HomeMy WebLinkAboutORD 2006-107 - REZ Georgetown Village PUDORDINANCE NO. a 107 An ordinance of the city council of the city of Georgetown, Texas, amending part of the zoning district map adopted on the 4th day of April 2002 in accordance with the Unified Development Code passed and adopted on the 11th day of March 2003, to change 145.566 acres out of the William Roberts survey, Abstract 524, and the Joseph Fish survey, Abstract 232, as recorded in document numbers 2005038969, 9553462, and Volume 1872, Page 708 of the official Deed Records of Williamson County, Texas, from AG, Agriculture District to a Planned Unit Development (PUD) with a base zoning district of RS, Residential Single - family; repealing conflicting ordinances and resolutions; including a severability clause; and establishing an effective date. WHEREAS, an application has been made to the City Council for the purpose of changing the zoning district classification of the following described real property ( "the property "): 145.566 acres out of the William Roberts survey, Abstract 524, and thejoseph Fish survey, Abstract 232, as recorded in document numbers 2005038969, 9553462, and Volume 1872, Page 708 of the official Deed Records of Williamson County, Texas, hereinafter referred to as "the property' WHEREAS, the City Council has submitted the proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report; and WHEREAS, notice of such hearing was published in a newspaper of general circulation in the City; which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and WHEREAS, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the lots within two hundred feet of the property, as required by law; and WHEREAS, the applicant for such zoning change placed on the property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing; and WHEREAS, the City Planning and Zoning Commission in a meeting held on August 2, 2006 recommended to the City Council Approval of the requested zoning change for the above described property from AG, Agriculture District to a Planned Unit Development (PUD) with a base zoning district of RS, Residential Single - family. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following objective of the Georgetown Century Plan, Future Land Use and Thoroughfare Plan: Goal 7: Provide for a variety of housing types throughout the City. Objective 1.3: Ensure that new developments will be compatible with existing land uses in terms of use, density, building heights, scale and offsite effects. Objective 1.5: Require zoning change requests to be consistent with the Future Land Use Plan. The Future Land Use Plan designates this property "Residential ". and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2. The Base Ordinance and the Zoning Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from AG, Agriculture District to a Planned Unit Development (PUD) with a base zoning district of RS, Residential Single - family, in accordance with the attached "Development Plan" which is attached hereto and incorporated by reference herein, is hereby adopted by the City Council of the City of Georgetown, Texas. SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this Ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this Ordinance and the City Secretary to attest. Carls City Attorney THE CITY OF GEORGETOWN: Mayor Georgetown Village, Section Seven Planned Unit Development Development Plan A. PROPERTY This Development Plan covers approximately 145.5779 acres of land to be located within the City Limits of Georgetown, Texas, to be known as Georgetown Village Planned Unit Development Section Nine. A location map is provided in Exhibit A. B. PURPOSE In accordance with Unified Development "Development Plan ", the following is a summary development of Section Seven of Georgetown consistent with those outlined in the approved Village and incorporated into the Unified Develop 1.03.D.3, Co DEVELOPMENT PLAN 10 Miscellaneous Code Section 4.04.030 (5) of the design standards for the Village. The standards are Concept Plan for Georgetown iment Code pursuant to Section a. A Public Review Final Plat for Section Nine has been submitted to the City of Georgetown on behalf Georgetown Village. A copy of this plat is attached hereto as Exhibit B and incorporated herein. b. The platted area is intended to be developed as a residential neighborhood designed as a detached single family lot development. C, All 351 single - family lots within Section Nine shall be developed consistent with the development standards contained herein. D. DEVELOPMENT STANDARDS 10 Maximum impervious cover is 50 %. 2. Front building setbacks shall be (15) property line to the front edge of the containing front porches. Front building setbacks shall be (20) feet measured from the front property line to the front edge of any portion of a building, for new homes not featuring front porches. 4. All non -patio home shall contain (3) side masonry. Front and side elevations must be constructed of brick and / or stone. 5. The combined total of the building side setback for a lot with a width of less than 69 feet may be reduced from (15) feet to (11) feet, with the setback of each side reduced from (7) feet - (6) inches to (5) feet - (6) inches for lots that are 69 feet or less in width. 6. On corner lots the Streetside Setbacks shall be (15) feet measured from the side property line. 7. Rear building setbacks shall be (20) feet measured from the rear property line. 6. The City of Georgetown Typical Residential Street and Utility Assignment detail is as per the attached Exhibit C, dated May 1996. 7. Sidewalks are required on both sides of all streets. 89 The maximum height of a residential fence located within a required side or rear setback shall be (6) feet, and (3) feet in a required front setback. a. Residential fences shall be stained, cedar picket. b. All fences and walls shall be subject to the sight triangle provisions of 33010 (G) of the Subdivision Regulations, 12. Local streets designed as "Courts" (such as the existing Fairfield Court, Green Grove, Spring Court, Village Glen, and Hanover Court at Georgetown Village) may be built with a (50) foot right -of -way and a (251) foot Roadway Width provided that the following conditions are met: a. Parking is limited to one side of the street. b. Lots on this "Court" designed local street may not exceed (15) total. Page 2 of 3 Georgetown Village Section Nine PUD Development Plan 13. Collector Streets may have a minimum centerline curve radius of 470 feet and must include a posted speed reduction to facilitate the necessary curve radius. 14. Local Streets may have a minimum centerline curve radius of 180 feet. 15. Parkland for Section Nine is being satisfied by the dedication of 1.25 acres out of Lot 1, Block "P" of Georgetown Village Section Nine, and 1.19 acres from Lot 26, Block D of Georgetown Village Section Seven Parkland Preserve, 16. Detached garages, accessed from the street in front of the house, may be constructed (3) feet from the side property line provided that all of the following conditions are met: a. The portion of the garage that is (5) feet or less from the property line consists of a fire -rated exterior wall. b. The garage does not include window or door openings. c. The garage construction complies with all other applicable Building Code provisions. d. The garage is built a minimum of (10) feet from all other structures on adjacent lots.
