Council Members Present: Doris Curl George Arroyos Lee Bain Winfred Bonner Susan Hoyt Ferd Tann Dick Vincent Staff Present: Council Members Absent: None Bob Hart, City Manager Marianne Banks, City Attorney Cari Speegle, Deputy City Secretary Elizabeth Gray, Director of Management Services Larry Hesser, Chief of Police Micki Rundell, Accounting Director Jay Carlson, City Management Intern Ed Barry, Director of Development Services Susan Morgan, Director of Finance Randy Morrow, Director of Parks & Recreation Bill Shanklin, Fire Chief Jim Briggs, Director of Community Owned Utilities Workshoa--Called to order 5:45 p.m. A Annual Ethics Review/Marianne Banks Banks reviewed the ethics policy and ordinance. Wood, Curl, Arroyos, Bain, Hoyt, Tonn, Vincent and Hart each signed an Affidavit of Compliance with Ethics Ordinance. Bonner arrived after the ethics workshop was complete. Regular Session - Called to order 6:30 p.m. Executive Session B Sec.551.071 consultation with attorney C Sec.551.072 deliberation on real property D Sec.551.074 staff report City Council Minutes/May 23, 1995 Page 1 of 5 Pages Regular Session - Called to order at 7:27 p.m. E Action on Executive Session items There was no action on executive session items Public HearinZ F Annexation of: approximately 354 acres located south of Westinghouse Road (CRI l l) and east of the existing City limit boundary and the Pottery and More property/Ed Barry and Clyde von Rosenberg Barry explained the annexation and stated that this is the first of two required public hearings. There were no questions from the Council. Terry Isaacks presented letters to the Deputy City Secretary from he and Ray Isaacks. The following persons spoke against the annexation: Charles Johnson, Ray Isaacks, Norma Steel, and Attorney Phil Mockford. Mayor Wood asked that interested citizens contact Hart or Barry to answer any questions. Hart will contact Mrs. Steel tomorrow to address her concerns. The public hearing was closed at 7:59 pm. Consent Agenda G Approval of meeting minutes --Regular Meeting of May 9, 1995 and Special Meeting of May 15, 1995/Sandra Lee Bain requested that attendance at the May 15 meeting be corrected to indicate that he and Hoyt were present instead of Voltz and McMaster and that Arroyos was absent. H Approval of a resolution expressing official intent to reimburse costs of certain capital improvements projects with proceeds from bonds that will be issued at a later time/Bob Hart and Susan Morgan I Approval of work authorization #M68313, between the City of Georgetown and LCRA, to provide breaker additions and SCADA interface, in the amount of $40,000/Jim Briggs J Award of contract to Garney Companies, Inc., of Kansas City, Missouri, to construct the West Loop Phase II Water Line Project, in the amount of $539,412.50/Jim Briggs K Approval of a agreement with Triple S Plastics and Williamson County concerning tax abatement and designation of an industrial district/Marianne Banks L Approve deferring the detailed development plan requirement for addition at Georgetown Hospital/Ed Barry and Hildy Kingma City Council Minutes/May 23, 1995 Page 2 of 5 Pages M Approval of a variance from the fence requirements of the Subdivision Regulations for Reata Trails, Unit Three, Block A, Lots 1 and 2/Ed Barry and Hildy Kingma Bain asked if the fence was on the property line and if there was a problem with visibility. Barry responded that the fence is on the property line and the Planning Department had checked the visibility and there should be no problem. N Approval of vacation of the Wilding Subdivision, Sections One through Twelve in the A. Short, G. Thompson, and W. Wilkinson Surveys/Ed Barry and Hildy Kingma O Approval of a variance from building setback requirements of the Subdivision Regulations for 1.2 acres in the Lewis Dyches Survey, located at 4307 S. IH 35/Ed Barry and Hildy Kingma P Approval of a contract, between the City of Georgetown and David Ham & Associates, in the amount of $8,000.000/Jim Briggs Bain asked for clarification. Briggs responded that this is the first look at a comprehensive drainage plan for this area of town and the study will be paid for from the stormwater drainage fees. Bain asked if the study was really necessary and Briggs responded yes because it covers a very large area and there are caves that need to be evaluated. Q Approval of an abandonment of an alley at 111 East 16th Street and issuance of a license to encroach for wastewater line/Marianne Banks Bain asked for clarification. Banks responded that the wastewater line does run under the house and the property owner would be liable for any repairs, etc. to the line. Motion by Vincent, second by Curl to approve consent agenda with Item G being corrected as noted above. Approved 7-0. Regular Agenda Council will individually consider and possibly take action on any or all of the following items: (Council may, at any time, recess the regular session to convene in executive session at the request of the Mayor, a councilmember, or the City Manager.) R Citizens wishing to address the Council Ms. Bonnie Jurrell of 304 Woodstone, addressed the Council regarding a problem with water backing up on her property. She stated that she had tried to work out the problem with the builder but was unsuccessful. Jim Briggs will work with Ms. Jurrell to help resolve this issue. S Mayor, Council, City Manager, and staff comments and reports City Council Minutes/May 23, 1995 Page 3 of 5 Pages Notice of vacancy for Board of Adjustment and Convention & Visitors Bureau - Mayor Wood asked Councilmembers to submit their recommendations to Bob Hart, Sandra Lee or Cari Speegle and appointments will be made at the June 13 Council meeting. Hart amiounced the following meetings: Joint meeting with Library Board, June 12, 5:30 p.m., Library Board Room Focus Group Session on Subdivision Regulations Process with Linda Goldzimmer, June 20, 5:30 p.m., Recreation Center Arroyos complimented the Police Department for the P.D. Fair held this past weekend. Arroyos requested that Hart poll the Council for attendance at the Budget Retreat. All Councilmembers stated they will attend except Bonner who stated that his attendance will be determined by his medical condition. Hart will work with Bonner to make medical accommodations. Councilmembers will leave from City Hall at 4:00 p.rn on June 1. Curl asked that the Council look for a new approach for handling the Mayor Pro -Tem position. She suggested that the position be rotated among Councilmembers so that everyone has the opportunity to serve. The Council will discuss at the retreat. Mayor Wood read a letter from Harry Gold complimenting the Community Owned Utility staff for their quick response to the transformer failure this past week. Vincent complimented Jim Briggs and the Community Owned Utility staff for their handling of the transformer outage at the Palace Theater, Mayor Wood asked Tonn to fill the non-voting member position of the Industrial Foundation. Councilmembers interested in attending the TML Legislative Wrap-up Meeting on June 16-23 should contact Hart by June 5 for registration. T Second Reading of an ordinance authorizing the issuance of $5,200,000 City of Georgetown, Texas Utility System Revenue Bonds, Series 1995; authorizing the pledge of certain net revenues; approving a paying agent/registrar agreement and authorizing other matters relating to the issuance of the bonds/Bob Hart and Susan Morgan Morgan introduced Monte Nitcholas, Financial Advisor, First Southwest Company and Carol Polumbo, Bond Attorney, McCall, Parkhurst & Horton. Nicholas and Polumbo explained the bonds. Bain pointed out that the former Councilmembers were listed on the ordinance. Polumbo stated that the first reading of the ordinance was before the election and the ordinance would be corrected. City Council Minutes/May 23, 1995 Page 4 of 5 Pages Polumbo read the caption. Motion by Tann, second by Vincent to approve Ordinance 95- 22 on second reading. Approved 7-0. U Second Reading of an ordinance providing for the annexation into the City of a portion of the proposed Park Meadow West subdivision, approximately 4.7 acres located in the vicinity of the southwest corner of Williams Drive and Lakeway Drive (Tract 1), and a portion of the First Baptist Church property, approximately 15.4 acres located south of SH 29 and east of the intersection with D.B. Wood Road (Tract 2)/Ed Barry and Clyde von Rosenberg Barry read the caption. Motion by Tonn, second by Bain to approve Ordinance 95-23 on second reading. Approved 7-0, V Item pulled at owners request Recessed at 8:48 p.m. - Reconvened at 9:00 p.m. W Mid -year review for fiscal year 1994-95/Bob Hart and Susan Morgan Morgan briefed the Council on the financial structure of the City. Morgan and Hart reviewed a booklet distributed in the Council packets regarding the mid -year review. There was no action taken on this item. Executive Session -Second session was not necessary. All business completed during the first session..
