HomeMy WebLinkAboutORD 2013-14 - Rates & Charges - Water -ScheduleAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING SECTION 13.04.120 ENTITLED "RATES AND CHARGES--WATER--SCHEDULE" OF THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN TEXAS; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, The City of Georgetown implements a monthly meter charge and a standard volumetric water rate to recover the costs of providing water service, and WHEREAS, Residential conservation water rates are automatically enacted on consumption from May through September of each year and other periods, as authorized by the General Manager, based upon irrigation demand and drought conditions; and WHEREAS, Residential conservation water rates were implemented to recover costs associated with excessive water use, as well as a deterrent to excessive irrigation, in order to conserve the City's water resources in accordance with its water conservation plan, adopted by the City Council: and WHEREAS, The adoption of inclining block rates as the standard water rates for all residential water and small commercial water 1.ise, to be utilized throughout the year, will provide continuous motivation to conserve the City's water resources. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS THAT. Section 1. The meeting at which this ordinance was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551, Section 2. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance complies with the Vision Statement 4.0(G) of the City of Georgetown 2030 Comprehensive Plan relating to the conservation of water resources. Section 3. Section 13.04.120 "Rates and Charges--Water--Schedule" of the Code of Ordinances of the City of Georgetown, Texas is hereby amended to read as follows: Ordinance Number: 4;o # M. Customer charge, per month: a. % inch meter, $ 16.50 b. 3/4 inch meter, $ 18.50 C, 1 inch meter, $ 30.90 d. 1 '/2 inch meter, $ 61.61 e. 2 inch meter, $ 98.61 f. 3 inch meter, $ 197.40 g. 4 inch meter, $ 308.40 h. 6 inch meter, $ 616.61 i. 8 inch meter, $ 986.61 2. Nonresidential Customers Cost per 1,000 gallons, $2.25 3. Residential Customers: Cost per 1,000 gallons a. Up to and including 18,000 gallons b. Over 18,000 gallons, up to and including 29,000 gallons: $3.00 C. Over 29,000 gallons, up to and including 39,000 gallons: $4.50 d. Over 39,000 gallons, up to an including 74,000 gallons: $6.00 e. Over 18,000 gallons, up to and including 29,000 gallons: $3.35 C, Over 29,000 gallons, up to and including 39,000 gallons: $4.85 d. Over 39,000 gallons, up to an including 74,000 gallons. $6.35 e. Over 74,000 gallons: $7.85 C. Non -potable water: Cost per 1,000 gallons, $1.05 D. Bulk Water: For water use from fire hydrant meters and all other miscellaneous water usage not regularly billed. 1. A $150.00 deposit is required prior to use, unless water is prepaid. 2. Usage is read and billed monthly. 3. Rate used based on inside or outside city limits, as appropriate. 4. Customer is responsible for the meter and all parts and retrofits to the meter involved in the meter reading process. E. Water rates are to be reviewed, by staff, and presented to City Council, every three years, on a schedule that coincides with the review of the water impact fees. F. Establish and maintain a water funding reserve, to be known as the "Rainy Day" Fund, independent of the contingency reserve. L Year end, excess water reserves will be used to support the Rainy Day Fund. 2, Rainy Day Funds will be used to offset weather related revenue impacts in subsequent years. G. Exemption to the rates provided in this section may be requested by a customer, in writing, from the City Manager, or his assigned agent, for leaks that occur on the customer side of the meter. H. All other provisions for City utility service shall apply, except as provided in this chapter. All ordinances that are in conflict with the provisions of this ordinance be, and the same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 6. If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Section 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect on May 1, 2013 after publication and in accordance with the provisions of the Charter of the City of Georgetown and shall be effective for all utility billings after May 1, 2013, PASSED AND APPROVED on First Reading on the 12th day of March, 2013.
