HomeMy WebLinkAboutORD 2004-87 - Adoption of CodesORDINANCE i a r AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AMENDING THE FOLLOWING CHAPTERS IN THE CITY OF GEORGETOWN CODE OF ORDINANCES TO PROVIDE FOR THE ADOPTION OF THE 2003 INTERNATIONAL BUILDING, FIRE, EXISTING BUILDING, PROPERTY MAINTENANCE, PLUMBING MECHANICAL, AND FUEL GAS CODES -- CHAPTER 15.04 "BUILDING CODE"; CHAPTER 15.08 "MECHANICAL CODE"; CHAPTER 15.12 "PLUMBING CODE"; CHAPTER 15.20 "GAS CODE"; CHAPTER 15.25 "EXISTING BUILDING CODE"; RENUMBERING THE SECTIONS OF CHAPTER 15 TO IMPLEMENT THESE AMENDMENTS; PROVIDING FOR THE PHASING IN OF THE APPLICATION OF THE 2003 INTERNATIONAL BUILDING, FIRE, EXISTING BUILDING, PROPERTY MAINTENA1NCE9 PLUMBING, MECHANICAL AND FUEL GAS CODES; ESTABLISHING A TRI -ANNUAL REVIEW PERIOD; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; INCLUDING A PENALTY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, it is the desire of the City Council of Georgetown, Texas to adopt, in all respects, the "2003 International Building Code, Fire, Existing Building, Property Maintenance, Plumbing, Mechanical and Fuel Gas", (the "International Codes") with the associated commercial and residential code requirements and (appendices, errata, deletions, local amendments and as amended in the future) relating to commercial building, fire prevention, plumbing, mechanical, fuel gas, existing buildings and property maintenance for residential and non-residential set forth herein; and WHEREAS, the City Council of Georgetown, Texas has found that the present commercial construction codes of the City of Georgetown have become obsolete and inadequate; and WHEREAS, the City Council of Georgetown, Texas is adopting the 2003 International Codes, in order to provide one set of consistent building code regulations for building designers contractors, builders and designer's working nationally; and WHEREAS, the City Council of Georgetown, Texas has determined that the adoption of the International Codes is done to facilitate proper inspection activities by Georgetown, Texas relating to construction within the corporate city limits of Georgetown and in the extra -territorial jurisdiction of Georgetown, for commercial buildings served by Georgetown utilities, relating to public safety, health, and general welfare; and WHEREAS, the Building Standards Commission, which has been appointed by the City Council, has (1) reviewed the effect of the proposed regulations; (2) held public hearings related Construction Codes Ord. No. A00 °' 97 Chapter 15.04 — Building Code Page 1 to same; and (3) made recommendations to the City Council for adoption of the same, including the revisions and deletions to the regulations noted herein; and WHEREAS, the caption of this Ordinance has been published in the Williamson County Sun in compliance with the City Charter of the City of Georgetown. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this Ordinance are hereby declared to be true and correct, and are incorporated be reference herein and made a part hereof, as if copied verbatim. The City Council hereby finds that this Ordinance implements the following Policies of the Century Plan — Policy Plan Element: Housing Policy S.0 "All citizens have access to safe and adequate housing opportunities. " Further, as required by Section 2/03 of the Administrative Chapter of the Policy Plan, the City Council hereby finds that the enactment of this Ordinance is not inconsistent with or in conflict with any other Century Plan Policies. SECTIQN 2: Chapter 15.04, `Building Code," is hereby amended as shown on f.xhibit A to this Ordinance, which is attached hereto and incorporated herein as if set forth in full. SECTION 3: Chapter 15.06, Property Maintenance Code," is hereby added as shown on Exhibit B to this Ordinance, which is attached hereto and incorporated herein as if set forth in full. SECTION 4: Chapter 15.08, "Mechanical Code," is hereby amended as shown on Exhibit C to this Ordinance, which is attached hereto and incorporated herein as if set forth in full. SECTION 5: Chapter 15.12, "Plumbing Code," is hereby amended as shown on Exhibit D to this Ordinance, which is attached hereto and incorporated herein as if set forth in full. SECTION 6: Chapter 15.20, "Gas Code" is hereby renamed "Fuel Gas Code and amended as shown on Exhibit E to this Ordinance, which is attached hereto and incorporated herein as if set forth in full SECTION 7: Chapter 15.25, "Existing Building Code," is hereby amended as shown on Exhibit F to this Ordinance, which is attached hereto and incorporated herein as if set forth in full. SECTION 8: All projects that are under construction on the Effective Date of this Ordinance and all complete applications for a building permit accepted by the City of Georgetown on the Effective Date of this Ordinance shall be allowed to complete construction under the terms of the prior provisions of Chapter 15 and shall not be required to meet the requirements of the 2003 Construction Codes Ord. No. _ Chapter 15.04 — Building Code Page 2 International Codes. All permit applications submitted after the Effective Date of this Ordinance shall comply with the terms of the Chapter 15 as amended by this Ordinance in its entirety. SECTION 9: The City Council has directed the Building Official to prepare a review of the newest updated version of the construction codes three (3) years from the effective date of this Ordinance. SECTION 10: All Ordinances and Resolutions, or parts of Ordinances and Resolutions, that are in conflict with this Ordinance are hereby repealed, and no longer in effect. SECTION 11: If any provisions of this Ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or applications thereof, of this Ordinance which can be given effect without the invalid provision or application and to this end the provisions of this Ordinance are hereby declared to be severable. SECTION 12: The Mayor of Georgetown is hereby authorized to sign this Ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effecting accordance with the terms of the City Charter, PASSED AND APPROVED on First Reading on the day of November 2004. No. " t Chapter 15.04 — Building Code Page 3 THE CITY OF GEORGETOWN: Mayor EXHIBIT "A" CHAPTER 15.04. BUILDING CGDE Sec. 15.04.010. Building Code Adopted. A. The provisions of the 2003 International Building Code (IBC) are hereby adopted by reference as if set forth in full, including Appendices C, E, F, I and J, with the specific local amendments as set forth in this Chapter. In this Chapter the 2003 International Building Code shall be referred to as "the Code" and the Code shall apply to the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such buildings or structures. B. Designated Officials. Within the Code adopted in this Section, reference is made to the duties of certain officials named therein; it is the intention of the City Council that the designated official of the City who has duties corresponding to those of the named official in the Code shall be deemed to be the responsible official in charge of enforcing the provisions of the Code. C. A copy of the Code shall be placed at the Georgetown Public Library and on file at the office of the Building Official. Sec. 15.04.012. Reserved. Sec. 15.04.020. Definitions. "Corporation counsel" means the City Atto.ney. "Municipality" means the City of Georgetown. Sec. 15.04.030. Nonliability--Defense of suits. Any officer or employee, or member of the Building Standards Commission, charged with the enforcement of the code, acting for the applicable governing authority in the discharge of their duties, shall not thereby render themselves personally liable, and is relieved from all personal liability, for any damage that may accrue to persons or property as a result of any act required or permitted in the discharge of their duties. Any suit brought against any officer or employee or member because of such act performed by him in the enforcement of any provision of this code shall be defended by the City Attorney until the final termination of the proceedings. Sec. 15.04.040. Permit fees. A. Section 108.2 Schedule of Fees, Chapter 1 of the 2003 Code is hereby deleted and replaced with the following: "A building permit shall not be issued until all fees as set forth by the City Council for the City of Georgetown, Texas have been paid in full. B. Permit Fees are based on total building valuation as determined by current area square foot valuation data published periodically by the International Code Council (ICC) and for all references made herein for applicable fees. C. New Construction. Residential Single -Family (Detached and Attached), Duplex, Tri- plex and Four-plex: Pen -nit Fees are based on total building valuation as determined by current area square foot valuation data published periodically by the International Code Council (ICC). Permit fee calculations: Valuation determined by the current square foot valuation multiplied by the total square feet of the proposed residential building (includes uncovered porches, balconies, and patios). The base fee is assigned for the least valuation amount in the applicable range. An incremental fee is assigned for each additional $1,000.00 (or fraction thereof) ofbuilding valuation in excess of the least valuation in the applicable range, to and including the highest figure in that .range, and is added to the base fee. All plans for new residential buildings no more than two Stories high and four living units, no fees. Residential buildings three stories in height and more than four living units, plans check fee shall be one-half of the building permit fee payable at the time of issuance of the building pemiit. All plans for new commercial buildings as classified by the building code as commercial occupancy types and remodels, additions or alterations tI e plan check fee shall be one-half of the total building permit fee. All other buildings, including residential structures and in excess of four stories high, commercial buildings three stories and higher, schools and all other buildings are subject to be forwarded to International Code Council (ICC) for plans review at the discretion of the Building Official. For those plans forwarded to ICC for review, the fees as detennined by ICC at the time of submittal shall be nonrefundable and be paid directly to ICC by the applicant. The provisions of the 2003 International Property Maintenance Code (IPMC) are hereby adopted by reference as if set forth in full, with the specific local amendments as set forth in this Chapter. In this Chapter the 2003 International Property Maintenance Code shall be referred to as "the Code" and the Code shall apply to all existing residential and nonresidential structures and all existing premises and constitute minimum requirements and standards for premises, structures, and equipment as provided for in Section 101.2 and all other sections of the Code. B. Designated Officials. Within the Code adopted in this Section, reference is made to the duties of certain officials named therein; it is the intention of the City Council that the designated official of the City who has duties corresponding to those of the named official in the Code shall be deemed to be the responsible official in charge of enforcing the provisions of the Code. C. A. copy of the Code shall be placed in the Georgetown Public Library and on File in the office of the Building Official, Sec. 1.5.06.020. Fees. The Code, Chapter 1, "AdminisiYation", Section 103.6 "Fees" shall be deleted and replaced with the following: "The fees for the activities and services performed under the provisions of this Code shall be paid in accordance with the schedule as established by the City Council of Georgetown, Texas as referenced in Chapter 15.04 of the Code of Ordinances." See. 15.06.030. Violation — Penalties. The Code, Chapter 1 "Administration", Section 106.4 "Violation Penalties" is hereby deleted in its entirety and replaced with the following: "Any person violating any provision of this Chapter or the Code is subject to punishment as provided in Section 1.08.010 of the Code of Ordinances." Sec. 15.06.040. Means of Appeals. The Code; Chapter 1 "Administration", Section 111 "Means Of Appeals" is hereby deleted in its entirety and replaced with the following: For the purpose of this Chapter and the Code, the Means of Appeals, as referenced throughout the Code, concerning property maintenance shall be knownn as the Building Standards Commission, as appointed by the City Council of Georgetown, Texas. The Commission shall hear cases involving appeals, orders and decisions or determinations made by the Building Official or designee to the application and interpretation of the Code. Reference shall be made to Construction Codes Ord. The provisions of the 2003 Mechanical Code (IMC) are hereby adopted by reference as if set forth in full, including Appendix A, with the specific local amendments as set forth in this Chapter. In this Chapter the 2003 International Mechanical Code shall be referred to as "the Code" and the Code shall regulate the design, installation, maintenance, alteration and inspection of mechanical systems that are permanently installed and utilized to provide control of environmental conditions and related processes within buildings. B. Designated Officials. All openings must be r placed in precisely the same condition as before the excavation started and all rubbish and materials must be removed at once, leaving the street or sidewalks clean and in perfect repair. C. All openings shall be marked with sufficient barriers.
