A Discussion regarding the City of Georgetown's Annexation Policy, including an overview of Annexation
issues, a review of the Annexation Priority Map, the Annexation Matrix, the Annexation Cost Benefit
Analysis/Economic Model, and a discussion on a Council Annexation Statement and Policy -- Paul
Brandenburg, City Manager
Brandenburg opened with a brief history regarding the current annexation policy. He expressed the need to
get better control over what is driving development and ensure that the annexation policy guides
development. He spoke about Extra Territorial Jurisdiction agreements with Round Rock and Leander. He
also spoke about the MUDS being formed at the same time that the City is preparing to grow it's own utility
system. He said it is imperative that Georgetown conrol its own destiny to protect greenspace, and take
advantage of water and wastewater infrastructure already extended.
He introduced speaker, Susan Rocha. Rocha told Council she is an attorney in San Antonio who
represents municipalities. She said unilateral annexation requires a 3 -year annexation plan. She spoke
about negotiations with the landowners for service plan provision. She said if agreement is not reached,
the Legislature now prescribes arbitration instead of going directly to court. She noted that the delivery of
services within 2 1/2 years of the date of annexation, including police, fire, wastewater, street maintenance,
utilities, parks, and swimming pools must be at least equivalent to what the area had been receiving prior to
annexation. She mentioned that sometimes topography provides an occasional exception.
Nelon spoke about surrounding cities having been able to "bank" 10% of their incorporated area, up to 30%
and noted that some cities are saying that no service will be provided at inception of the annexation, but
service will be negotiated once the development begins. Rocha suggested that there might be a 3rd party
service provider involved in the negotiations. There were further comments and clarifications from the
Council.
Brandenburg demonstrated a map colored to show the areas where it would be advantageous to annex.
There were questions and comments from the Council. Carls clarified current preferences regarding MUD's
and developer negotiations. Council discussed options in various fictitious scenarios.
Brandenburg

staff needs direction from Council at the Council Meeting on Tuesday,
regarding
areas
of
interest
for
annexation.

Rundell explained the Annexation Cost Benefit Analysis/Economic Model and Impact Summary provided in
the packet.
Kirby expressed concern with the annexation policy process.
B Presentation regarding Conservation Subdivisions and Direction to staff -- Bobby Ray, Interim Director of
Planning & Development Services
Ray distributed a handout and demonstrated, with a slide presentation, a review of the concepts and
standards of conservation design from a previous workshop with Randall Arendt. He listed four steps in
conservation design, which are: identification fo conservation areas; location of housing sites; alignment of
streets and trails; and location of lot lines. He asked Council for direction and offered two implementation
options: (1) required implementation and (2) voluntary implementation.
There were questions and comments from the Council. It was determined by the Council that they would
prefer to have an action item posted for a future meeting in order to receive further information and
deliberate over the response.
