HomeMy WebLinkAboutORD 2006-45 - Establishing Residental ParkingORDINANCE NO, Gob J.5 AN ORDINANCE AMENDING CHAPTER 10.16 OF THE CODE OF ORDINANCES REGARDING PARKING TO ESTABLISH A "RESIDENTIAL PARKING ZONE" ON PORTIONS OF E, 7" STREET, E. 8" STREET, OLIVE STREET, AND SNUTH CREEK ROAD; DIRECTING THE CITY MANAGER TO ERECT APPROPRIATE SIGNS INDICATING SUCH ZONES; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; PROVIDING A SEVERABH.ITY CLAUSE; PROVIDING FOR PUBLICATION AND SETTING AN EFFECTIVE DATE, WHEREAS, on April 15, 2006 the Citv Council of the City of Georgetown approved an ordinance rezoning Lots 8 and 9 of the Anderson Addinon from Residential Single-family to Planned Unit Development (PUD),to be included in the Southwestern University PUD, and WHEREAS, at the public hearing on the rezoning application the neighbors surroandmg the rezoned properly expressed their desire to limit on -street parking in the neighborhood to residents only, and WHEREAS, the City Coanofl directed City staff to implement a residential parking zone in the neighborhood; and WHEREAS, the City Council finds that it is necessary and proper and in the best interest of the citizens of Georgetown to adopt the changes horomaftcr set forth, NOW. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OFGEORGETOWN, TEK4S. that SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated] by reference herein and expressly made a part hereof, as if copied verbatim, The City Council hereby finds that this ordinance implements Transportation Policy 12.0 of the Century Plan - Policy Plan Element, which slates: "Gcorgetown's transportation system provides for the safe and efficient racy of traffic, promotes the economic interests of the community, and adequately serves the needs of individuals'; and finturtber finds that the enactment of this ordinance is not inconsistent or in conflict wdlh any other Century Plan Policies, as required by Section 2,03 of>hc Administrative Chapter of the Policy Plan. Ordinance No. AD Resikial Partang Zone Page l of 6 SECTION 2: That Section 10.16 of Code of Ordinances: City of Georgetown, Texas, is hereby amended to add Section 10.1608' as follows: 10.16.081 E. 7 "AND 8"' STREET NEIGHBORHOOD PARKING ZONE A Definitions. The following terms, as used in this Section, have the following definitions. (1) "Chief of Police" shall mean the Chief of Police of the City of Georgetown, Texas or his designee. (2) "E 7i' and 8' Street Residential Parking Zone" shall meat the area comprised of the following public streets and all residential lots abutting or immediately adiacent to said streets: A, 1000and 1100block ofEastSeven 6Strect B. 1100 block of float P,ight Street, C 100 block of Olive Street; and D700block ofSouth Crack Road. (3)"Matorvehicle" shall man evervvchiclewhich isself-propelled. B Offenses (1) No person shall park any motor vehicle on any public street in the E,1' and 81h Street Residential Parking Zone without displaying a valid residential parking Zone permit or a valid temporary visitor's pemut (2) An individual commits an offense if he displays a permit issued pursuant to this Section on a motor vehicle other than the motor vehicle for which the permit was issued. (3) A person commits an offense if he falsely represents himself as being eligible for a residential parking zone permit or temporary visitor permit, submits false documents, or otherwise makes a false statement of material fact on an application fora permit, C. Penalties: (1) Any vehicle parked in the E. 7ih and 8'4 Street Residential Parking Zone, without displaying a valid permit issued order this Section, may be issued a citation or be subjcot to immediate towing and impoundment OrdinanceNo. qSb Reaidential Parking Zone Page 2 of 6 (2) A person who commits mty other violation against the provisions of tis Section is subject to the penalties provided for in the Code of Ordinances City of Georgetown, Tens. D. Ezce lions. The (errs of this Section shall not apply in the following instances: (1) Motor vehicles that are parked in a drivcwav, parking lot, or other authorized and appropriate area designed for parking motor vehicles (2) Motor vehicles that are stopped temporarily while the operator or a passenger is making deliveries to a location within the E.1e and Strcet Residential Parking Zone; (2) Motor vehicles that are used in transporting individuals, equipment, and goods neaassary for making improvements and repairs, providing labor, and performing other services at a residence, church or other location within the E,1li and 8a Siseel Residential Parking Zone; (4) Motor vehicles that are stopped temporarily lot loading or unloading passengers or goods; or i) Motor vehicles that are stopped temporarily for necessary emergency repairs, F. Residential ParkineZone Permits. (1) All residents of a the E.1a and Bs Street Residential Parking Zone who register with the Chief of Police, or his designee, shall be issued, free of charge, one (1) permit for each motor vehicle owned and kept by the resident at the premises located within the E,1n and 0 Street Residential Parking Zane The Residential Parking permits must be hung from the rear view mirror of the motor vehicle or otherwise displayed on the dashboard of the vehicle (2) Each permit issued to a resident will be assigned to a specific vehicle, and will only be valid for the particular vehicle to which it is assigned. No permit may be transferred to any other individual or used for a different vehicle other Ian the one to which the permit is assigned. 3) All residents applying for a permit or permits must use the application developed by the Chief of Police. (4) The Chief shall, upon receiving a completed application, issue a Residential Parking Zone permit to any individual that is eligible for the permit. An individual is eligible te obtain a permit if Ordinance S 0 1006,45 Residential Parking Zone Page 3 of 6 (i) foe individual owns a motor vehicle; (ii) resides nithin the E.1n and 8i' Strict Residential Parking Zone; and (iii) does not five in on -campus, student housing at Southwestern University. (S) The individual's application for a permit must contain the following information the name, address, and Texas Driver's license number of the owner of the motor vehicle to be parked in the E7" and 8' Street Residential Parking Zone; and (ii) the make, model, registration. and license plate number of the motor vehicle to be parked in the E. 7u and 8ih Street Residential Parking Zone. (6) The applicant for a permit must submit the following information at the time application is made for a E.1n and 8' Street Residential Parking Zone permit (i) a valid Texas motor vehicle reg oration for the motor vehicle which is the subject of the permit application; and (i) a valid Texas divers license of the applicant showing the applicant's current home address, or a residential utility bill acceptable to the Chief of Police showdpg the applicants home address. F. Temporary Visitor Parldn¢Zone Permits. (I) Two Tcmpomrq Visitor permits will automatically be issued time of charge; for each residential lot situated within the E. 76 and 8'" Street Residential Parking Zone. These permits will be valid on any date during the year (b) Additional Temporary Visitor permits shall be issued, free of charge, for persons visiting in the area, at the written request of any person living within the E. 10 and 8'4 Street Residential Parking Zone, These Temporary Visitor permits shall be valid only on the date(s) noted on the permit. (7) Miscellaneous. OrdNanco No. d6D o ResidentialParkmallo Page 4 of 6 (t) When a motor vehicle is parked in a E. 74 and 8" Street Residential Parking Zone, (hc permit must be conspicuously displayed by hanging it on the rear view mirror of the motor vehicle, or otherwise displaying it on the dashboard of the vehicle. (2) A permit issued pursuant to this Section, and properly displayed, mdmrizcs the permiteds motor vehicle to be parked in the E1n and 8a Sheet Residential Parking Zone when otherwise prohibited by this Section. A permit does not authorize the permihee's motor vehicle to be parked in a manner or location that is prohibited or otherwise governed by regulations, ordinances, statutes, or laws other than provided for in this Section. (3) A permit is not transferable from one motor vehicle to another. (4) A lost or stolen permit may be replaced. The pernuttee must submit a signed affidavit stating that the permit was lost or stolen and not transferred to another vehicle, nor given or conveyed to another individual. SECTION 3! All ordinances, parts of ordinances, or resolutions in conflict herewith are expressly repealed, SECTION 4: The invalidity of any section or provision of this ordinance shad not invalidate other sections or provisions thereof.
