Council Present: Patty Eason, Gabe Sansing, Doug Smith, Henry Carr, John Kirby and Farley Snell Council Absent: Mayor Gary Nelon, Ben Oliver Regular Session — Called to order by Mayor Pro Tem Doug Smith at 5:00 p.m. and recessed to Executive Session. Executive Session A Sec.551.071 consultation with attorney: Del Webb Water/Wastewater Agreement 5:22 p.m: — adjourned Executive Session and Returned to Open Session Regular Session B Discussion and possible action regarding acceptance of Water/Wastewater fees per the Dei Webb Water/Wastewater Agreement — Paul Brandenburg, City Manager and Patricia E. Carls, City Attorney Motion by Sansing, second by Kirby that the City Council agree to accept the $80,602.00 payment for 2004 from Del Webb for the "Remaining Water/Wastewater Supply" option pertaining to "potable water," "non -potable water" and "wastewater" under paragraph 1.C., and the "Additional Supply" option pertaining to "potable water" and "non -potable water" under paragraphs 2.A. and 2.8. of the Water and Wastewater Utility Agreement dated June 1, 2003, on the conditions that: (1) the remaining balance due to the City resulting from increases in the BRA water rate for 2004 be paid by Del Webb to the City no later than October 29, 2004; and (2) the acceptance of the 2004 payments by the City shall not constitute a waiver by the City of its rights under the Water and Wastewater Agreement, the Seventh Amendment, or the Development Agreement, nor shall it be deemed or construed to be a waiver of any other terms or conditions of the Water and Wastewater Agreement, the Seventh Amendment, or the Development Agreement or a subsequent waiver of the same terms or conditions in the Water and Wastewater Agreement, the Seventh Amendment, or the Development Agreement.
