WHEREAS, the City Charter grants the City Council the authority to establish boards and commissions to assist it in carrying out its duties; and WHEREAS, the City Council desires to establish the Georgetown Transportation Advisory Board to advise and assist the City Council in the performance of its duties; and WHEREAS, the City Council finds it to be in the best interest of the public to establish the Georgetown Transportation Advisory Board as set out herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following elements of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan: Polio Statement 1.0 The Community enjoys the benefits of well-planned land use in which conflicting needs are balanced. Policy Statement 9.0 Citizens and commercial goods move safely and v efficiently throughout all parts of the City. Title 2 of the Code of Ordinances of the City of Georgetown is hereby amended to add the following Chapter: Chapter 2.113. GEORGETOWN TRANSPORTATION ADVISORY BOARD 2.113.010 Created — Membership A. There is hereby created the Georgetown Transportation Advisory Board of the City of Georgetown, hereinafter referred to as the "Board." Be The will consist of seven (7) members, no more than two of which will be members of the City Council. One member shall be from the Georgetown Enhancement Corporation (GTEC), preferably the chairperson. One member shall be from the Georgetown Planning and Zoning Commission, preferably the chairperson. The remaining three (3) members shall be citizens -appointed under the provisions of the Charter and ordinances of the City. All members shall reside in the city limits or the extraterritorial jurisdiction of the City. 2.113*020 Terms of Office The term of office for members shall be two (2) years, with all members initially appointed for two full years. The second appointments shall be staggered, so that four (4) members shall be appointed for two-year terms, and the remaining three (3) members appointed for one (1) year terms. Thereafter, all terms shall be for two (2) years. 2.113.030 Purpose A. The purpose and goals of the Board shall be: (1) To assist in the development of a continuing, comprehensive, multi- modal transportation planning process carried on cooperatively with State and local transportation agencies in concurrence with State and Federal guidelines; (2) To advise the City Council on the status of the needs identified through the continuing multi -modal transportation planning process; (3) To facilitate coordination and communication between policy boards and agencies represented on the TAB; Ordinance No. Page 2 of 5 Creation of Georgetown Transportation Advisory Board (4) To assist the general public in understanding Transportation decisions and policies of the boards; and (5) To act as a conduit for cooperative decision making by transportation officials of this urbanized area in cooperation with Regional, State and County, and local transportation agencies, thereby serving as the basis for a cooperative transportation planning process. (6) To review items related to transportation improvements, transportation modeling, transportation development, transportation planning, and transportation infrastructure, including, but not limited to, streets, roads, sidewalks, highways, freeways, transit services, and rail. (7) Examines various potential funding mechanisms to conduct necessary transportation improvements and projects. (8) Makes recommendations and advises the City Council. B. The responsibilities of the Board shall include: (1) Establishment of short and long-term goals and objectives for the transportation planning process. (2) Review and recommend approval of transportation planning projects for the City. (3) Review and recommend changes to the Urbanized Area Boundary, the Transportation Planning Area Boundary, as well as review and recommendation for changes to the Overall Transportation Plan (OTP). (4) Review and recommend changes to the adopted CAMPO Metropolitan Planning Organization Comprehensive Transportation Plan. (5) Review and recommend approval of the City's Transportation Capital Improvement Program (TCIP) for multi -modal capital and operating expenditures to insure coordination between local, County, Regional and State capital and operating improvement programs. 2113.040 Rights & Duties The Board is responsible to and shall act as an advisory body to the Council and shall perform such duties and exercise such additional powers as may be prescribed by the ordinances of the City of Georgetown not inconsistent with the provisions of the Charter. The Board and its members have no authority to expend funds or make obligations on behalf of the City. Ordinance No.=W25;4(0 Page 3 of 5 Creation of Georgetown Transportation Advisory Board 2.113.050 Compensation All members of the Board shall serve without compensation, but may be reimbursed for all expenses reasonably incurred by them in the performance of their duties as members of such Board, when authorized in advance by the City Council. 2.113.060 Organization The City Council shall select a Chair of the Board, and the Board shall select from among its members a Vice Chair and Secretary. The Board shall adopt such rules and regulations, subject to Council approval, as it may deem proper for the governance of its proceedings. Such rules and regulations shall be consistent with the ordinances of the City. The Secretary shall keep a record of all transactions of the Board. The City Manager shall assign appropriate staff to provide the Board with all information and support assistance, and any resources as directed by Council necessary for the performance of its duties. 2.113.070 Bylaws and Open Meetings Act Compliance The Board shall adopt bylaws, subject to review and approval by City Council, in conformity with this Chapter and with any applicable federal and state laws. The Board shall comply with the provisions of the Texas Open Meetings Act. SECTION 3. This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal or affect any of such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. Ordinance No. � Page 4 of 5 Creation of Georgetown Transportation Advisory Board SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect in accordance with the provisions of the Charter of the City of Georgetown.
