G Citizens wishing to address the Council Ed Steiner addressed the Council regarding the name change of Chitaukua Park to Edna Powell Park. This issue will be discussed after the special election for District 2 Councilmember. H Mayor, Council, City Manager, and staff comments and reports Mayor Wood expressed sympathy and requested prayers for the family of Judge Timothy Maresh who was killed in an auto accident this afternoon. Mayor Wood presented City pins to Boy Scout members. Regular Agenda O Second reading of an ordinance amending Ordinance No. 93-42 to extend the time period for payment of assessments on East I-35 Frontage Road/1\4arianne Banks City Council Minutes/December 12, 1995 Page 2 of 7 Pages Banks read the caption. Motion by Tonn, seconded by Hoyt to approve Ordinance 95-59 on second reading. Approved 6-0. P Concept Plan of an 11.85 acre tract in the Lewis Dyches Survey, to be known as Pleasant Valley Estates/Ed Barry and Hildy Kingma Kingma presented the concept plan. Motion by Bain, second by Curl to approve concept plan. Approved 6-0. Q Second reading of an ordinance amending Exhibit 1 of the Century Plan - Development Plan for 11.85 acres in the Lewis Dyches Survey to be known as Pleasant Valley Estates as recorded in Volume 613, Page 419 of the Official Deed Records of Williamson County, Texas from Intensity Level Two to Intensity Level Three/Ed Barry and Clyde von Rosenberg von Rosenberg read the caption. Motion by Vincent, second Torn to approve Ordinance 95-60 on second reading. Approved 6-0, R Preliminary Plat of a 1.44 acre tract in the David Wright Survey, to be known as the Physician's Center Tract; and approval of variances to the Subdivision Regulations/Ed Barry and Hildy Kingma Kingma presented the preliminary plat. After a lengthy discussion between Councilmembers, Don Bizzell, Project Architect Patrick Rhoder, Dr. Richard Male, and Dr. Murray Snook the following motions were made. Motion by Arroyos, second by Bain to approve applicants preliminary plat with single entry driveway. Denied 4-2. Hoyt and Curl opposed. Motion by Arroyos, second by Bain that preliminary plat be approved subject to driveway access issue being resolved at DDP approval. Approved 6-0. S License to encroach in the platted public utility easement located along Hacienda Lane of Lot 2, Block B, Berry Creek Subdivision, Section Four, located at 30107 Briarcrest Drive/Ed Barry and Hildy Kingma Kingma explained the resolution. The applicant, Clifford Friesen, addressed the Council and showed an exhibit of his property and views of his lot at different angles. Motion by Vincent, second by Torn to approve license to encroach. Approved 6-0. T Variances to the platted PUE and building setback requirements of Berry Creek Subdivision, Section Four, Block B, Lot 22, located at 30107 Briarcrest Drive/Ed Barry and Hildy Kingma Motion by Bain, second by Curl to uphold Planning & Zoning Commission's recommendation to approve the requested variances to Sections 34020 E. and 34030 thereby allowing a five foot fence to encroach into the public utility easement, and to Section 34020 G.1. of the Subdivision City Council Minutes/December 12, 1995 Page 3 of 7 Pages Regulations, thereby allowing the fence to encroach into the 15 foot front yard setback line after making the required findings of fact. Denial of the variances to Section 34020 G.1. to allow a swimming pool, pool equipment pad and deck to encroach into the 15 foot front yard setback line. Approved 6-0. U Variance to the building setback requirements for Berry Creek Subdivision, Section Nine, Phase Three, Block A, Lot 31, located at 30407 La Quinta Drive/Ed Barry and Hildy Kingma Motion by Curl, second by Bain to uphold Planning & Zoning Commission's recommendation to approve the requested variance to reduce the rear building line from 25 feet to five feet and to reduce the eastern side building line from 35 feet to a minimum of ten feet, or anything greater if it is required by Community Owned Utilities, provided the applicant submits construction plans that show an abandonment of the existing storm water pipe, its relocation to the eastern lot line, and a five foot easement beyond the outside edge of the pipe. Approved 6-0. V Approval of a letter requesting the Texas Department of Transportation (TxDOT) to include the relocation of entrance and exit ramps to IH35 south as a component of the third IH35 main lane project through Georgetown/Ed Barry and Clyde von Rosenberg Motion by Bain, second Tonn to approve letter to Texas Department of Transportation. Approved 6-0. W Approval of the amendment to the Development Agreement with Del E. Webb Development Co., L.P., concerning the development of Planned Unit Development of Sun City Georgetown/1\4arianne Banks Motion by Bain, second by Arroyos to approve amendment to the Development Agreement. Approved 6-0. X Approval of a Revised Concept Plan (Second) of the Planned Unit Development of Sun City Georgetown, a 5,314 acre tract in the L. Dyches, F. Foy, B. Eaves, W. Roberts, M. Lewis, R. Jenkins, L. Russell, A. Short, G. Thompson, W. Wilkinson and D. Monroe Surveys/Ed Barry and Hildy Kingma Motion by Curl, second Bain to approve revised concept plan. Approved 6-0. Y License to encroach into the platted public utility easement and public right-of-way and a variance to Section 37040B. Of the Subdivision Regulations for a Planned Unit Development of Sun City Georgetown, Phase 1, Neighborhood One, Tract D for an entry feature wall/Ed Barry and Hildy Kingma Motion by Tonn, second by Hoyt to approve license to encroach into the platted public utility easement and variance. Approved 6-0. Approved 6-0. AA License to encroach into the platted public utility easements and a variance to Section 37040B. of the Subdivision Regulations for a Planned Unit Development of Sun City Georgetown, Phase 1, Neighborhood One, Tracts B and D for a fence along RM 2338/Ed Barry and Hildy Kingma Motion by Bain, second by Curl to uphold Planning & Zoning Commission's recommendation to approve the requested variance to Section 37040 B. to permit four foot tall fences with five foot columns to encroach into the 25 foot front building line along RM2338, after making the required findings of fact, provided a license to encroach, which permits the fences to encroach into the public utility easements. Approved 6-0. BB License to encroach into the platted public utility easements and a variance to Section 37040B. of the Subdivision Regulations for a Planned Unit Development of Sun City Georgetown, Phase 1, Neighborhood One, Tracts B and D for walls located at the intersection of RM2338 and Del Webb Boulevard/Ed Barry and Hildy Kingma Motion by Hoyt, second by Tonn to approve license to encroach into the platted public utility easements and variance. Approved 6-0 CC Second Reading of an ordinance to rezone a resubdivision of Sun City Georgetown, Phase 1, Neighborhood One, Tract U, and 10.0 acres in the W. G. Wilkinson and George Thompson Surveys, to be known as the Planned Unit Development of Sun City Georgetown, Phase 2, Neighborhood Ten -A; from A. Agricultural to C-1, Local Commercial/Ed Barry and Hildy Kingma Kingma read the caption. Motion by Bain, second by Curl to approve Ordinance 95-61 on second reading. Approved 6-0. DD Preliminary/Final Plat of a resubdivision of Sun City Georgetown, Phase 1, Neighborhood One, Tract U. and 10.0 Acres in the W. G. Wilkinson and Georgetown Thompson Surveys, to be known as the Planned Unit Development of Sun City Georgetown, Phase 2, Neighborhood Ten -A; and approval of variances to the Subdivision Regulations/Ed Barry and Hildy Kingma Kingma presented the plat. Motion by Hoyt, second by Vincent to approve preliminary/final plat. Approved 6-0. EE Preliminary Plat of a 475.52 acre tract to be known as the Planned Unit Development of Sun City Georgetown, Phase 2, and approval of variances to the Subdivision Regulations/Ed Barry and Hildy Kingma City Council Minutes/December 12, 1995 Page 5 of 7 Pages Kingma presented the plat. Motion by Bain, second by Tonn to approve preliminary plat. Approved 6-0. Bain expressed his appreciation to Del Webb for their efforts to educate Councilmembers regarding the development. FF Second reading of an ordinance providing for the annexation into the City of a 333.490 acre portion of the Sun City Georgetown Planned Unit Development, Phase 2, located in the Daniel Monroe, W. G. Wilkinson, George Thompson, Abner Short, R. T. Jenkins, and Mary Ann Lewis Surveys/Ed Barry and Clyde von Rosenberg von Rosenberg read the caption. Motion by Tonn, second by Bain to approve Ordinance 95-62 on second reading.. Approved 6-0. GG First Reading of an ordinance Adopting Impact Fees/Ed Barry Barry read the ordinance. Motion by Bain, second by Vincent to approve ordinance on first reading. Approved 6-0. HH Appointment to the Williamson County Health District/Mayor Wood Motion by Vincent, second by Hoyt to reappoint Darlene Lacy as the City of Georgetown's member on the Williamson County & Cities Health District Board. Approved 6-0. II Appointment to Planning and Zoning Commission/Mayor Wood Council decided to wait until January to make a new appointment to the Planning & Zoning Commission. JJ Establish regular monthly workshop meeting schedule/Bob Hart Council decided to begin workshops at 5:00 p.m. instead of having another meeting date. Meeting with Linda Goldzimmer - January 30 Retreat with Linda Goldzimmer - February 10 Vincent and Hart will attend the TML Governance discussion in Corpus Christi. Hart requested that Councilmembers give him their list of concerns to be discussed at the March retreat within the next two weeks.
