HomeMy WebLinkAboutORD 2003-68 - Construction Permit FeesORD. cp, oa 3 - toy AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS AMENDING SECTION 15.04.040 "PERMIT FEES" OF THE CODE OF ORDINANCES (THE "CODE°') TO REVISE CONSTRUCTION PERMIT FEES; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS, INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Manager of the City of Georgetown, Texas, has submitted to the City Council a proposed Annual Operating Plan element ("Plan") of the Century Plan of the revenues of s aid C ity a nd e xpenses of conducting t he a ffairs t hereof a nd providing a complete financial plan for the ensuing fiscal year, beginning October 1, 2003, and ending September 30, 2004; WHEREAS, i t i s t he i ntention of t he C ity C ouncil to be responsive to t he t ime constraints of the construction process and remain competitive with Georgetown's commercial and industrial competitors; and WHEREAS, it is the intention of the City Council to revise the City's local construction fees and it is determined that revising the construction fees is in the best interest of the citizens and the businesses in the City of Georgetown; and WHEREAS, the caption of this ordinance was printed in the Williamson County Sun on August 20, 2003 in compliance with the City Charter of the City of Georgetown. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following element of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent with nor in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan: Policy Statement 14.0: "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both current and future needs are provided. SECTION 2. Section 15.04.040 of the Code of Ordinances entitled "Construction Permit Fees" is hereby amended as shown on Exhibit "A" attached hereto and incorporated herein. SECTION 3. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal or affect any such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect on October 1, 2003, PASSED AND APPROVED on First Reading on the 26th day of August 2003.
