me effective andsign 'be ind'nance full forcenand effect ty Secretary to attest.
