HomeMy WebLinkAboutORD 2003-16 - UDC AdoptionORDINANCE NO. c�t' - ) AN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS AMENDING IN THEIR ENTIRETY THE FOLLOWING PROVISIONS OF THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN, TEXAS: THE SUBDIVISION REGULATIONS (CODIFIED AT CHAPTER 16, AND BEING THE FEBRUARY 14, 1988 SUBDIVISION REGULATIONS, AS SUBSEQUENTLY AMENDED), THE ZONING REGULATIONS (CODIFIED AT CHAPTER 17, AND BEING THE FEBRUARY 12, 1968 ZONING ORDINANCE, AS SUBSEQUENTLY AMENDED), AND THE SIGN REGULATIONS (CODIFIED AS CHAPTER 12.10, AND BEING THE FEBRUARY 9, 1993 SIGN ORDINANCE, AS SUBSEQUENTLY AMENDED), AND ENACTING REVISED SUBDIVISION REGULATIONS, ZONING REGULATIONS, AND SIGN REGULATIONS IN A CODE REFERRED TO HEREIN AS THE "UNIFIED DEVELOPMENT CODE" OR "UDC," WHICH ESTABLISHES PLATTING REQUIREMENTS AND PROCEDURES, ZONING DISTRICTS AND PROCEDURES, ZONING USE REGULATIONS, LOT DESIGN STANDARDS, SITE DESIGN STANDARDS, LANDSCAPING AND BUFFERING STANDARDS, OFF-STREET PARKING AND LOADING STANDARDS, SIGN STANDARDS, ENVIRONMENTAL PROTECTION STANDARDS, PEDESTRIAN AND VEHICLE CIRCULATION STANDARDS, INFRASTRUCTURE AND PUBLIC IMPROVEMENT STANDARDS, PROVISIONS RELATED TO NON -CONFORMING USES AND STRUCTURES, PROVISIONS ADOPTING VARIOUS TECHNICAL AND DESIGN MANUALS BY REFERENCE; AND ENFORCEMENT PROVISIONS, INCLUDING FINES AND PENALTIES FOR VIOLATIONS; REPEALING CONFLICTING ORDINANCES AND PROVISIONS; PROVIDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, on April 23, 2001 the City Council initiated a public review and amendment process whose objective was to undertake a comprehensive rewrite of the City of Georgetown's zoning, subdivision and sign regulations with the assistance of the planning consultants, Duncan and Associates, Inc., and with the understanding that there would be wide public involvement throughout the process; WHEREAS, since November 2001, the City of Georgetown's Planning and Development Services Division has been working diligently on a draft "Unified Development Code" document or "UDC" that will revise and replace (in substantial part) the City's existing subdivision, zoning, and sign regulations; and WHEREAS, over 20 public meetings including technical workshops, town hall meetings, neighborhood meetings, and public hearings have been held to receive input and comments from all parties who may be affected by the adoption of the UDC; and Ordinance No. C�Dt73 UDC Adoption Page 1 of 3 WHEREAS, hundreds of written comments were received and reviewed by Planning and Development Services in finalizing the second and third draft of the proposed "Unified Development Code," WHEREAS, following proper mailed and published notice, a joint public hearing on the UDC was held by the Planning and Zoning Commission and the City Council on January 30, 2003 as required by law and in accordance with Ordinance No. 2003-03; and WHEREAS, the Planning & Zoning Commission met on February 4, 2003 and made a final report to the City Council recommending adoption of the UDC. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the Century Plan as follows: 1. Policy Statement 2.0, which states, "Georgetown's natural and physical resources are managed so that citizens enjoy the benefits of economic and social development;" 2. Policy Statement 3.0, which states, "Citizens, business owners and organizations enjoy the benefits of well-planned land usage in which conflicting needs are balanced;" 3. Policy Statement 5.0: which states, "Prehistoric and historic resources are preserved, protected and promoted for the benefit of the citizens of Georgetown;" 4. Policy Statement 6.0 which states, "All citizens have access to safe and adequate housing opportunities;" 5. Policy Statement 10: which s tates, " Citizens a nd c ommercial g oods move safely and efficiently throughout all parts of the City;" 6. Policy Statement 11: which states, "Georgetown's citizens and businesses enjoy an attractive community with a unique sense of place and a positive, identifiable image, at a cost which is consistent with other social and economic priorities." and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The "Unified Development Code," which is attached hereto as Attachment "A" and incorporated herein by reference as if set forth in full, is hereby adopted in its entirety. Except as otherwise provided herein, all provisions of the City's Subdivision, Zoning and Sign ordinances that conflict with the provisions of the Unified Development Code are hereby repealed; however, the following provisions of the Georgetown City Code are not repealed by this ordinance: Chapter 12.08 '`Street Excavations;" Chapter 12.36 "Georgetown Airport Zoning;" Chapter 13.10 "Utility System Improvements;" and shall remain in full force and effect until repealed or amended. SECTION 4. All ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 5. If any provision of this Ordinance or the UDC, or application thereof, to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The City Secretary shall cause the caption of this Ordinance to be published one time within ten (10) days after its final passage, or as soon thereafter as possible, in the Williamson County Sun. SECTION 7: The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. The UDC adopted by this ordinance shall take effect ten (10) days after the date of the publication of its caption in the Williamson County Sun.
