Aor AN ORDINANCE OF THE CITY COUNCIL OF CITY OF GEORGETOWN, TEXAS SETTING A JOINT PUBLIC HEARING WITH THE PLANNING & ZONING COMMISSION AND THE CITY COUNCIL AND PRESCRIBING THE TYPE OF NOTICE TO BE GIVEN OF SUCH JOINT PUBLIC HEARING REGARDING PUBLIC COMMENTS ON AND THE POSSIBLE APPROVAL AND ADOPTION OF A NEW "UNIFIED DEVELOPMENT CODE" ("UDC") TO REPLACE THE EXISTING REGULATIONS PERTAINING TO SUBDIVISIONS, ZONING, AND SIGN REGULATION; REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, for approximately one year, the City of Georgetown's Development Services Department has been working on a draft "Unified Development Code" or "UDC" that will revise and replace the City's existing subdivision, zoning, and sign regulations; and WHEREAS, numerous town hall meetings and workshops have been held in order to receive input and comments from all parties who may be affected by the adoption of the UDC; and WHEREAS, Sections 211.006(c) and 211.007(d) of the Texas Local Government Code allows a City Council to adopt an ordinance streamlining the public hearing process and specifying the type of notice to be provided for the time and place of a public hearing to be held jointly by the City Council and the Planning & Zoning Commission; and WHEREAS, the City Council desires to have a joint public hearing with the Planning & Zoning Commission and to prescribe the type of notice to be provided of the public hearing.. NOW THEREFORE, BE IT ORDAINED BY THEY CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT: SECTION 1. Pursuant to the authority granted in Sections 211.006(c) and 211.007(d) of the Texas Local Government Code, the City Council of the City of Georgetown hereby prescribes that a joint meeting of the City Council and the Planning & Zoning Commission shall be held on January 30, 2003 at 6:00 p.m. at Benold Middle School, 3407 Northwest Blvd., Georgetown, Texas for the purpose of holding a joint public hearing to consider public comments on and possible adoption of the UDC. SECTION 2. Pursuant to authority granted in Sections 211.006(c) and 211.007(d) of the Texas Local Government Code, the City Council of the City of Georgetown hereby Ordinance No. Notice of Joint Public Hearing for UDC prescribes that the type of notice to be given of the joint public hearing shall be published and mailed notice as specified in Section 3 of this Ordinance. SECTION 3. The public notice of the joint public hearing prescribed by this Ordinance shall be (1) published in the Williamson County Sun fifteen (15) or more calendar days prior to the date of the joint public hearing, and (2) mailed to each owner of property within the city limits, as detennined by the most recent municipal tax roll of the Williamson County Tax Appraisal District, before the tenth (10t'') day before the date of the joint public hearing, and the notice shall be considered to be properly served by its deposit in the United States mail. A copy of the notice to be mailed is attached hereto as "Attachment A" and incorporated herein by reference for all purposes as if set forth in full. SECTION 4. This ordinance was adopted by at least a 2/3 vote (i.e., approval by at least 5 members) as required by Sections 211.006(c) and 211.007(d) of the Texas Local Government Code, SECTION 5. All ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 6. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Georgetown. Carts, Brown & Carls, LLP, City Attorney Ordinance No. � 03 Notice of Joint Public Hearing for UDC THE CITY OF GEORGETOWN LOWE Nelon, Mayor r, it � f City of Georgetown Joint Public Hearing on the Unified Development Code The Georgetown City Council and Planning and Zoning Commission will hold a Joint Public Hearing on the Proposed Unified Development Code (UDC) Date & Time: Thursday, January 30, 2003 at 6:00 p.m. Location: Benold Middle School Cafeteria 3407 Northwest Boulevard Georgetown, Texas As a property owner within the City you are advised of the joint public hearing and opportunity to comment on the proposed Unified Development Code. If adopted, the Unified Development Code will replace the City's existing Zoning, Subdivision, and Sign Regulations. A copy of the proposed Unified Development Code will be available for public review at the Division of Planning and Development Services and the Georgetown Public library before the hearing. It is also available on the City's website at: www.georgetown.org/city/ If the UDC is adopted by the City Council, the City's existing zoning districts will be renamed but the existing zoning district boundaries will not change. Some new zoning and overlay districts will be added. In addition, some uses and design standards within some of the existing zoning classifications will also change. The charts below illustrate some of the proposed changes in zoning classifications and in allowable uses from the existing regulations.
