Technician Tom Bolt, Building Plan Reviewer Angela Gray, City Manager Intern Policy Development/Review Workshop - Called to order at 5:30 p.m. A Report from Conference -- Shelley Davis Davis shared his learning experiences from having attended the National Black Caucus of Local Elected Officials Regional conference held recently in Fort Worth. Wood noted that the Palace Theatre had received a grant from LCRA. Wood also noted that Rep. Lamar Smith was in Georgetown last Saturday for a town meeting. B Discussion of annexation policy and procedures -- Murray Blackman and Bob Hart Hart told Council that during this discussion they would review policy and priorities that had been previously set by Council and asked for their input on desired revisions. City Council Agenda/Ju15T 22, 1997 Page n of 4 Pages Council generally agreed that the City should attempt to inform residents of the potential annexation area about the proposed annexation. Barton asked Hart to establish a timeframe that would allow the residents in Berry Creek I to pay at the same rate to connect to the existing sewer line as the residents of Serenada East. It was noted that the subdivisions of Raintree and Pleasant Valley have been classified as Priority I Annexations. Staff asked Council to give direction as to the guidelines for the remaining annexations and asked them to review the current issues to be considered, such as notification of property owners, and public safety response. Staff told Council they would bring back an annexation policy for consideration on the next agenda. C Answer questions on Statutory Consent Agenda Items listed specifically below under the Regular Session that will begin no sooner than 7:00 p.m. (For questions only, no action to be taken until Regular Session) Tonn informed that he would abstain on Item T. and Valdez noted that he would abstain on Item F. H Mayor, Council, City Manager, and staff comments and reports Wood spoke of having attended Lamar Smith's Town Meeting regarding the position of the M®KAN Highway. He said he spoke to Henry Pearson of Carter Burgess about asking TXDoT to move the location further east. I Citizens wishing to address the Council Janet Briery, 50110 Thunderbird, said she appreciates the assistance in moving the proposed MOKAN highway further east. She noted to Council that County Road 102 is adjacent to the Indian Creek Subdivision, saying that one of their neighborhood streets City Council Agenda/Juts. 22, 1997 Page 2 of 4 Pages has become an access road to County Road 102, and the proposed position of MOKAN will make the traffic even worse. She asked that the City use their influence to get the proposed highway moved further away from Indian Creek Subdivision. Paula Thomas, 50700 Indian Creek Drive, showed a map of the subdivision and the proposed location of the MOKAN highway. Wood noted that Carter -Burgess said that County Road 102 would not be an access road to Highway 29. He thanked Thomas for bringing this to the attention of the community. Sylvester Guzman, 50107 Paleface Drive, thanked the Council and Mayor for their support on the positioning of the MOKAN Highway, and emphasized the issue of safety. Dennis Hill, 204 County Road 102, said his front door is within a few hundred feet of the access road on the map of the proposed highway. He said he is concerned about the proposed elevated interchange at Highway 29. He provided a petition of over 100 signatures to show that the neighborhood is united in their opposition to the proposed location of MOKAN. Wood suggested he take the petition to TXDoT also. Teri May, 216 County Road 102, said he lives twenty feet from the proposed frontage road. She noted that her house is for sale and there had been a serious offer, but as soon as they disclosed that MOKAN would be located nearby, the potential buyer went away. She asked Council to use their influence to keep MOKAN at a significant distance from Indian Creek. Madelen Powell, 50304 Eagle Trace Drive said she felt she was misquoted in the article in the Williamson Counoj Sulo. She asked Council to protect the value of the homes in Indian Creek, by using their influence to move the highway further east. Sharon Thomason, 21.0 County Road 102, said she was shocked that the County Road would become a 60 mph, three -lane frontage road to the proposed 12 -lane MOKAN, and asked Council to do whatever they could to change the location Bebe Johnson, Route 3, Box 5, thanked Wood for his communication regarding MOKAN. She noted that the Indian Creek Subdivision is asking to be closed off from both MOKAN and SH29. She said although they love living there, if they ever did have to sell the house, it would be devalued by 30% to 50%. William P. Mulock told Council that he is concerned about Item AA on the Council Agenda, saying that if HEB goes there, HEB should be responsible for paying for any improvements that are made to the area. He asked Council if they knew what was proposed for the 203 acres. Barton told him that there would be an HEB store, and that the development going there would be voluntarily annexed. City Council Agenda/July 22, 1997 Page 3 of 4 Pages Della Green, 1901 Vine, noted that Highway 29 is already congested. She asked that a public hearing be held in Georgetown for MOKAN. Wood noted that the first public hearing on MOKAN was held two years ago at the Williams Middle School in Georgetown. Frank Parmenter, 41.06 Sequoia Trail East, spoke to Council on Item EE regarding the parking study, saying that there is no cost mentioned in the item. He claimed that there is no parking problem downtown. Approved 7-0. (Tonn abstained from Item T. and Valdez abstained from Item F.). Legislative Regular Agenda BB First Leading of an ordinance to rezone 11.5 acres in the John Berry Survey, from A, Agricultural, to C -2A -Residential, Commercial First Height or any more restrictive classification, located on the North IH -35 Frontage Road and County Road 190 -- Wendy Walsh and Ed Barry Walsh noted that the property is located on two major entryways to Georgetown and suggested the Council may want to exclude storage units. Barton suggested that mobile home sales be excluded also. Hart explained that the applicant is a mobile home sales complex. Hart suggested Council might want to have consultation with their attorney before voting on this item. 7:55 p.m. recessed to Executive Session 8:20 p.m. resumed Open Session Walsh read the caption only of the ordinance on first reading after having satisfied the Charter requirements. Barton said he was concerned about the rezoning to allow mobile home sales. He said that when the Berry Creek Annexation Hearing was held, the Council told the Berry Creek residents that the annexation would protect the land use for the areas around Berry Creek. He said the intersection of Highways 195 and 190 and the proposed route of MOKAN would make the area a gateway to Georgetown, and from an aesthetic viewpoint it would be much more pleasant to see a motel, restaurant, or shopping center, instead of a mobile home park. Motion by Barton, second by Burson, to defer this item until the August 12 Council Meeting. Approved 6-0. Bain abstained. CC First Reading of an ordinance providing for the annexation into the City of approximately 203 acres in the Joseph Fish and David Wright Surveys owned by Campbell -Georgetown No. 1 and located along Shell Road and RM2338 -- Clyde von Rosenberg and Ed Barry von Rosenberg read the caption only on first reading after having satisfied the Charter requirements. Tonn confirmed that this would be a voluntary annexation. Motion by Tonn, second by Barton to approve the ordinance on first reading. Approved 7-0. City Council Agenda/July 22, 1997 Page 6 of 4 Pages DD Consideration of a Short Form Final Plat of a Resubdivision of Chaparro Estates, Lot 8 and a 026 acre tract in the George Thompson and R. T. Jenkins Surveys, to be known as Warnock Estates, located on Sedro Trail, with Variances to the Subdivision Regulations - - Hildy Kingma and Ed Barry This item was deferred at the request of the applicant. EE Consideration of authorizing staff to negotiate an. Agreement with John F. Hickman and Associates to conduct a parking management study for the downtown area -- Murray Blackman and Bob Hart Blackman noted that Council at the Workshop had given staff authority to send out a Request for Quotations. Hoyt noted that the workshop had been well attended by the merchants, local organizations, and county employees, and it was their recommendation that a consultant be hired to do the study. Blackman said a meeting was held last Monday night with interested parties and the proposed consultant, John Hickman. Barton asked Hart if there were skilled staff at the City who could perform such a study. Hart said there were, but any recommendation made by the City would not be as readily acknowledged, and college students/interns would not have sufficient experience to pull together such a study. When asked about the proposed cost, Hart said he felt it could be done for $25,000, and that the item was being brought to Council to ask for authority to negotiate an agreement at which time the fee would be decided. Wood reiterated that the City told the citizens at the workshop that a consultant would be hired, and he felt the Council is obligated to proceed with that plan. Hart explained that meetings with the interested parties would be a part of the study, as well as other aspects, such as signage, lighting, possibility of nearby property being used for parking lots/garage, and the possibility of negative impact on nearby residences. Motion by Hoyt, second by Davis to authorize staff to negotiate an agreement with the consultant to do the study. Approved 6-1. Barton opposed. FF First Reading of an ordinance amending Ordinance 97-11 establishing standards for wireless communications facilities within Georgetown -- Murray Blackman and Bob Hart Blackman read the ordinance. Hoyt asked to amend Section 6, A.2 to prohibit lattice towers with flat signal devices. Motion by Hoyt, second by Davis to approve the ordinance on first reading with the above-mentioned amendment. Bain asked if that would be too restrictive. Hart said it could be corrected in the second reading. He asked about the previous changes at the other first reading.
