An Ordinance of the City Council of the City of Georgetown, Texas, amending part of the
Zoning District Map adopted on the 41h Day of April 2002 in Accordance with the Unified
Development Code Passed and Adopted on the 111h Day of March 2003, to Change 6.07 Acres in
the John Berry Survey, as Recorded in Volume 758, Page 740 of the Official Deed Records of
Williamson County, Texas from RS, Residential Single-Family District to MF, Multi- Family
Residential District Classification; Repealing Conflicting Ordinances and Resolutions; Including
a Severability Clause, and Establishing an Effective Date.
Whereas, an application has been made to the City Council for the Purpose Of Changing the
Zoning District Classification of the Following Described Real Property ( "The Property "):
6.07 Acres in the John Berry Survey, as Recorded in Volume 758, Page 740 of the
Official Deed Records of Williamson County, Texas hereinafter referred to as "The
Property'
Whereas, the City Council has submitted the proposed change in the Base Ordinance to the
Planning and Zoning Commission for its consideration in a public hearing and for its
recommendation or report; and
Whereas, notice of such hearing was published in a newspaper of general circulation in the
City; which stated the time and place of hearing, which time was not earlier than fifteen (15) days
for the first day of such publication; and
Whereas, written notice was given not less than fifteen (15) days before the date set for the
meeting before the Planning and Zoning Commission to all the owners of the lots within two
hundred feet of the property, as required by law; and
Whereas, the applicant for such zoning change placed on the property such sign(s) as
required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen
(15) days before the date set for such hearing; and
Whereas, the City Planning and Zoning Commission in a meeting held on January 3, 2006
recommended changing said zoning district classification of the above described property from RS,
Residential Single- family district classification to MF, Multi- family residential district classification,
in accordance with attached Exhibit A.
Now, Therefore, Be It Ordained By The City Council Of The City Of Georgetown, Texas,
That:
Section 1. The facts and recitations contained in the preamble of this ordinance are hereby
found and declared to be true and correct, and are incorporated by reference herein and expressly
made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance
implements the following objective of the Georgetown Century Plan, Future Land Use and
Thoroughfare Plan:
■ Objective 1.5: Require zoning change requests to be consistent with the Future Land Use
Plan.
The proposed MF, Multi- family Residential district classification is consistent with
the "Residential" land use designation.
■ Objective 6.3: Promote the availability of a variety of housing types within the City that
will meet the needs of all segments of the Georgetown population including age, family
status, income and household size.
and further finds that the enactment of this ordinance is not inconsistent or in conflict with any
other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy
Plan.
Section 2. The Base Ordinance and the Zoning Map of the City, as well as the Zoning
District for the Property shall be and the same is hereby changed from RS, Residential Single - Family
district classification to MF, Multi- family Residential zoning district in accordance with attached
Exhibit A which is attached hereto and incorporated by reference herein, is hereby adopted by the
City Council of the City of Georgetown, Texas.
Section 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict
with this Ordinance are hereby repealed, and are no longer of any force and effect.
Section 4. If any provision of this Ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this Ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this Ordinance are hereby declared to beseverable.
Section 5. The Mayor is hereby authorized to sign this Ordinance and the City Secretary to
attest. This Ordinance shall become effective and be in full force and effect on the date of final
adoption by City Council.
PASSED AND APPROVED on First Reading on the 24th day of January 2006.

All that certain tract of land situated in Williamson County, Texas, out of the John Berry Survey,
Abstract No. 51 and being a portion of that tract described as 36.575 acres in a Warranty Deed
granted to LOM Services, Inc., dated May 23, 2001, and recorded as Document No. 2001044944,
Official Records of Williamson County, Texas, and further described by metes and bounds:
BEGINNING at a 3/4" iron rod set in concrete and in the East line of County Road 152 as
dedicated hereon and the South line of that tract described as 1.96 acres in a Warranty Deed
granted to Margaret Elizabeth Noyes, dated July 30, 1996, and recorded as Document No.
9639777, of said official records for northwest corner of this tract, the described Northwest corner
of said LOM Services tract bears approximately S 68 919'59" W 8.85 feet, the Southwest corner of
said John Berry Survey bears approximately S 190 E 7630 feet based on Williamson County tax
records;
THENCE: N 68 °19'59" E 417.66 feet along the South line of said Noyes tract and the North line
of said LOM Services, Inc. tract to a 3/4" iron rod set in concrete and in the West line of that tract
described as 41.96 acres in a Deed granted to Hayden B. Lay, et ux, dated June 14, 1988, and
recorded in Volume 1673, Page 423, of said official records for the Southeast corner of said
Noyes tract and the Northeast corner of said Lom Services, Inc. tract and this tract;
THENCE: along West line of said Lay tract and the most Northerly East line of said LOM Services,
Inc. tract in the following two (2) courses,
1. S 20 °01'51" E 406.92 feet to a 1/2" iron pin with a yellow plastic cap inscribed "CCC 4835" set,
2. S 20 °10'11" E 197.25 feet to a 3/4" iron rod set in concrete for the Southwest corner of said
Lay tract, an angle point of said LOM Services, Inc. tract and the Southeast corner of this tract;
THENCE: across said LOM Services, Inc. tract with the South line of this tract in the following two
(2) courses,
1. S 58 004'45" W 192.35 feet to a 1/2" iron pin found,
2. S 68 °19'33" W 237.89 feet to a 3" brass disc set in concrete and in the East line of said County

approximately S 68°12'51" W 339.98 feet;
THENCE: N 18 °45'50" W 249.89 feet with said East line of County Road 152 to a 1/2" iron pin
with a yellow plastic cap inscribed "CCC 4835" set for the Northwest corner of this tract;
