AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING THE CENTURY PLAN - DEVELOPMENT PLAN PASSED AND ADOPTED ON THE 13TH DAY OF MARCH 1990, AND TO AMEND THE FUTURE LAND USE PLAN, PASSED AND ADOPTED ON THE 28TH DAY OF MAY 2002, TO INCLUDE THE WILLIAMS DRIVE CORRIDOR STUDY AS PART OF THE CENTURY PLAN — DEVELOPMENT PLAN; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council did, on March 13th, 1990, adopt the Centum Plan — Development Plan, Land Intensity, Transportation, and Utilities Functional Plan Elements as the Land Use, Transportation, and Utilities Functional Plan Elements of the Century Plan pursuant to Section 1.08. Subsection 2 of the City Charter, by Ordinance Number 900149; and WHEREAS, the adopted Centitq Plan - Policy Plan does allow for amendments to the adopted elements of the Century Plan; and WHEREAS, the City Council did, on May 18`h 2002, adopt the Future Land Use Platt and Thorouglifctre Platt, as an amendment to the Century .Plan*, and WHEREAS, the adopted Future Land Use Platt and Thoroughfare Plan outlined a strategy for completing the Williams Drive Corridor Study; and WHEREAS, the Williams Drive Corridor Study, which includes a future land use plan, objectives and recommendations for the Williams Drive corridor were created from the discussions and input received at two workshops held with residents and property owners along the corridor on September 19 and September 22, 2002; and WHEREAS, on October 2=1, 2002, a Williams Drive Corridor Study workshop, attended by more than 50 interested citizens, was held to review the draft corridor future land use plan map, and WHEREAS, the draft corridor future land use plan map for the t-1lilliams Drive Corrirdor Studv was modified based on citizen input, and presented to the Planning and Zoning Commission or: December 3, M02; and WHEREAS, the Planning and Zoning Commission did hold a Public Hearing on the Williams Drive Corridor Study on December 3, 2002; and Ordinance ti; . C2003-04 Century Plan — Development Plan C)rdinance, Williams Drive Corridor Study Elements Paue I of 3 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following goals and objectives of the Future Land Use Plan and Thoroughfare Plan: GOAL l: Encourage the most desirable and efficient use of land while enhancing the physical environment through functional and compatible land use configurations. Objective 1.2: Plan for future development that is compatible with the City's natural features, environmentally sensitive areas, and existing land uses. Objective 1.7: Review land use policies and explore the possibility of using such policies to encourage the development of non-residential "nodes", which would result in concentrated areas of retail and commercial uses instead of strip development; in addition, allowing small-scale nodes in close proximity to residential development should be explored. Objective 1.9: Identify special study areas, such as along Williams Drive, where more detailed evaluation and analysis is needed. Gau 4: Provide an efficient, safe and connective transportation system that is coordinated with existing needs and with plans for future growth; this system should be economical and responsive to environmental concerns. Objective 4.1: Use the Thoroughfare Plan and the Futit re Land Use Plan (as it is adopted subsequent to this planning effort) in conjunction to one another, specifically to ensure that the various land uses within the City are accommodated by the transportation system. Objective 4.8: Ensure that a positive image of Georgetown is reflected within major transportation corridors (e.g., State Highway 29, Interstate Highway 35), further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The Document entitled "Century Plan — Development Plan, Land Intensity, Transportation, and Utilities Functional Plan Elements" dated November 15, 1989, shall be amended as follows: A. Adding the Williams Drive Corridor StiOv. dated December 10, 2002, to the Future Land Use Plan and Thoroughfare Plan, adopted May 28`" ' 002, which is Ordinance No. 'aCO3 -oq Century Plan — Development Plan Ordinance, Williams Drive Corridor Study F1C1t1ents Pare 2 of attached hereto as Exhibit A and incorporated herein by reference for all purposes. B. Change the full title of the Development Plan to Century Plan — Development Plan, Future Land Use, Future Thoroughfare, Williams Drive Corridor Study, Land Intensipvl, Transportation, and utilities Functional Plan Elements, with short -title of Century Plan — Development Plan. SECTION 4: The Century Plan — Development Plan as hereby amended shall be implemented in accordance with the Administrative procedures in Chapter IV of the Policy Plan Element of the Century Plan adopted on March 8, 1988, SECTION 5: All future ordinances of the City implementing elements of the Century Plan — Development Plan shall be in conformity with the adopted Century Plan — Development Plan as amended by this Ordinance, SECTION 6. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 7. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 8. This ordinance shall become effective in accordance with the provisions of the Charter of the City of Georgetown. PASSED AND APPROVED on First Reading on 10th day of December 2002.
