HomeMy WebLinkAboutORD 2002-44 - Speed Zone Park LnORDINANCE NO. 0. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING SECTION 10.12.090(8.)(6.) OF THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN, TEXAS TO EXTEND THE EXISTING 20 MPH SCHOOL SPEED ZONE ON PARK LANE TO ITS INTERSECTION WITH FM 2338 (WILLIAMS DRIVE); PROVIDING A CONFLICT CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the existing school speed zone on Park Lane terminates at its intersection with McCoy Lane (350 east of the west curbline of the west Frontage Road of Interstate 35) and does not include the segment of Park Lane located east of and adjacent to the McCoy School parking lot from its intersection with McCoy Lane south to FM 2338 (Williams Drive); and WHEREAS, the City Council of the City of Georgetown, Texas, hereby finds it necessary and proper and in the best interests of the citizens of Georgetown to establish a 20 -mph school speed zone along the entire length of Park Lane from Shannon Lane to FM 2338 (Williams Drive). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Transportation Policy 1 of the Century Plan - Policy Plan Element, which states: "The City will encourage a transportation system that provides for the safe and efficient movement of traffic, promotes the economic interests of the community, and adequately serves the personal needs of individuals", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2, Chapter 10.12.090(B.)(6.) of the Code of Ordinances of the City of Georgetown, Texas is hereby amended to read as follows: "6. School Speed Zone. Park Lane — The entire length of Park Lane beginning at the east curbline of Shannon Lane and continuing east then south on Park Lane to the north curbline of FM 2338 (Williams Drive), a prima facie maximum speed limit of 20 miles per hour during the hours of 7:15 a.m. until 8:15 a. m., and 2:45 p. in. until 3:45 p.m., when school is in session. " SECTION 3. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal School.-. Zone Ordinance: PagesPage 1 of 2 or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
