HomeMy WebLinkAboutRES 021412-Mis i' • RESOLUTION GEORGETOWN, DECEMBER 31, 2012 FOR APPLICATIONS COUNCIL OF AN AMNESTY EXPIRED LAND rHE CITY OF PERIOD WHEREAS, the City Council of the City of Georgetown, Texas wishes to encourage and further economic development, incentivize development, and recognize the stresses on the economy that may have resulted in project development delays; and WHEREAS, there are pending Unified Development Code (UDC) amendments that will provide for a Site Plan and Preliminary Plat extension and reinstatement process, as well as increase the expiration periods for some other development application types; and WHEREAS, the Ordinance for the pending UDC amendments is anticipated to receive first reading by the City Council on March 27, 2012. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY *F GEORGETOWN, Section 1. That land development applications, approved pursuant to UDC Chapter 3, with pending expiration dates shall be eligible to receive the benefit of the anticipated UDC amendments related to expirations and extensions. The expiration of these application is hereby extended to May 1, 2012. Those applications whose expiration is extended based on this Resolution may utilize the amended extension processes as outlined in the UDC, once adopted. There shall be no cost to extend the application expiration until May 1, 2012. Section 2. Site Plan, Preliminary Plat, Final Plat, Construction Plan, and Stormwater Permit applications approved after January 1, 2007, that have expired, may be resubmitted for an extension to the UDC deadline for the specific application type. The deadline to apply for an extension is December 31, 2012. The application fee for the extension subject to this Resolution shall be 50% of the original application fee. The expired application may not be modified from the original application or the application extension will be denied. The Community Development Director shall determine whether the expired application is modified from the previously approved application. The Community Development Director is directed to publish notice of the amnesty period made available by this Resolution.
