HomeMy WebLinkAboutORD 2012-62 - Goods in TransitWHEREAS, the 82nd Texas Legislature in Special Session, enacted Senate Bill 1, to
take effect on. September 1, 2011, which requires a taxing to take action, in the required
manner, after October 1, 2011, to provide for the taxation of goods in transit; and
WHEREAS, Tex. Tax Code Section 11,253 as amended allows the governing body of a
taxing unit, after conducting a public hearing, to provide for the taxation of such goods -in -transit;
and
WHEREAS, the City Council of the City of Georgetown having conducted a public
hearing as required by Section 1-n (d), Article VIII, Texas Constitution, is of the opinion that it is
in the best interests of the City to tax such goods in transit;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this ordinance are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this
ordinance complies with the Vision Statement of the City of Georgetown 2030 Comprehensive
Plan.
SECTION 2. City of Georgetown Code of Ordinances is amended as follows:
"Chapter 4.16 Property Taxes
Section 4.16,070 — Goods in Transit
Tangible
personal
property, also
known as goods -in -transit, as defined in V.T.C.A., Tax
Code
Section
11.253
shall
be subject
to
taxation."
SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.
SECTION 4. If any provision of this Ordinance or application thereof to any person or

circumstance shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this Ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this Ordinance are hereby declared to be
severable.
SECTION 5. The Mayor is hereby authorized to sign this Ordinance and the City
Secretary to attest. This Ordinance shall become effective upon adoption of its second and final
reading by the City Council of the City of Georgetown, Texas.
