HomeMy WebLinkAboutORD 2002-29 - Speed Zone SH29AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS, REPLACING THE EXISTING SECTION 10.12.010 OF THE CODE OF ORDINANCES WITH THE PROVISIONS SET OUT HEREIN TO DEFINE "SPEEDING" AND FIX A PENALTY THEREFOR; DECLARING WHAT MAY BE A SUFFICIENT COMPLAINT IN PROSECUTIONS HEREUNDER; REPLACING THE EXISTING SECTION 10.12.020 OF THE CODE OF ORDINANCES WITH THE PROVISIONS SET OUT HEREIN TO ZONE FOR TRAFFIC AND RATE OF SPEED ON STATE HIGHWAY 29 IN THE CITY LIMITS OF THE CITY OF GEORGETOWN, PROVIDING A SEVERABILITY CLAUSE; REPEALING CONFLICTING LAWS; AND SETTING AN EFFECTIVE DATE. WHEREAS, the Texas Department of Transportation ("TxDOT') has completed speed studies on the segment of State Highway 29 located within the corporate limits of the City of Georgetown and has determined that adjustments to the existing speed zones are currently warranted; and WHEREAS, the City Council of the City of Georgetown finds it to be in the best interest of the citizens of Georgetown to adopt the speed zone adjustments recommended by TxDOT on the segment of State Highway 29 within the City of Georgetown. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GEORGETOWN: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following elements of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter the Policy Plan: Transportation Policy 10.00 of the Century Plan — Policy Plan Element, which states: "Citizens and commercial goods move safely and efficiently throughout all parts of the City. of SECTION 2. The existing text contained in Section 10.12.010 of the Code of Ordinances of the City of Georgetown is hereby replaced with the following: Ordinance No, ... Speed Zone Adjustments on SH 29 Page of 4 That all of the streets of this city, and all portions of any such streets, are hereby declared to be public streets and that the driving or operating of any motor- vehicle on or along any portion of any street of this city at a rate of speed that is greater than the maximum rate of speed for said portion of said street, as fixed by this ordinance shall be guilty of a misdemeanor, which is named "The Offense of Speeding" and that the said offense is punishable by a fine in any sum not to exceed Two Hundred dollars (8200.00). That the use of the word "Speeding" shall be sufficient to designate the said offense, and shall mean that a motor vehicle has been driven upon a public street at a greater rate of speed than fixed by city ordinance for the street and for the zone thereof, that such motor vehicle was so being driven upon, if zoned. That in prosecutions under this ordinance, for the offense of speeding, the complaint, if in other respects sufficient in form, shall as to the portion thereof seeking to acknowledge the offense, be sufficient if it in substance alleges that the defendant did while driving a motor vehicle in said city commit the offense of "Speeding ". SECTION 3. The existing text contained in Section 10.12.020 of the Code of Ordinances of the City of Georgetown is hereby replaced with the following: It is hereby determined by the City Council of the City of Georgetown upon the basis of an engineering and traffic investigation that the prima facie maximum speed limit on those portions of SH 29 routed in the City of Georgetown, is hereby stated, which prima facie maximum speed limit shall be effective at all times and signs will be erected giving notice of the prima facie maximum speed limit so declared to -wit. Speed Zone FOR WESTBOUND TRAFFIC Beginning at the east city limit of Georgetown at milepoint 24.141 to milepoint 23.023, a distance of 1.118 miles, a prima facie maximum speed limit of 55 miles per hours. From milepoint 23.023 to milepoint 22.779, a distance of 0.244 miles, a prima facie maximum speed limit of 50 miles per hour. From milepoint 22.779 to milepoint 22.411, a distance of 0.368 miles, a prima facie maximum speed limit of 40 miles per hour. j , Ordinance Ir r ` r Speed r Adjustments on SH • Page of 4 From milepoint 22.411 to milepoint 11.600, a distance of 1.060 miles, a prima facie maximum speed limit of 35 miles per hour. From milepoint 11.600 to milepoint 11.105, a distance of 0.495 miles, a prima facie maximum speed limit of 40 miles per hour. From milepoint 11.105 to milepoint 10.895, a distance of 0.210 miles, a prima facie maximum speed limit of 50 miles per hour. From milepoint 10.895 to the west city limit of Georgetown at milepoint 9.962, a distance of 0.933 miles, a prima facie maximum speed limit of 55 miles per hour. School Speed Zone Beginning at milepoint 22.217 to milepoint 22.028, a distance of 0.189 miles, a prima facie maximum speed limit of 20 MPH when flashing, 35 MPH at all other times. FOR EASTBOUND TRAFFIC Beginning at the west city limit of Georgetown at milepoint 9.962 to milepoint 10.895, a distance of 0.933 miles, a prima facie maximum speed limit of 55 miles per hour. From milepoint 10.895 to milepoint 11.105, a distance of 0.210 miles, a prima facie maximum speed limit of 50 miles per hour. From milepoint 11.105 to milepoint 11.600, a distance of 0.495 miles, a prima facie maximum speed limit of 40 miles per hour. From milepoint 11.600 to milepoint 22.411, a facie maximum speed limit of 35 miles per hour. SECTION 4. That should any section or any portion of any section hereof be decreed to be void, the invalidity of such section or such portion thereof shall not affect the validity of the remaining portions of this ordinance; and that each section and each portion thereof not decreed to be invalid shall remain valid and enforceable. SECTION 5. That all ordinances and parts of ordinances that are in conflict with this ordinance are hereby repealed. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
