Me a004 " 0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING PART OF THE ZONING DISTRICT MAP ADOPTED ON THE 4T" DAY OF APRIL 2002 IN ACCORDANCE WITH THE UNIFIED DEVELOPMENT CODE PASSED AND ADOPTED ON THE ,IITH DAY OF MARCH 2003, TO CHANGE 65.036 ACRES, OUT OF THE BURRELL EAVES SURVEY, ABSTRACT 216, LOCATED ON SUN CITY BOULEVARD, TO BE KNOWN AS SUN CITY GEORGETOWN, ASSISTED LIVING CEN'T'ER, AS RECORDED IN DOCUMENT NUMBER 96 9468 OF THE OFFICIAL RECORDS OF WILLIAMSON COUNTY, TEXAS, FROM AG, AGRICULTURE TO PLANNED UNIT DEVELOPMENT (PUD); REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, an application has been made to the City Council for the purpose of changing the zoning district classification of the following described real property ("the property"): 65.036 ACRES, OUT OF THE BURRELL EAVES SURVEY, ABSTRACT 216 LOCATED ON SUN CITY BOULEVARD TO BE KNOWN AS SUN CITY GEORGETOWN, ASSISTED LIVING CENTER, AS RECORDED IN DOCUMENT NUMBER 9619468 OF THE OFFICIAL RECORDS OF WILLIAMSON COUNTY, TEXAS, hereinafter referred to as "the property"; WHEREAS, the City Council has submitted the proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report; and WHEREAS, notice of such hearing was published in a newspaper of general circulation, in the Ciiv: which stated the tune and place of hearing, which time was not earlier than ffteen (15) days for the first day of such publication; and W� iEREAS, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the lots within two hundred feet of the property, as required by law; and WHEREAS, the applicant for such zoning change placed on the property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (17} days before the date set for such hearing; and WHEREAS, the City Planning and Zoning Commission in a meeting held on November 4, 2004 recommended changing said zoning district classification of the above` described property from AG, Agriculture district classification to Planned Unit Development (PUD), in accordance with attached Exhibit Al WHEREAS, in co=mpliance Development Pian was submitted Development district, Assisted Uving Center PUD Page 1 of 3 with Section 4.04.030(A)(2) of the Unified Development Code a in conjunction with the requested establishment of the Planned Unit `NHEREAS, the City PI -Nr �ning and Zoning Commission in a meting held on November 4, 2004 recommended adoption cf the Development Plan for the Planned Unit Development, attached hereto as Exhibit B, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF 'THE CITY OF GEORGETOWN, TEXAS, THAT SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby fot:nd and declared to be true and correct, and are incorporated by reference herein and expressly made a par hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following objective cf the Georgetown Century Plan, Future Land Use and Thoroughfare Plan: Goal 1: Encourage the most desirable and efficient use of land while enhancing the physical environment through functional and compatible land use configurations. Objective 1.5: Require zoning change requests to be consistent wit the Future Land Use Plan Objective 6.3: Promote the availability of a variety of housing types within the City that will meet the needs of all segments of the Georgetown population including age, family status, income and household size SECTION 2. The City Council hereby finds that the proposed Planned Unit Development and Development Plan satisfy the approval criteria of Section 3.06.030 and Section 3.06.404 of the Unified Development Code, as follows: Section 3.06.030 Approval Criteria (Rezoning) A. The application materials submitted provide complete, sufficient and correct information necessary to render adequate review and final action; S. The propose PUD is consistent with the Comprehensive Plan land use designation of "Residential!.a;pd impleme,1 the fallowing Goals / Policies of the future Land Use Plan: 0 Objective 1 e5: Require zoning change requests to be consistent wit the Future Land Use Plan. The Land Use designation for the site is "residential'. O Obiective 6.3: Promote the availability of a variety of housing types within the City that will meet the needs of all segments of the Georgetown population including age, family status, income and household size. C. The proposed PUD promotes the health, safety, or general welfare of the City and the safe, orderly and healthful development of the City, D. The proposed PUD is compatible with the zoning and use of surrounding properties and with the character of the surrounding area: * Surrounding land uses inciude single family residential and tracts of open space. E. The site is suitable for the range of uses proposed with the PUD district. 6 An assisted living center is classified as group living within the multi -family zoning classification. Section 3.06.040 Approval Criteria (Planned Unit Development) 1. The :proposed project provides for a variety of assisting living housing types which serve a specific segment of the population. Included within the development are apartments, independent living units and a skilled nursing facility. 2. The location of the project provides for an orderly arrangement of land uses within the area by situating the facility adjacent to single-family neighborhoods within the Sun City development. Vehicular access to the development is provided via Sun City Boulevard, an arterial roadway. The proposed building locationfsi will maximize the environment by preserving significant open space as reflected in Tracts A and B. 6. f he staging of the development is such that the provision of utilities can be easily accommodated. and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Pian Poiicies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 3. The Zoning District Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from AG, Agriculture district classification to Planned Unit Development (PUD), in accordance with Exhibit A attached hereto and incorporated by reference herein is hereby adopted by the City Council of the City of Georgetown, Texas. SECTION 4. The Development Plan accompanying the Planned Unit Development, attached hereto as Exhibit S, is hereby adopted by the City Council of the City of Georgetown, Texas. SECTION 5. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no conger of any force and effect. SECTION 6. If any provision of this Ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of tI lis Ordinance are hereby declared to be severable. SECTION ?. The Mayor is hereby authorized to sign this Ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect on the date of final adoption by City Council. PASSED AND APPROVED on First Reading on the 23rd day of November 2004. PROPERTY This Development elan covers approximately 65 acres of land located within the city limits of GeorgetoNvn, Texas, described as 65.036 acres out of the Burrell Eaves Surrey, to be known as "Sum City Georgetown, Assisted Living Center. The legal description and field notes of the site are attached as Exhibit B. B, PURPOSE In accordance with Unified Development Plan", the following is a summary of the Assisted Living Center of Sun City Texas. C. A Prelin1mary Plat for Assisted Living Center has been submitted to the City of Georgetown on behalf of Del Webb Texas Limited Partnership. A copy of this piat is attached hereto as Exhibit A and incorporated herein. b. The platted area is intended to be developed as a residential group living designed as a assisted living center development. c. Lot 1 within the Assisted Living Center shall be developed as standard `croup living nursing or convalescent home consistent with the development standards contained herein. i. Assisted Living Center plat shall be developed with on Lot 1, 15.411 acres to be built as an assisted living center facility. It is Sun City's desire to facilitate the development of a health care campus on approximately 15 acres within Sun City Texas. hlitial plans indicate an �%ssisted Living (AL) Center- with an Alzheimer�s Care Winu. This facility will be a structure built and licensed within the State AL guidelines. The exterior will be mostly masonry with a high quality asphalt shingle roof The main entrance will feature a Porte cochere. There will be a total of 90 units, approximately 60 of which will be developed as phase 1, all with private baths. The facility will have a commercial kitchen as well as a laundry to launder facility linens and residents personal clothing. e. The facility will require 24-hour care and will be staffed over 3 shifts. It is anticipated that approximately 18 staff vehicles (not taking into account some personnel may car pool) on the day shift with approximately 10 or, the evening shift and 5 on the night shift. f. As aging in place occurs, residents may require a higher acuity level of care, thus fhe plan also incorporates a skilled nursing facility (SNh) as part of phase 2. This element will add to the continuum of care. This SNF will be a structure complementing the architectural exterior of the AL center witl, its cwn entrance. There will be 120 residentslbeds all with private baths. Again, it will be staffed 24hours a day on a shift schedule. Day slift: will expect approximately 24 employees; Evening shift would employ about 16 and the Night shift will have 7 on staff. g. Phase 3 of the project will include a group of independent living units with associated medical services or assisted living units for those requiring limited services and assistance. Once again the architecture of this structure will compliment the other buildings on the campus and will included 90 units. 2. Proposed Acreage and Usage a. The development area includes one lot and two tracts: a. Block 1, Lot 1 15.411 acres b. Block 1, Tract A 31.308 acres c. Block 1, Tract B 12.369 acres The assisted living center will be constructed on Lot 1 and Tract B and Tract C will remain as open space. Circulation Sun 1.1L.Boul,.,vard median will be reduced from 18' to 10' but will retain four L raffic lanes and 120' of ROW. M . Parkland / Open. Space In accordance with Development Agreement - Amendment No. 6, public parks are not required within the neighborhood. 6. Public Facilities There are no public facilities, i.e., schools or fire station within the neighborhood boundary.
