AMENDING SECTION 15.04.045 "DEVELOPMENT PROCESS
FEES" OF THE CODE OF ORDINANCES (THE "CODE") TO
REVISE PLANNING AND ZONING FEES; REPEALING
CONFLICTING ORDINANCES AND RESOLUTIONS;
INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING
AN EFFECTIVE DATE.
WHEREAS, the Unified Development Code (UDC), adopted on March 11, 2003,
introduced several new permits for which no development process fees were previously
established or approved; and
WHEREAS, on June 22, 2004 the City Council adopted Ordinance 2004-33
amending the UDC and creating new permits for which no process fees were previously
established. or approved; and
WHEREAS, upon the effective date of these Ordinances the City became
responsible for accepting and processing applications submitted pursuant to the UDC;
and
WHEREAS,
the
majority of
these fees are established to off -set the costs
associated with the
City's
processing
of these applications; and
WHEREAS, the caption of this ordinance was printed in the Williamson County
Sun on July 21, 2004 in compliance with the City Charter of the City of Georgetown.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, THAT.
SECTION 1. The facts and recitations contained in- the preamble of this
ordinance are hereby found and declared to be true and correct, and are incorporated by
reference herein and expressly made a part hereof, as if copied verbatim. The City
Council hereby finds that this ordinance implements the following element of the Century
Plan Policy Plan and that the enactment of this ordinance is not inconsistent with nor in
conflict with any other Century Plan Policies, as required by Section 2.03 of the
Administrative Chapter of the Policy Plan: 11
Policy Statement 14.0: "All municipal operations are conducted in an efficient
business -like manner and sufficient financial resources for both current and
future needs are provided.
SECTION 2. Section 15.04.045 of the Code of Ordinances entitled
"Development Processing Fees" is hereby amended as shown on Exhibit "A" attached
hereto and incorporated herein.
SECTION 3. This ordinance shall be and is hereby declared to be cumulative of
all other ordinances of the City of Georgetown, and this ordinance shall not operate to
repeal or affect any such other ordinances, except insofar as the provisions thereof
might be inconsistent or in conflict with the provisions of this ordinance, in which event
such conflicting provisions, if any in such other ordinance or ordinances are hereby
superseded.
SECTION 4. if any provision of this ordinance or application thereof to any
person or circumstance, shall be held invalid, such invalidity shall not affect the other
provisions, or application thereof, of this ordinance which can be given effect without the
invalid provision or application, and to this end the provisions of this ordinance are
hereby declared to be severable.
SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This Ordinance shall become effective and be in full force and effect
on the date of final adoption by the City Council,
PASSED AND APPROVED on First Reading on the 10th day of August 2004,
PASSED AND APPROVED on Second Reading on the 24th day of August 2004.
