Council Members Present: Ferd Tonn Mike McMaster Dick Vincent George Arroyos Doris Curl Jane Voltz Winfred Bonner Staff Present: Bob Hart, City Manager Marianne Banks,. City Attorney Sandra Lee, City Secretary Ed Barry, Dir. of Development Services Hartley Sappington, Dir. of Community Svcs. Susan Morgan, Dir. of Finance & Admin. Council Members Absent: None Hildy Kingma, Chief Planner Clyde von Rosenberg, Chief Planner Larry Revering, Water/Wastewater Superintendent Workshop -Called to order 6:00 p.m. (incoming and outgoing Councilmembers) A Schedule of Council workshop and orientation sessions/Bob Hart Hart reviewed the schedule of upcoming events with the seated Council and the incoming members. Facilitators Dick Schott and Dave Clark asked Council to respond with issues they would like to cover at the Retreat. Consent Agenda - Called to order at 7:12 p.m. B Approval of meeting minutes --Regular Meeting of April 25, 1995/Sandra Lee C Approval of a development agreement for wastewater services for property along Shell Road/ Marianne Banks and Ed Barry Mayor Wood requested that it be read into the record that the approval of this item is subject to approval of the development agreement by the City Manager and City Attorney, D Approval of a resolution indicating intent to annex, setting of public hearing, and adoption of the service plans for the annexation of approximately 1,241 acres generally bordering the Stonehedge City Council Minutes May 9, 1995 Page 1 of 7 Pages (also known as Churchill Farms) subdivision to the west, south, and east/Ed Barry and Clyde von Rosenberg E Award of contract to Garney Companies, Inc., of Kansas City, Missouri, to construct the Pecan Branch Wastewater Interceptor, in the amount of $1,392,720.00/Jim Briggs F Award of annual bid for water meters to The Rohan Company in the estimated amount of $70,000.00/Jim Briggs and Terry Jones G Award of bid of aluminum underground cable to WESCO Distribution in the amount of $16,625.00/Jim Briggs and Terry Jones H Approval to initiate rezoning of Stonehedge, Sections One and Two from A, Agricultural, to RS, Residential Single Family/Ed Barry and Hildy Kingma Motion by Voltz, second by Vincent to approve the consent agenda. Approved 7-0 Regular Agenda I Citizens wishing to address the Council There were no citizens who wished to address Council at this time. J Mayor, Council, City Manager and staff comments and reports Curl thanked the Council and citizens for their support of the Grace Heritage Center project and spoke of a memorable event at the recent dedication ceremony last Saturday. K Second reading of an ordinance amending the Transportation Element of the Century Plan - Development Plan to eliminate reference to a future extension of Northwest Boulevard between Serenada Drive and Shell Road (RM2338/SH195 Connector) and to reduce the requirement for right-of-way on the remaining portion of Northwest Boulevard from 100 feet to 80 feet/Ed Barry and Clyde von Rosenberg von Rosenberg read the ordinance. Motion by Torn, second by McMaster to approve Ordinance 95-18 on second reading. Approved 6-1 (Voltz opposed) Voltz said she is still of the opinion that the Council should take up a transportation plan for all of Georgetown and give a response to the recommendations from the Planning and Zoning Commission. L Second Reading of an ordinance to rezone 3.0 acres in the Clement Stubblefield Survey from RS, Residential Single Family and I, Industrial to RM -2, Dense Multifamily/Ed Barry and Hildy Kingma Kingma read the ordinance. Motion by McMaster, second by Tonn to approve Ordinance 95-19 on second reading. Approved 7-0. City Council Minutes May 9, 1995 Page 2 of 7 Pages M Second reading of an ordinance amending Exhibit 1 of the Century Plan - Development Plan for 7.5 acres in the Clement Stubblefield Survey, located at Railroad Street and 22nd Street, and 3.0 acres in the Clement Stubblefield Survey, located at Leander Street and 22nd Street, from Intensity Level 3 to Intensity Level 5/Ed Barry and Clyde von Rosenberg von Rosenberg read the ordinance. Motion by McMaster, second by Curl to approve Ordinance 95-20 on second reading. Approved 7-0. N Approval to authorize payment of $25,000 from Council Contingency to Georgetown Independent School District for lighting at the Georgetown High School tennis courts/Bob Hart Hart told Council that this item had been placed on the agenda by Councilmembers Curl and Tonn who are members of the Joint City Council/School Board Committee. The payment of $25,000 would leave a balance in the Council Contingency fiend of $53,000. Voltz said that at least eight years ago parents started trying to get lights at the high school tennis courts. She said she is glad to see that it is a joint effort between the City and the school district. She commended High School Tennis Coach Kerry Minzenmayer, and said she would like to see tennis lessons offered at the Georgetown Recreation Center. Motion by Voltz, second by McMaster to authorize the payment of $25,000 for lighting at the high school tennis courts. Approved 7-0. O Consideration and possible action on the recommendation of the Council Compensation Committee/Sandra Lee Lee provided a memo to the Council on the digs, saying that the two members who were able to attend preferred not to make the decision without the support of the remaining four members of the committee who were not able to attend. Mayor Wood asked that the decision be deferred for consideration at a later time. Motion by McMaster, second by Arroyos to defer consideration of the Council Compensation Committee until a future date. P Approval of an ordinance canvassing the votes for the May 6, 1995, General Election and declaring the election results to be official --Emergency Reading/Sandra Lee Mayor Wood asked Councilmembers Tonn, Curl, and Bonner to exit the Council Chambers and canvass the votes as presented by tally sheets and returns from the Election Judges of each of the four precincts. Upon returning to the Bias, the three Councilmembers agreed that the count was found to be accurate. Lee read the ordinance. City Council Minutes May 9, 1995 Page 3 of 7 Pages Motion by McMaster, second by Voltz to approve Ordinance 95-21 on emergency reading. Approved 7-0. Q Comments by outgoing Councilmembers Outgoing Councilmember Voltz presented parting gifts to the other members of the Council, Mayor Wood and City Manager Hart as she joked with them and spoke of the memorable times she had spent with them during her years on the Council. She spoke of her gratitude at being able to serve on the Council and thanked the City staff for their support. Outgoing Mayor Pro -Tem McMaster said goodbye and thanked everyone for their support for the last eight years that he has served on the Council. R Swearing in of Councilmembers/Sandra Lee Councilmembers Arroyos and Vincent requested to be sworn in by Justice of the Peace Jimmy G. Bitz. Hoyt and Bain were sworn in by City Secretary Sandra Lee and took seats at the Bias. S Comments by incoming Councilmembers Vincent reaffirmed his desire to serve to the best of his ability and thanked the citizens of District 5 for re-electing him. He stated that he was looking forward to continuing the Council's work on Sun City, the River Corridor Park, and the transportation plan. Arroyos thanked the voters in District 1 for electing him to his first full term. He thanked McMaster for his leadership and sensitivity, and thanked Voltz for her insights and calming nature. He recognized his sister, Velma Barfield, as being an inspiration to him. Hoyt thanked everyone for their support and expressed her willingness to work with the Council. Bain recognized his parents in the audience and expressed his appreciation to Voltz and McMaster. He thanked the people who helped him with his campaign and the voters of District 4. T Election of Mayor Pro-Tem/Sandra Lee Mayor Wood expressed that as long as he has been in Georgetown it has been a tradition that the Mayor Pro -Tem has been the senior member of the Council. He asked for a nomination for Mayor Pro -Tem. Vincent nominated Doris Curl, saying that although they were a traditional council, they also were a progressive council, dealing with growth and change. City Council Minutes May 9, 1995 Page 4 of 7 Pages Wood asked for any other nominations. Motion by Arroyos, second by Vincent that nominations cease and that Doris Curl be elected by acclamation. Approved 7-0. U Swearing in of Mayor Pro-Tem/Sandra Lee Doris Curl was sworn in as Mayor Pro Tem by City Secretary Sandra Lee, Public Hearin V Annexation of: (1) the Stonehedge subdivision, Sections One, Two and three (also known as Churchill Farms); (2) a 48.51 acre tract in the William Addison Survey by Stonehedge Partners; and (3) a 2.735 acre tract in the William Addison Survey described as "Tract Five" in a Declaration of Restriction in Volume 2332, page 132 of the Williamson County land records/Ed Barry and Clyde von Rosenberg The Public Hearing was opened at 8:19 p.m. von Rosenberg explained that this was the second of two public hearings and read the service plan for the proposed annexation areas. There were no comments. The public hearing was closed at 8:24 p.m. Regular Agenda W First Reading of an ordinance providing for the annexation into the City of a portion of the proposed Park Meadow West subdivision, approximately 4.7 acres located in the vicinity of the southeast corner of Williams Drive and Lakeway Drive (Tract 1), and a portion of the First Baptist Church property, approximately 15.4 acres located south of SH29 and east of the intersection with D.B. Wood Road (Tract 2)/Ed Barry and Clyde von Rosenberg von Rosenberg read the ordinance. Motion by Vincent, second by Curl to approve this ordinance on first reading. Approved 7-0. X Councilmembers from Districts 1, 3, 4, and 5 to draw straws as to terms: 3 year terms (2), 2 year terms (2)/Bob Hart Hart explained that due to the Charter Amendment passed by voters last May, it would be necessary for the four newly elected councilmembers to draw lots to determine whether they would serve for two or three years. The City Secretary passed a basket containing slips of paper marked with "2- or 3 -year term." District 1 Councilmember Arroyos drew a two-year term; District 3 Councilmember Susan Hoyt drew a three-year term; District 4 Councilmember Lee Bain drew a three-year term; and District 5 Councilmember Dick Vincent drew a two-year term. Y Consider authorizing Councilmember Bonner to attend the Special African American Legislative Summit sponsored by the Congressional Black Caucus Foundation/Winfred Bonner City Council Minutes May 9, 1995 Page 5 of 7 Pages Wood explained that Council permission was needed for travel by a Counciimember to an out-of-state conference not previously listed in the Council Travel Policy - Resolution 910092. Bonner asked City Attorney Banks if she had checked with the Texas Attorney General about whether an opinion had been issued regarding the need for Council approval for travel. Banks responded that to her knowledge no such opinion had been issued by the Texas Attorney General. Arroyos asked that Wood entertain a motion on the subject. Wood replied that a citizen had requested to speak and recognized Jane Voltz. Voltz reminded Council to honor each other's feelings and resolve issues in a mamzer that would be best for the City as a whole. Wood asked for a motion to approve the request. Motion by Curl to deny the request. She spoke of her respect for Councilmember Bonner and his service to his district and the community of Georgetown, but after reviewing the agenda packet and speaking with others, she felt there were better ways to resolve the issue. Arroyos stated that he grew up as a migrant field worker, and he feels he understands the concerns of people with color, and has worked side by side with other minorities in efforts to be accepted and represented in all issues. He talked of setting positive examples of leadership and not dwelling on negative accusations in order to achieve equality. Wood asked for comments from other Councilmembers. Vincent stated that he was appalled at the accusations from Bonner at the last Council Meeting. He told Bonner that he and the other Councilmembers had spoken about attending many functions together, and that Bonner was not in attendance at many of those functions. He said he has a problem sending him to a meeting about issues that don't really affect Georgetown, when Bonner can't seem to attend the local meetings that do affect Georgetown. Bonner stated that he plans to go anyway. His reason for bringing it up was because of the NLC "network" that shares information among all black councilmembers in the nation. He said he will always bring forward any item that he feels is discriminatory. Vincent seconded the motion on the floor by Curl to deny the request by Bonner. Approved 6-1. (Bonner opposed) Executive Session Z Sec.551.071 consultation with attorney AA Sec.551.072 deliberation on real property City Council Minutes May 9, 1995 Page 6 of 7 Pages BB Sec.551.074 staff report Regular Session CC Action on executive session items, including any formal resolutions authorizing litigation as needed. Banks read a resolution authorizing participation with other cities of similar situation to take action against GTE Southwest to collect delinquent franchise fees. Motion by Hoyt, second by Bain to approve this resolution. Approved 7-0. DD Final comments and evaluation of meeting process Wood and Hart welcomed the new members of the Council.
