approve. Motion by Sansing, second by Kirby to amend to change the annexation of the 95 acres known
as the Liese Property to a 1001 -foot strip along Williams Drive, with the caviat that if the property is to be
developed in the future, the Lieses or their heirs would voluntarily ask for annexation. Oliver questioned
the ability to continue to annex along Booty's Crossing Road. Polasek noted that there would still be
access. Oliver inquired as to the enforceability of the caviat, and Carls said it would be spelled out in the
ordinance and there will be an agreement made with the Lieses some time in January. She said it would
be necessary to have the surveyor redo the field notes for this ordinance prior to the effective date which
is December 30, 2005. She said, if that is possible, the annexation will be valid for this year. Vote on
amendment: 3-3 (Eason, Smith and Carr opposed) (Snell absent) Mayor Nelon broke the tie in favor of
approval of the amendment. Vote on the motion as amended: Ordinance 2005-95 approved 6-0. (Snell
absent)
6. Second Reading of an ordinance annexing into the City an approximately 0.49 acre portion of
Booty's Crossing Road R.O.W. that begins at the current city limits near Kathi Lane and extends
northwest approximately 250 feet, referred to as Annexation Area 13d -- Bobby Ray, AICP, Acting

annexation involves the Hughes Tract. He said Mrs. Hughes called him and said she would not attend
the Council Meeting because she felt there was nothing more she could do to oppose the annexation.
He said he is very much in favor of annexation, but he thinks it is a shame that tracts like this that have

Deen in Tamnies Tor generations are so close to the City that they have to be included. He acknowledgei
that he voted against this annexation at the first reading as a "protest vote, " but would vote in favor on
