HomeMy WebLinkAboutORD 2004-41 - Board Member QualificationsAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS AMENDING SECTION 2.36.020 OF THE CODE OF ORDINANCES, PERTAINING TO QUALIFICATIONS FOR BOARD, COMMISSION, AND COMMITTEE MEMBERS, ADDRESSING SERVICE ON MORE THAN ONE PERMANENT BOARD, COMMITTEE OR COMMISSION, ADDRESSING CITY EMPLOYEES' ELIGIBILITY FOR SERVICE AS BOARD, COMMITTEE OR COMMISSION MEMBERS; INCLUDING SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Georgetown has created several city boards, committees, and commissions that are charged with advising the City Council on various matters of importance to the City; and WHEREAS, the City usually receives numerous applications from persons interested in service on such boards, committees, and commissions and desires to provide an opportunity for service to as many persons as possible. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are found to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Century Plan Policy End number 6.0 which states, "A high level of cooperation and involvement exists among Georgetown's citizens and governmental organizations," and further finds that the adoption of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2: Section 2.36.020 of the Code of Ordinances pertaining to Qualifications of Board, Commission, and Committee members is hereby amended to add new Subsections B and C as follows: Sec. 2.36.020. Qualifications A. It is the past practice and the present intent of the City Council of the City that Section 9.01 of the City Charter (relating to Nepotism) shall not apply to appointments of persons to city boards, commissions, or committees that are advisory only and that exercise no final authority on behalf of the City. B. It is the intent of the City Council that as many persons as possible be invited to serve on the City's various boards, committees and commissions. To that end, no person shall serve as a member of more than one board, commission or committee if other qualified applicants are available to serve, unless the ordinance or Bylaws of one board, committee, or commission require the participation of a member from another board, committee, or commission. If a person who serves on a board, committee or commission is appointed to another board committee or commission before the end of his or her existing term, acceptance of the new appointment shall operate as an automatic resignation from the position previously held. Notwithstanding the foregoing, the provisions of this subsection shall not apply to persons appointed by the City Council to ad hoc or non -permanent advisory committees and such ad Ordinance No. . V1 Qualifications of Boards and Commission members Page I of 2 hoc committees may be comprised in whole or in part of persons who serve on the City's standing boards, committees, and commissions. C. City employees are not eligible to serve as board, commission or committee members, unless otherwise required by law or by the Bylaws. SECTION 3: All other provisions of the City Code that are not amended hereby shall remain in full force and effect. SECTION 4: This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. SECTION 5: If any provision of this ordinance or application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6: The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Georgetown.
