HomeMy WebLinkAboutORD 2006-92 - Planning & Zoning FeesAn Ordinance of the City of Georgetown, Texas amending Section 15.04.045 "Development Process Fees" of the Code of Ordinances (The "Code ") to revise Planning and Zoning fees; repealing conflicting ordinances and resolutions, including a severability clause; and establishing an effective date. WHEREAS, as part of the 2006 -2007 Annual Budget process the Planning and Development Services Department has conducted a review of it's application processing fees; and WHEREAS, the purpose of this review was to determine if the current fees are consistent with the amount of staff time spent and if the fees were covering the cost of application processing; and WHEREAS, there are certain fees that warrant an adjustment to ensure recovery of staff time and material cost; and WHEREAS, the caption of this ordinance was printed in the Williamson County Sun in compliance with the City Charter of the City of Georgetown. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following element of the Century Plan Policy Plan and that the enactment of this ordinance is not inconsistent with nor in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan: Policy Statement 14.0: "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both current and future needs are provided. SECTION 2. Section 15.04.045 of the Code of Ordinances entitled "Development Processing Fees" is hereby amended as shown on Exhibit "A" attached hereto and incorporated herein. 2006 -200? Planning ! This ordinance shall be and is hereby declared to be cumulative of all other ordinances of the City of Georgetown, and this ordinance shall not operate to repeal or affect any such other ordinances, except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this ordinance, in which event such conflicting provisions, if any in such other ordinance or ordinances are hereby superseded. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This Ordinance shall become effective and be in full force and effect on the date of final adoption by the City Council. PASSED AND APPROVED on First Reading on the 12th day of September 2006.
