C AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING SECTION 13.04.140 ENTITLED "RATES AND CHARGES- -SEWERS --SCHEDULE" OF THE CODE OF ORDINANCES OF THE CITY OF GEORGETOWN TEXAS; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, The City of Georgetown established its current wastewater rates in 2003, as directed by phase 11 of a cost of service and rate design study for wastewater; and WHEREAS, City Council, in 2003, decided to phase-in the recommend rate increase incrementally, at $.15 per year, over two years; and WHEREAS, The outside city limit rates earn a higher rate of return than inside city limit rates due to the risks and responsibilities borne by inside city limit customers; and WHEREAS, The City of Georgetown wishes to implement rates that fully recover the cost of wastewater service to make the utility self-supporting; and WHEREAS, The City Council of the City of Georgetown wishes to amend the current, standard wastewater rates and adopt proposed rates, effective on all utility billings after November 15, 2004. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT. SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Finance Policy End 4.0 of the Century Plan - Policy Plan Element, which states: "The City will conduct all municipal operations in an efficient business -like manner and sufficient financial resources for both short-term and long-term needs are provided," and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2, Section 13.04.140 'Rates and Charges--Sewer--Schedule" of the Code of Ordinances of the City of Georgetown, Texas is hereby amended to read as follows: "Rates and charges for sewer charges are as follows: OrdinanceSewer Rate A. Residential Rates 1, Inside City Limits a. Customer charge, per month: $11.75 b. Cost per 1,000 gallons: $3-19 $3.25 c. The non-residential charges in this section are computed using the actual water usage billed per month. 2. Outside City Limits a. Customer charge, per month: $11-75 $13.50 b. Cost per 1,000 gallons: $3.18 $3.85 c. The non-residential charges in this section are computed using the actual water usage billed per month. C. Customer may request in writing that the City Manager, or his assigned agent, calculate a sewer charge using a basis for calculation other than that provided in this section, when such other basis results in an average that is fair and equitable to both the customer and the entire system. Such requests will be made annually. D. Anyone receiving City water service and connected to City sewer must pay the sewer charges in this section. Anyone whose home is both vacant and under contract to sell with a real estate agent, will be exempt from paying for sewer service upon application for exemption with the Utility Office. SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary Sewer Rate Ordinance No. C200" Page 2 of 3 to attest. This ordinance shall become effective and be in full force on all billing on or after November 15, 2004, in accordance with the provisions of the Charter of the City of Georgetown.
