AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS REVISING
SECTION 3.01.490 OF THE CODE OF ORDINANCES ENTITLED
"DISCIPLINARY ACTION AND APPEALS" TO DELETE SECTION
3.01.490(B)(3); AMENDING PERSONNEL POLICY NO. 451 -
DISCIPLINARY APPEALS; PROVIDING A CONFLICT CLAUSE AND
SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Georgetown finds it to be in the best
interest of the citizens of Georgetown to revise and amend the City's Personnel Policies
as herein set forth; and
WHEREAS, the voters of the City of Georgetown voted in May 3, 2003 to amend
Section 2.16 of the City Charter of the City of Georgetown to streamline the employee
disciplinary appeals process.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this
ordinance are hereby found and declared to be true and correct, and are incorporated
by reference herein and expressly made a part hereof, as if copied verbatim. The City
Council hereby finds that this Ordinance implements the following elements of the
Century Plan Policy Plan and that the enactment of this Ordinance is not inconsistent or
in conflict with any other Century Pian Policies, as required by Section 2.03 of the
Administrative Chapter the Policy Plan:
• Finance Policy End 14.00 - "All municipal operations are conducted in
an efficient business -like manner and sufficient financial resources for
both current and future needs are provided."
SECTION 2, Section 3.01.490 of the Code of Ordinances is hereby amended to
read as follows:
Sec. 3.01.490. Disciplinary action appeals.
A. Purpose: to provide a process for employees to appeal disciplinary actions
B. Policy,
1. The affected employee shall first be provided the opportunity to discuss the
action with the employee's immediate supervisor. After such discussion, or
attempted discussion, the affected employee may initiate the appeals procedure.

2. All City employees have the right to appeal a disciplinary action to the next
level supervisor up to and including the City Manager. If a disciplinary action is
overturned, at any level, the employee shall be granted back -pay or be reinstated
to previous position with back -pay. The decision of the City Manager shall be the
final authority to the disciplinary appeal process.
SECTION3. The City Director of Human Resources is hereby authorized and
directed to amend Personnel Policy No. 451, Disciplinary Action Appeals, to be
consistent with this ordinance.
SECTION 4. This Ordinance shall be and is hereby declared to be cumulative of
all other ordinances of the City of Georgetown, and this Ordinance shall not operate to
repeal or affect any of such other ordinances, except insofar as the provisions thereof
might be inconsistent or in conflict with the provisions of this Ordinance, in which event
such conflicting provisions, if any in such other ordinance or ordinances are hereby
superseded.
SECTION 5. If any provision of this Ordinance or application thereof to any
person or circumstance, shall be held invalid, such invalidity shall not affect the other
provisions, or application thereof, of this Ordinance which can be given effect without
the invalid provision or application, and to this end the provisions of this Ordinance are
hereby declared to be severable.
SECTION 6. The Mayor is hereby authorized to sign this Ordinance and the City
Secretary to attest. This Ordinance shall become effective and be in full force and
effect upon adoption in accordance with the provisions of the Charter of the City of
Georgetown.

PURPOSE
