HomeMy WebLinkAboutORD 2002-19 - Digital Zoning Map*RDINANCE NO. 00d I q AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING THE ZONING ORDINANCE PASSED AND ADOPTED ON THE 12TH DAY OF FEBRUARY 1968, TO AMEND SECTION 10.1 OF THE ZONING ORDINANCE TO ADOPT AN UPDATED OFFICIAL ZONING MAP; AND TO AMEND 14.206 OF SAID ZONING ORDINANCE TO ESTABLISH A DIGITAL ZONING MAP TO BE USED IN ADMINISTRATION AND ENFORCEMENT OF THE ZONING ORDINANCE, AND AUTHORIZING THE MAYOR TO SIGN AN UPDATED, PAPER ORIGINAL OF THE OFFICIAL ZONING MAP OF GEORGETOWN, REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, Section 10.1 of the Zoning Ordinance adopts an Official Zoning Map of the City of Georgetown; and WHEREAS, Section 14.206 of the Zoning Ordinance provides that there shall be one Official Zoning Map, but also provides that that copies of the Official Zoning Map may be created and used for convenience; and WHEREAS, at present the Official Zoning Map dated December 15, 1988 reflects some, but not all, of the City Council zoning amendments through approximately August 16, 1995; and WHEREAS, the Official Zoning Map needs to be updated to include the zoning amendments approved by the City Council through March 12, 2002; and WHEREAS, in addition to updating the Official Zoning Map, the City Council of the City of Georgetown, Texas, finds that portions of its current Zoning Ordinance governing the Zoning Map do not allow for the use of digital, computer generated mapping products; and WHEREAS, due to creation of a Geographic Information System, the City of Georgetown has increased capabilities to provide digital copies of map products and data bases; and WHEREAS, this additional computer capability provides a means of allowing greater public access to City of Georgetown's ordinances, records and map products, thereby malting the development process more efficient within the community; and WHEREAS, the Digital Zoninor Map and Official Zoning Map of Georgetown created using a Geographic Information System, does not change any zoning district boundary, zoning category, or amend the Zoning Map in any other way, other than Ordinances passed by the City Council, through the procedures established in the Zoning Ordinance; and Ordinance No. etc Zoning Ordinance Revision — Digital Zoning Map Page 1 of 4 WHEREAS, the City Council has submitted the proposed change in the Official Zoning Map to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report; and WHEREAS, notice of such hearing was published in a newspaper of general circulation in the City; which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and WHEREAS, the City Planning and Zoning Commission in a meeting held on March 19, 2002, recommended revising Section 14.206, to establish a digital zoning map to be used in the administration and enforcement of the zoning ordinance, and recommended authorizing the Mayor to sign an updated Official Zoning Map. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policies of the Century Plan - Policy Plan Element: 1. Facilities Policy 4.6 which states "The City Provides appropriate, well managed information technology products and services that support City operations and citizen access to information"; and 2. Growth and Physical Development Policy 7.1 which states "The City's regulations implement the Policy Ends and provide the opportunity to seek change with reasonable effort and expense"; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. Section 10.1 of the City of Georgetown Zoning Ordinance is hereby repealed and amended to provide as follows: 10.1 Official Zoning Map Property in the City is zoned according to the Official Zoning Map dated April 9, 2002, which is on file with the Director of Planning and Development Services ("Official Zoning Map"). The Official Zoning Map shall be revised in accordance with any subsequent ordinances that are passed and approved by the City Council in accordance with the procedures required by this Zoning Ordinance. The April 9, 2002 Official Zoning Map, as it may be amended from time to time, is hereby adopted as part of the Zoning Ordinance and made an integral part thereof. Ordinance No. A 00(RR 11 Zoning Ordinance Revision — Digital Zoning Map Page 2 of 4 10.2 Historical Zoning Maps Unless the prior Official Zoning Map has been lost or has been totally destroyed, the prior map or any significant parts thereof remaining, shall be preserved, together with all available records pertaining to its adoption or amendment. SECTION 4. Section 14.206 of the City of Georgetown Zoning Ordinance is hereby amended as shown below: 14.206. The Official Zoning Map of Georgetown shall be and is hereby designated as that Zoning Map of Georgetown bearing the original authenticating signature of the Mayor of said City and dated as of April 9. 2002. Said Official Map shall be held in the custody of the Director of Planning and Development Services of the City of Georgetown and be reasonably available for public observation. There shall be only one (1) such Official Zoning Map but for convenience copies thereof may be used and duplicated but each copy shall clearly shown thereon in bold black print the following: "COPY OF ZONING MAP FOR GENERAL INFORMATION ONLY, SEE OFFICIAL ZONING MAP." A digital map, created through the use of geographic information technology, may be used in the administration and enforcement of the Zoning Ordinance but shall not replace the paper original of the Official Map required by this Zoning Ordinance. If, in accordance with the provisions of the Zoning Ordinance. changes are made to zoning district boundaries portrayed on the Official Zoning Map, the date of such change shall be promptly noted on the Official Zoning Map after having been dulapproved by the City Council. SECTION 5. The Mayor is hereby authorized to sign the updated Official Zoning Map of Georgetown, that does not change any zoning district boundary, zoning category, or amend the Zoning Map in any other way, other than Ordinances passed by the City Council, through the procedures established in the Zoning Ordinance. SECTION 6. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 7. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 8. This ordinance shall become effective in accordance with the provisions of the Ordinance No. Q(? w Zoning Ordinance Revision - Digital Zoning Map Page 3 of 4 Charter of the City of Georgetown.
