HomeMy WebLinkAboutORD 2005-44 - Levying Tax RateCERTIFICATE OF RECORD VOTE ON ORDINANCE LEVYING TAX RATE FOR TAX YEAR 2005 I, the undersigned Mayor of the City of Georgetown, Texas (the "Unit"), hereby certify as follows: 1. The City Council (the "Governing Body") of the Unit convened in regular session at Georgetown, Texas on September 13, 2005 (the "Meeting"), at the designated meeting place, and the roll was called of the duly constituted members of the Governing Body, to wit: Gary Nelon, Mayor Doug Smith, Mayor Pro Tern Patty Eason Gabe Sansing Henry Carr John Kirby Farley Snell Ben Oliver All of such persons were present, thus constituting a quorum. Whereupon a written: ORDINANCE LEVYING A TAX RATE FOR THE CITY OF GEORGETOWN FOR THE TAX YEAR 2005; PROVIDING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE (the "Ordinance") was duly heard on second and final reading, the caption of same read per the requirements of the City Charter, approval of the Ordinance was moved and seconded and, after due discussion, said motion, carrying with it the adoption of the Ordinance, prevailed and carried by the following votes: Gary Nelon, Mayor Doug Smith, Mayor Pro Tem Patty Eason Gabe Sansing Henry Carr John Kirby Farley Snell Ben Oliver for against X for against for X against X for against X for against X for against for X against X for against X not voting per City Charter Sec. 2.06 2. A true, full, and correct copy of the Ordinance is attached to and follows this Certificate; the actions of the City Council have been duly recorded in the minutes of the Meeting; the persons named in the above and foregoing paragraph are the duly elected, qualified, and acting members of the Governing Body; each of such members was duly and sufficiently notified officially and personally, in advance, of the time, place, and purpose of the Meeting, and that the Ordinance would be introduced and considered for adoption at the Meeting, and each of such members consented, in advance, to the holding of the Meeting for such purpose; and the Meeting was open to the public, and public notice of the time, place, and purpose of the Meeting was given, all as required by law. WHEREAS, the City of Georgetown, Texas is an incorporated Home Rule city dependent upon taxes to provide its citizens with services; and and WHEREAS, the City of Georgetown, Texas published the required notice on August 28; WHEREAS, the City Council lowered the 2005 property tax rate on the first reading of this ordinance; and WHEREAS, the revised 2005 property tax rate is lower than the published notice rate; and WHEREAS, all notification and publication requirements have still been satisfied; and WHEREAS, the City Council finds it necessary to levy taxes for the 2005/06 fiscal year for the City of Georgetown, Texas; and WHEREAS, THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS THAN LAST YEAR'S TAX RATE, and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policy of the Century Plan - Policy Plan Element: 1. Finance Policy Statement 13.0, which states: "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both current and future needs are provided", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, Levy Tax Rate 2003/04 Ordinance No. CZoos ` Page i of 2 P: L4GENDA120051budgetlBudget-Tar Levy.4RD.doc SECTION 2. The City Council of the City of Georgetown (the "City Council") hereby finds that all of the prerequisites to the levying of a tax rate for this City for the year 2005, (including, without limitation, certifications, notices, submittals, and public hearings) as required by law have been complied with. SECTION 3. The City Council does hereby levy and adopt the tax rate on $100 valuation for the tax year 2005 as follows: $.20713 for the purpose of maintenance and operation $.13913 for the principal and interest on debt of this city 34626 total tax rate SECTION 4. If any section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional. SECTION 5. This Ordinance shall become effective upon adoption of its second and final reading by the City Council of the City of Georgetown, Texas.
