OF GEORGETOWN,! , 9.08 OF 1 i i OF ORDINANCES RELATING TO WEAPONSTO ADDRESS;B GUNSI OTHER GUNS, AND ARCHERY; AMENDING CHAPTER 12aO OF THE CODE OF 11' RELATING TO PARKS AND RECREATIONAL y O DELETE THE REFERENCE TO BOWHUNTING AND C! rii 1 AMENDING CHAPTER OF THEii OF ORDINANCES! i PARADES AND PROCESSIONS TO PROVIDE ! •'! it OBTAINING SPECIALPERARTS FOR USE OF .: GUNS, OTHER AND ARCHERYREPEALING CONFLICTT PROVISIONS; PROVIDING A SEV• l AND ESTABLISHING EFFECTXrRjis y WHEREAS, the City Council recognizes the need to provide a safe area where the youth in the City of Georgetown can engage in certain supervised activities; and WHEREAS, the Council wishes to accommodate the Boy Scouts' request to be allowed to provide BB gun instruction and shooting in its Boy Scout Day Camp in Georgetown, Texas, and WHEREAS, the Council also recognizes the need to regulate the discharge of certain other weapons to ensure the safety of its citizens, and WHEREAS, the Council finds that allowing BB gun instruction, and instruction on archery, only with a Special Event Permit, and otherwise prohibiting those activities within the city limits is in the best interest of the City of Georgetown. NOW, i i ORDAINED t i OF CITY OF GEORGETOWN, SECTION 1: The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part thereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following Century Plan Elements: 4.0 The City provides for the safety of its citizens and supports the responsive delivery of coordinated services by the City and other public agencies. 11.0 All citizens , actively, participate in recreational activates, community -wide social, cultural, and 11.2 The City's park facilities and recreational programs meet the leisure needs of citizens. I Ir, 11.5 Georgetown has an on-going process for recreational needs assessment and program evaluation. The,City Council further finds that the enactment of this ordinance is not inconsistent or in conflict'with any other Century Plan Policies, as required by section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. Section 9.08.010 of the Georgetown Code of Ordinances (pertaining to the "Discharge of BB guns") is hereby amended to read as follows: Sec, 9.08.010 Discharge of BB Guns, Pellet Guns, Air Guns, Paint Ball Guns, Spear Guns, Wrist Rockets and/or Slingshots and Engagement in Archerp. It is unlawful for any person to fire or discharge any BB rifle., or any BB gun, pellet gun, air gun, paint ball gun, -spear .gun, wrist rocket andlor slip shot of any description, or to engage in archery (which term shall include but not be limited to use of a long bow, compound bow, or crossbow), for anv reason, including hunting, suortinz. target practice or competition within the City except: a. as may be permitted by the laws of this State or the United States, or be with a Special Event Permit issued under the provisions oLChapter 12.24. SECTION 3. Section 12.20.060 of the Georgetown Code of Ordinances (pertaining to "Prohibited practices") is amended to delete subsection (B) as follows: Sec. 12.20.060 Prohibited practices. A. Section 12.24.060 of the Georgetown Code of Ordinances (pertaining to "Contents of application for special event permit") is amended to add subsection (1) as follows: Sec. 12.24.060 Contents of application for special event permit. Section 12.24.080 of the Georgetown Code of Ordinances (pertaining to "Application for permit --Issuance.") is amended to add subsection H as follows: Section 12.24.080 Application for permit Issuance. H The applicant has complied with all the requirements of reasonable. SECTION 6. The City Manager and City Secretary are hereby authorized and directed to make the necessary changes to all records of the City of Georgetown to reflect this amendment. SECTION 7.: All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. If any Provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 8. This Ordinance shall become effective in accordance with the City Charter and the laws of the State of Texas.
