HomeMy WebLinkAboutORD 2002-32 - Land Use & ThoroughfareAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING THE "CENTURY PLAN - DEVELOPMENT PLAN" PASSED AND ADOPTED ON THE 13TH DAY OF MARCH 1990, TO INCLUDE A FUTURE LAND USE PLAN AND A FUTURE THOROUGHFARE PLAN AS PART OF THE CENTURY PLAN —DEVELOPMENT PLAN; MAKING CONFORMING CHANGES TO THE CENTURY PLAN — DEVELOPMENT PLAN; ADOPTING SECTION 1.12.060 OF THE CODE OF ORDINANCES TO SPECIFICALLY ADOPT THE REVISED "CENTURY PLAN- DEVELOPMENT PLAN;" REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council did, on March 13th, 1990, adopt the Century Plan — Development Plan, Land Intensity, Transportation, and Utilities Functional Plan Elements as the Land Use, Transportation, and Utilities Functional Plan Elements of the Century Plan pursuant to Section 1.08. Subsection 2 of the City Charter, by Ordinance Number 900149; and WHEREAS, the adopted Century Plan - Policy Plan does allow for amendments to the adopted elements of the Century Plan; and WHEREAS, the Annual Operating Plan. Element of the Century Plan was adopted on September 25, 2001, creating Performance Measures in terms of Goals, Policy Objectives and Strategies, replacing a governance model of Policy Ends and Focus Ends in the Century Plan; and WHEREAS, the Annual Operating Plan Element of the Century Plan adopted on September 25, 2001, outlined a Strategy for Long Range Planning as: Initiate a Comprehensive Plan revision process that will result in a strategy to revise and/or replace the elements that have been impacted by the remarkable growth and change inland use since adoption; and WHEREAS, a Quality of Life Survey was completed in November of 2001, which revealed the desires of the citizens of Georgetown for an updated Land Use and Transportation element of the Century Plan; and WHEREAS, on January 10, 2002, a Land Use Open House, attended by more than 60 interested citizens, was held to discuss six specific issues arising from the November 2001, Quality of Life Survey; and WHEREAS. a draft future land use plan map, future thoroughfare plan map and goals and objectives for the Future Land Use Plan and Future Thoroughfare Plan were created from the discussions and input received at the January 10, 2002 Land Use Open House; ane: Ordinance Nig. c2oocl " t LentLWY Plan — DevelOrM nt Plan Oidinawe, Future Land Ilse and I=utuse TherOu(Iilfare Elements Pate 1 44 WHEREAS, on January 31, 2002, a Second Land Use Open House, attended by more than 90 interested citizens, was held to review the draft future land use plan map, draft future thoroughfare plan map, and draft goals and objectives; and WHEREAS, the draft future land use plan map, future thoroughfare plan map and goals and objectives for the Future Land Use Plan and Future Thoroitglhf�tre Plait were modified based on citizen input, and presented to the City Council and the Planning and Zoning Commission on February 25, 2002; and WHEREAS, on February 25, 2002, the City Council held a Town Hall Meeting, attended by approximately 100 citizens, to receive comment on the Draft Future Land Use Plait Map and Draft Future Thorouglif ire Plan Map: and WHEREAS, the Draft Future Land Use Plan Map and Draft Future Thoroughfare Plan Allap were revised based on citizen input and City Council direction received at the February 25, 2002 Town Hall Meeting; and WHEREAS, the Planning and Zoning Commission did hold a Public Hearing on the Future Land Use Plan and Future Thoroughfare Plan on March 19, 2002; and WHEREAS, the City Council did hold a Public Hearing on the Future Laird Use Plan and Future Thoroughf ire Plan on April 9, 2002. NOW, THEREFORE, BE IT ORDAL TD BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policies of the Century Plan - Policy Plan Statements, Goals and Strategies as amended by the 2001/2002 Annual Operating Plan Element of the Century: 3.0 Policy Statement: Citizens, business owners and organizations enjoy the benefits of well-planned land usage in which conflicting needs are balanced. Goal: Maintain quality utilities and transportation systems that promote well-planned development. Goat: Promote growth management strategies to guide the City's land use, transportation, infrastructure, and economic development decisions that will provide long-term quality of fife. Strategy: Initiate a Comprehensive Plan revision process that will result in a strategy to revise and/or replace the elements that have been impacted by the remarkable growth and change in land use since adoption. Land Lyse amd Future "t'hort>uL�Jifare Elements Pace') of 4 11.0 Policy Statement: Georgetown's citizens and businesses enjoy an attractive community with a unique sense of place and a positive identifiable image, at a cost which is consistent with other city social and economic priorities. Goal: Support the facilitation of a quality growth strategy which seeks to strike an optimum balance between economic expansion through better development practices and the effective stewardship of natural resources, municipal infrastructure and quality of life concerns; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The Document entitled "Century Plan — Development Plan, Land Intensity, Transportation, and Utilities Functional Plan Elements" dated November 15, 1989, shall be amended as follows: A. Repealing the existing "Introduction" section of the Century Plain — Development Plan, Land Intensity Transportation and Utilities Functional Plan Elements in whole and replacing it with the revised "introduction" section to the Century Plan — Development Plan, Land Intensity Transportation and Utilities Functional Plant Elements that is attached hereto as Exhibit A and incorporated herein by reference for all purposes. B. Adding a Future Land Use Plan, dated April 9, 2002, which is attached hereto as Exhibit B and incorporated herein by reference for all purposes. C. Adding a Future Thoroughfare Plan, dated April 9, 2002, which is attached hereto as Exhibit C and incorporated herein by reference for all purposes. D. Change the full title of the Development Plan to Century Plait — Development Plan, Future Land Use, Future Thoroughfare, Land Intensity, Transportation, and Utilities Functional Plan Elements, with short -title of Century Plan — Development Plain. SECTION 3: Chapter 1.12, Georgetown Century Plan, of the Code of Ordinances of the City of Georgetown is hereby amended to add Section 1.12.O60 as follows: Section 1.12.060 functional development plan adopted. In accordance with Chapter 1.08, Subsection 2 of the Georgetown City Charter, the City Council of the City of Georgetown has adopted that certain document entitled the "Century Plan — Development Plan" for the purpose of directing the City Council, staff, and/or commissions in rendering actions and resolutions relating to the utilization of all of the available resources within the City and its Ordinance No. `•'OCP3 i�Cnt(WV Plan-- DevelopI'men( Film Ordln7nCC, 1 Flture Land Use and t"I.;ttli—O'TI10:'pli(7llt'aCC Elements Page 3 lit" -i. Planning Area for the purpose of developing public and private land and serving that land with infrastructure systems. Adoption of the Development Plan, is inclusive of the Future Land Use, Land Intensity, Transportation, Future Thoroughfare, and Utilities Functional Plan Elements. This document may be amended from time to time. SECTION 4: The Century Plan — Development Plan as hereby amended shall be implemented in accordance with the Administrative procedures in Chapter IV of the Policy Plan Element of the Centuty Plan adopted on March 8, 1988. SECTION 5: All future ordinances of the City implementing elements of the Century Plan — Development Plan shall be in conformity with the adopted Cer2tttry Plan — Development Plan as amended by this Ordinance. SECTION 6. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 7. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 8. This ordinance shall become effective in accordance with the provisions of the Charter of the City of Georgetown. PASSED AND APPROVED on First Reading on 23rd day of April 2002. Comprehensive plans are no longer prepared solely as physical plans for the design and layout of a city's infrastructure. Today, they consist of social and economic factors and goals, as well as the traditional physical factors. More important, however, is the evolution in the manner in which comprehensive plans are used. It has become more common for comprehensive plans to be used both in the day-to-day operation of city government and in the determination of long range strategies and programs. In order to be a truly dynamic and useful tool, the comprehensive plan should bear a direct relation to the everyday regulatory and development needs of the community. This includes providing a foundation for the city's zoning, subdivision, and other land development regulations, as well as a means of guiding capital improvements programming and other resource allocation decisions. Although land throughout the united Mates, and in Georgetown as well, is predominantly privately owned and controlled, the potential development capacity of any given parcel of land is highly influenced by public sector decisions to provide public services. The comprehensive planning process enables a community to view the overall needs for services and to plan for the distribution of resources in a manner that reflects public goals and values. In Georgetown, the City Charter establishes the comprehensive planning process as a mans "... to guide, regulate, and manage the future development within the corporate limits and extraterritorial jurisdiction of the City to assure the most appropriate and beneficial use of land, water and other natural resources, consistent with the public interest. " The Century Plan as a whole, and more specifically the Development Plan, fulfills this purpose in an innovative manner. Cenuuy Plan — Development Plan, Future Land Use. Future Ti oroughf tre, hand Intensity, Transportatitm, and htilities Functional Plan Elements - Intresduction fate I of The Century Plan - Development Plan consists of the Future Land Luse, Future Thoroughfare, Land Intensity, Transportation, and Utilities Functional Plan Elements , and Utilit Functional P.___ Elements. These are among the first of 15 Functional Plan Elements to be prepared and adopted by the City Council. These Elements are mandated by Section 1.08 of the City Charter which requires that the comprehensive plan include, among others, "...a) public a future land use element; b) a traffic circulation and transit element; [and] c) a wastewater, electric, solid waste, drainage and potable water element.... The Development Plan has been prepared in accordance with the adopted Policies contained in the Century Plan - Policy Plan. The adopted Policies, along with the recommended Ends and Means in the Policy Plan, formed the basis for the more specific programs, projects, and work activities included in the Development Plan.
