HomeMy WebLinkAboutORD 2004-88 - Liquefied Petroleum GasAN ORDINANCE OF THE CITY OF GEORGETOWN, TEXAS AMENDING SECTION 8.04.055 OF THE CODE OF ORDINANCES PERTAINING TO ABOVE GROUND TANKS TO REVISE CERTAIN PROVISIONS RELATING TO THE STORAGE, USE, TRANSPORTATION AND HANDLING OF LIQUID HAZARDOUS MATERIALS; PROVIDING A SAVINGS CLAUSE; AND REPEALING ALL ORDINANCES IN CONFLICT. WHEREAS, the City Council of the City of Georgetown, Texas is required to and desires to appropriately exercise its police power to protect the health, welfare and safety of its citizenry; and WHEREAS, the City Council recognizes that liquid hazardous materials such as gasoline, naptha, diesel, etc., if not properly controlled and regulated, constitute a dangerous and hazardous condition affecting the health, safety, and welfare of the general public; and WHEREAS, the City Council recognizes the need to regulate the use, handling, transportation, and storage of any form of liquid hazardous materials within the city limits of the City of Georgetown, Texas; WHEREAS, the City Fire Marshal and Building Official have reviewed the City's current ordinance related to liquid hazardous materials and have recommended that its provisions be revised as set forth herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Section 1. Section 8.04.055 of the City of Georgetown Code of Ordinances is hereby amended to provide as follows: See. 8.04.055. Storage of Liquid Hazardous Materials in Above Ground Tanks. A. Section 304 of the 2003 International Fire Code is adopted with the following revision: "The storage of flammable or combustible liquids or hazardous materials in above ground tanks outside of buildings is prohibited except as provided herein." B. Any aboveground tank for the purposes of the storage of flammable, combustible, or otherwise hazardous materials, shall be installed in accordance Ordinance No. 01DOq• 9s Amending Sec. 8.04.055 Liquid Hazardous Materials Page 1 of 4 with the following: 1. The tank shall be a "vaulted" tank, built to testing agency specifications and approved by the authority having jurisdiction. Minimum standards shall include any U.L. listed (standard 142 steel aboveground tanks for flammable and combustible liquids) steel tank, all portions of which shall be enclosed in a secondary containment and encased with six inches of reenforced concrete and the complete structure shall be U.L. listed in accordance with U.L. Subject 2085, protected type. 2. All aboveground tanks shall have a spill containment area capable of holding the combined capacity of all tanks in the facility. This containment structure shall be built of a material that is impervious to the material being stored. 3. All aboveground tanks located inside the city limits of Georgetown, Texas shall be directly accessible from a major arterial roadway, as defined by Section 10.04.030 of this Code "Flammable Liquid Transport and Parking Restrictions," or by a street within the confines of an area designated as a Business Park or Industrial District (as defined in Section 4.04.020 of the City's Unified Development Code). 4. All aboveground tanks shall have emergency vehicle access from all sides via an all-weather driving surface of not less than 20 feet in width with adequate roadway turning radius, capable of supporting the imposed loads of fire apparatus, and having a minimum vertical clearance of 13 feet six inches. 5. Tanks shall be limited in size to not exceed 1,000 gallon capacity. 6. Aboveground tanks within the city limits shall not be used for commercial or retail purposes. 7. Aboveground tanks within the city limits of Georgetown, Texas shall not be located in Residential Districts (as defined in Section 4.04.010 of the City's Unified Development Code.). 8. All aboveground tanks shall follow all guidelines set forth in National Fire Protection Association Standards 30 and 30A as amended. 9. No aboveground tanks shall be allowed in a fire district(s). 10. No more than two tanks shall be allowed at any one site. 11. All aboveground tanks shall be protected from mechanical damage by Ordinance No. c2ooq - Amending Sec. 8.04.055 Liquid Hazardous Materials Page 2 of 4 guardrafts or guard posts. 12. No materials can be dispensed by gravity feed, all materials shall be dispensed by approved pumps taking suction through the top of the container. 13. Aboveground storage tanks shall comply with all City, County, State and Federal statutes and regulations. 14. No aboveground tank may be installed without first obtaining a permit from the City. SECTION 2: All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed. SECTION 3: The invalidity of any section or provision of this ordinance shall not invalidate other sections or provisions thereof. SECTION 4: The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Georgetown.
