HomeMy WebLinkAboutORD 2005-71 - REZ Georgetown Village Sect 8An Ordinance of the City Council of the City of Georgetown, Texas, amending part of the zoning district map adopted on the 4th day of April 2002 in accordance with the Unified Development Code passed and adopted on the 11th day of March 2003, to change, 15.62 acres in the Joseph Fish Survey, Abstract No. 232, as recorded in Document No. 2003011802 of the Official Deed Records of Williamson County, Texas, from AG, Agriculture district to Planned Unit Development (PUD) district with a base zoning district of RS, Residential Single Family; repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. Whereas, an application has been made to the City Council for the purpose of changing the zoning district classification of the following described real property ("the property'): 15.62 acres in the Joseph Fish Survey, Abstract No. 232, as recorded in Document No. 2003011802 of the Official Deed Records of Williamson County, Texas, hereinafter referred to as "the property'; Whereas, the City Council has submitted the proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report; and Whereas, notice of such hearing was published in a newspaper of general circulation in the City; which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and Whereas, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the lots within two hundred feet of the property, as required by law; and Whereas, the applicant for such zoning change placed on the property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing; and Whereas, the City Planning and Zoning Commission in a meeting held on October 4, 2005 recommended to the City Council Approval of the requested zoning change for the above described property from AG, Agriculture district to Planned Unit Development (PUD) district with a base zoning district of RS, Residential Single Family. Now, Therefore, Be It Ordained By The City Council Of The City Of Georgetown, Texas, That. Section 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following objective of the Georgetown Century Plan, Future Land Use and Thoroughfare Plan: V - �7/ Georgetown Village, Sec. 8 Page t of 2 Objective 1.3: Ensure that new developments will be compatible with existing land uses in terms of use, density, building heights, scale and offsite effects. Objective 1.5: Require zoning change requests to be consistent with the Future Land Use Plan. The Future Land Use Plan designates this property "Residential". and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, Section 2, The Base Ordinance and the Zoning Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from AG, Agriculture district to Planned Unit Development (PUD) district with a base zoning district of RS, Residential Single Family, in accordance with attached Attachment A which is attached hereto and incorporated by reference herein, is hereby adopted by the City Council of the City of Georgetown, Texas, Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. Section 4. If any provision of this Ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. Section 5. The Mayor is hereby authorized to sign this Ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect on the date of final adoption by City Council Passed and Approved on First Reading on the 25th day of October 2005. PROPERTY This Development Plan covers approximately 15.62 acres of land located within the City Limits of Georgetown, Texas, described as 15.62 acres, to be known as Georgetown Village Planned Unit Development Section Eight. The legal description and field notes of the site are attached as Exhibit A. B. PURPOSE In accordance with Unified Development Code Section 4.04.030 (5) "Development Plan", the following is a summary of the design standards for the development of Section Eight of Georgetown Village. The standards are consistent with those outlined in the approved Concept Plan for Georgetown Village and incorporated into the Unified Development Code pursuant to Section 1.03.D.3. Co DEVELOPMENT PLAN 1. Miscellaneous a. A Public Review Final Plat for Section Eight has been submitted to the City of Georgetown on behalf Georgetown Village. A copy of this plat is attached hereto as Exhibit B and incorporated herein. b. The platted area is intended to be developed as a residential neighborhood designed as a detached single family lot development. C, All 65 single-family lots within Section Eight shall be developed consistent with the development standards contained herein. D. DEVELOPMENT STANDARDS 1. Maximum impervious cover is 50%. 2. Front building setbacks shall be (15) feet measured from the property line to the front edge of the front porch provided that: a. For front -accessed garages a functional front porch is built which is defined as at least (6) feet deep and (12) feet wide and the garage is V 4 005mo 7 Page 1 of 4 Georgetown Village Section Eight DT TT'1 Din" designed to be located (5) feet back from the front edge of the front porch such that the garage setback shall be (20) feet from the front property line. 3. The combined total of the building side setbacks for a lot with a width of less than 69 feet may be reduced from (15) feet to (11) feet, with the setback on each side reduced from (7) feet - (6) inches to (5) feet - (6) inches for lots that are 69 feet or less in width. 5. Non -alley accessed lots shall have a rear setback of (20) feet. 6. The City of Georgetown (MODIFIED) Typical Residential Street and Utility Assignment detail is as per the attached Exhibit C, dated May 1996, 7. Because of the proximity of Section Eight to Summers Green in Georgetown Village Section Three (within 1,000 lineal feet of), sidewalks are required on both sides of all streets in Section Eight. 8. Fences over (3) feet in height utilizing design #2, #3, or #5 on Exhibit D, may be erected at a distance of (7) feet - (6) inches within the secondary platted setback for lots if the following lot configuration is present: a. Adjacent to the Georgetown Village perimeters wall provided that the fences line up with the wall. OR b. The lots are back-to-back corner lots. OR C. The lots are back-to-back corner lots with an alley in between. OR d. The lots are back-to-back corner lots that are not yet developed but will be developed and will complete the back-to-back configuration as described in (b) and (c) herein. 9. Local streets designed as "Courts" (such as the existing Fairfield Court, Green Grove, Spring Court, Village Glen, and Hanover Court at Georgetown Village) may be built with a (50) foot right-of-way and a (251) foot Roadway Width provided that the following conditions are met: a. Parking is limited to one side of the street. b. Lots on this "Court" designed local street may not exceed (15) total. ,/), � I, Page 2 of 4 Georgetown Village Section Eight 10. Collector Streets may have a minimum centerline curve radius of 470 feet and must include a posted speed reduction to facilitate the necessary curve radius. 11. Local Streets may have a minimum centerline curve radius of 180 feet. 12. Parkland for Section Eight is satisfied by the park at Lot 26, Block E, a total of 2.3195 acres in Georgetown Village Section Seven Planned Unit Development previously dedicated to the City of Georgetown with the platting of Section Seven. 13. Detached garages, accessed from the street in front of the house, may be constructed (3) feet from the side property line provided that all of the following conditions are met: a. The portion of the garage that is (5) feet or less from the property line consists of a fire -rated exterior wall. b. The garage does not include window or door openings. c. The garage construction complies with all other applicable Building Code provisions. d. The garage is built a minimum of (10) feet from all other structures on adjacent lots.
